On March 11, 1982 the agreement between CRMWD and the City will expire. This 1972 agreement set a service boundary line between the two jurisdictions. After March 11, 1982 both agencies have the legal power to sell water within territorial boundaries. The agreement was revoked by the City Council in March, 1981 for the following reasons: 1. The City desires to serve water to new developments outside the existing boundary. 2. The City wishes to negotiate an agreement on the distribution of nonpotable (reclaimed) water within the City. 3. The City is concerned about the planning and financing of long-range capital improvements within the CRMWD territory. During 1981 the City was unable to negotiate a settlement of these issues primarily because of the subsidiary district election held November 3, 1981. During the election campaign CRMWD represented that a reclaimed water master plan and a capital improvement plan were being prepared. Currently, the District is taking the position that the voters want the "status quo." In order to avoid bickering over water service to new developments, it is essential to resolve the territorial dispute. At the moment there is insufficient information available to decide what is best for the City as a whole. We need to develop facts and positions of each agency. In order to allow time to do this, it is suggested the agreement be extended for one year provided each party is willing to accomplish the following: (Cont'd on next page) January "19, 1982 Page 2 . CITY 1. Appoint a Public Utilities Commission of leading citizens to advise the Council on water system and waste water reclamation planning. 2. Develop a water system and sewer system master'plan. 3. Develop a long-range capital improvement financing plan. CRMWD 1. Complete the waste water reclamation master plan. 2. Prepare a water system master plan.. 3. Prepare a long-range capital improvement and financing plan. The goal would be to complete these plans by August 1, 1982, At that point, negotiations would commence on rewriting the existing agreement. A settlement would be sought by January 1, 1983.
