RECOMMENDED ACTION: If the City Council concurs, your action is to Introduce Ordinance No.�Z2-y--3 ITEM EXPLANATION: The City Council, at your December 15, 1981 meeting, indicated that they wished to consider an ordinance effectuating the increases in Council salary as provided in state law. A memorandum explaining the law and an ordinance in that regard are attached. The ordinance also provides for additional compensation for our elected Mayor as authorized by Government Code Section 36516.1. MEMORANDUM DATE: December 8, 1981 TO: Mayor and City Council FROM: City Attorney SUBJECT: CITY COUNCIL SALARIES For the last eight years it has been our practice in December, preceding election years, to remind the Council of the law regarding Council salaries. The current'Council salary of $279.00 per month was set by Ordinance 1227 in January of 1980. Pursuant to Government Code Section 36515.2, all members of the City Council are eligible for a 5% increase in salary for 1980 and a 5% increase in salary ` for 1981. This amounts to an increase of $29.00 per month. The Assistant City Manager for Development, by memorandum dated December 8, 1981, reports that the recently completed federal, census fixes the population of Carlsbad at slightly in excess of 35,000. The basic salary schedule for each member of the City Council is set by Government Code Section 36516 which has steps based on population. Since incorporation we have been operating under Subsection (a) for cities up to and including 35,000 in population--$150.00 per month. We now come within Subsection (b), cities over 35,000, up to and including 50,000 in population--$200.00 per month. That necessitates an additional increase in salary of $50.00 per month, for a new monthly salary of a total of $358.00 ($279.00 + $29.00 + $50.00). Government Code Section 36516.5 provides that the increases in salary may not be effective until a new member is seated on the Council, which should occur in June, 1982. If the Council wishes to pursue this matter further the attached ordinance which we have prepared should be introduced at one of your January 1982 meetings. The Municipal Code also provides for a salary of $50.00 a month for the Mayor, which is in addition to his City Council salary. If the Council wishes to consider any adjustments to Municipal' Code Section 2.04.040, which provides for the Mayor's salary, that should be accomplished as a part of the Council's salary ordinance and you should instruct us to add the necessary section to the ordinance. y Mayor and City Council -2- December 8, 1981 If any member of the Council wishes this matter discussed further, it would be appropriate to do so at the December 15,, 1981 meeting at which time the Council may wish to direct us to prepare the documents for Council action in January. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Title 2, Chapter 2.04 of the Carlsbad Municipal Code is amended by the amendment of Sections 2.04.010 and 2.04.020 to read as follows: "2.04.010 Compensation. Each member of the City Council shall receive as salary the sum of $329.00 per month as authorized by Section 36516 of the Government Code for cities over 35,000 and up to and including 50,000 in population and, by previously adopted ordinances authorized by Section 36516.2 of the Government Code, plus the sum of $29.00 per month, representing an increase of 5% per year for each calendar year from the operative date of the last adjustment of salary, for a total of $358.00 per month payable at the same time and in the same manner as salaries are paid to other officers and employees of the City. The salaries established by this section are exclusive of any amounts payable to each member of the City Council as reimbursement for actual and necessary expenses incurred in the performance of official duties for the City. This section shall become operative only on and after the date upon which one or more members of the City Council become eligible pursuant to Section 36516.5 of the Government Code for a salary increase by virtue of beginning a new term of office following adoption of this section. 2.04.020 Elected mayor --additional compensation. The mayor, elected pursuant to Sections 34900 to 34904 inclusive of the Governn,-nt Code, shall receive a salary of.one hundred dollars per month in addition `o the salary he receives as a member of the council as authorized by Section 36516.1 of the Government Code.
