SE O§ o oo RECOMMENDED ACTION: Both the planning staff and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING ZC-241, per Planning Commission Resolution No. 1902. ITEM EXPLANATION This item is a request for approval of a preannexational zone change from County A-70-8 (agricultural 8 acre minimum lot size) to P-M (Planned Industrial) for a 13.4 acre parcel located immediately north of Palomar Airport between the Roll Property and the Signal Landmark property. The Planning Commission found that the proposed P-M zone is consistent with the general plan designation of Planned Industrial on this property. Also, the Commission found that uses allowed in the P-M zone would be consistent and compatible with surrounding land uses and zoning. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not cause any significant environmental impacts and,-therefore, has issued a Conditional Negative Declaration, dated December 7, 1981 and approved on December 23, 1981. FISCAL IMPACT The applicant will provide all required public improvements to the project. Also, the applicant has agreed to pay a public facilities fee to offset the costs of providing all other public services. ATTACHMENTS A. PC Resolution No. 1902 B. Staff Report, dated December 23, 1981 w/attachments 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1902 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM COUNTY A-70-8 TO CITY OF CARLSBAD P-M ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF PALOMAR AIRPORT APPLICANT: HIEATT CASE NO; ZC-241 WHEREAS, a verified application for certain property, to wit: All that portion of Lot "F" of the Rancho Agua Hedionda according to Map 823 filed November 16, 1896. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 23rd day of December, 1981, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THE'REFORE, BE IT HEREBY RESOLVED by the Planning Commis- sion as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing, the Commission recommends approval of ZC-241 based on the following findings and subject to the following conditions: Findings; 1) The proposed change of zone to P-M is consistent with the General Plan designation of P-I since a designation like this is applied to an area which is suitable for industrial develop- ment. 2) The P-M Zone is compatible with surrounding properties since other properties are presently vacant but are zoned industrially and will develop as'industrial in the future. 3 3) The applicant has agreed and is required by the inclusion of an rent with need as required by the General Plan. 6 4) The Planning Director has determined that this zone change will 7 not have a significant impact on the environment and therefore has issued a Conditional Negative Declaration on December 7, 8 1981 which was approved by the Planning Commission on December 23, 1981. 9 5) Prior to development of this property, a site development plan 10 11 12 15 16 17 18 19 25 26 appropriate condition to pay a public facilities fee. At that time the applicant will be required to comply with all mitigation mea- sures of the Conditional Negative Declaration. 6) The proposed change of zone is consistent with all other ele- ments of the General Plan. 13 Conditions 14"1) This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated May 29, 1981, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 20 2) Prior to development of this property, a Site Development Plan must be approved by the Planning Commission. 21 3) During construction, the following measures shall be observed 22 to protect adjacent archeological sites: 23 a. Prior to any construction activity the boundaries of the property shall be clearly marked. 24 b. Any construction equipment, materials, and vehicles shall be staged in areas devoid of cultural resources. c. Adjacent parcels of land shall be restricted from use as borrow pits for construction activity. 27 d. Construction personnel shall be restricted from random 28 grading or surface collections. I. Project Description and Past History The applicant is requesting that the zoning of the above de- scribed parcel be changed from County A-70-8 to city of Carlsbad P-M (Planned Industrial). At the present time, the properties to the north, east and west are vacant while Palomar Airport is located to the south. The Roll Company's industrial and com- mercial development will occur to the north and east of this property. The property to the west of this site will be devel- oped for industrial purposes by the Signal Landmark Company. Topographically the site is dominated by a plateau which is oriented north-south through the center of the property. Slopes declining from this plateau vary from quite steep at the north- ernmost point to very mild along the southern and eastern por- tions of the property. Over 50% of the site is relatively flat. Access to subject property is presently provided by circuitous dirt roads crossing both the Roll property to the north and east and the Signal Landmark property to the west. Future access to this project will be via a paved public street which will be a part of the Signal Landmark industrial development. II. ANALYSIS Planning Issues; 1. Is the proposed PM zone consistent with the PI General Plan designation? 2. Is the proposed PM zone and uses allowed within this zone consistent with surrounding zoning and land uses? Discussion The requested zone change to P-M (Planned Industrial) will be consistent with the recent General Plan Amendment that changed the land use designation of this property from NRR (Non-Residen- tial Reserve) to PI (Planned Industrial). The proposed P-M zon- ing and the uses permitted within it will be consistent with sur- rounding zoning and land uses. As previously mentioned, the pro- perties to the north, east and west will be developed with indus- trial uses, while Palomar Airport is located directly to the south of the subject property. Prior to development of this property, a site development plan will be required because this property is designated as a special treatment area on the General Plan since it is in close proximity to Palomar Airport. Staff feels that the uses permitted by the P-M zone are compatible with future industrial land uses that will be built in the area, therefore, staff recommends approval of the requested zone change. IV. Environmental Review The Planning Director has determined that, as conditioned, the approval of ZC-241 will have no significant impact upon the sur- rounding environment. An archeological survey of this property on September 10, 1981 revealed that there were no archeological, prehistoric or historic sites on the property. However, the sur- vey pointed out a number of archaelogical sites in close proximi- ty to this project and suggested four mitigation measures to pro- tect these sites from any indirect impacts caused by the develop- ment of the subject property. The measures have been made condi- tions of the Negative Declaration and are indicated on the at- tached Initial Study. A biological survey of the property on September 13, 1981 re- vealed the presence of Dichondra Occidentalis, which the biolo- gist doing the survey considered a rare and endangered species. However, recent studies made by other environmental consultants indicate that Dichondra Occidentalis is not as rare and endan- gered as previously thought (refer to attached environmental documents). Staff has field checked the site and feels that the removal of the Dichondra Occidentalis from this site should not create a significant environmental impact. -2- — S**«r Recommendation It is recommended that the Planning Commission APPROVE the Condi- tional Negative Declaration issued by the Planning Director and adopt Resolution No. 1902 recommending APPROVAL of ZC-241 to the City Council based on the findings and subject to the conditions contained therein.
