RECOMMENDED ACTION:
Adopt Resolution No. (t adopting regulations for candidates
with any desired modifications, and reaffirm the $25.00 filing fee.
ITEM EXPLANATION:
On January 12, 1982, Council adopted Ordinance No. 1242 changing
the date of the City's General Municipal election to coincide with
the date of the statewide primary election. The ordinance was
approved by the Board of Supervisors and became effective on
January 19, 1982. On January 20, 1982, the notice of the change of
election date was mailed to every registered voter in the City of
Car 1 s bad .
The date of the next Municipal election is June 8, 1982, and the
nomination period for that election is from February 16, 1982 to
March 12, 1982. If the incumbent of an office does not file, the
nomination period will extend for 5 days - to March 17, 1982.
In preparation for the nomination period, Council needs to adopt
regulations for candidates. The attached Resolution has been pre-
pared in accordance with past Council actions. However, Council
may change the regulations on three matters if they desire:
1. The length of candidates statements may be
OR a 400 word maximum.

The Council may require the candidate to pay his pro-rated
share of printing candidate statements in Spanish OR the City
would pay for the Spanish printing.
The Council may require candidates to pay their pro-rated
printing cost in advance when they file OR after the actual
printing is finished and upon receipt of a bill.
The Registrar of Voters Office indicates a candidate's cost for
printing a candidate's statement (using 200 words) would be as
follows:

A final issue for consideration is the filing fee. In accordance
with Section 22843 of the Election Code, a filing fee not exceeding
$25.00 may be required.
The attached resolution provides for 200-word statements, billing
candidates after printing is complete, and billing for only the
English printing. Council may make any changes they desire.

FISCAL IMPACT:
If the City pays for printing the Spanish translation of candidate
statements not exceeding 200 words each, it will cost approximately
$70.50 per candidate statement. The remainder of the cost will be
born by candidates.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
2 OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS
FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING
3 TO MATERIALS SUBMITTED TO THE ELECTORATE AND
COSTS THEREOF.

WHEREAS, Section 10012 of the Elections Code of the

State of California provides that the governing body of any
6
local agency adopt regulations pertaining to materials prepared
7
by any candidate for a municipal election, including costs
8
thereof;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
10
CARLSBAD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE
11
AND ORDER AS FOLLOWS:

SECTION 1. GENERAL PROVISIONS. That pursuant to

Section 10012 of the Elections Code of the State of California,

each candidate for elective office to be voted for at any
15
General Municipal Election to be held in the City of Carlsbad

may prepare a candidate's statement on an appropriate form
17
provided by the City Clerk. Such statement may include the
18
name, age and occupation of the candidate and a brief
19
description of no more than two hundred (200) words of the
20
candidate himself. 'Such statement shall not include party
21
affiliation of the candidate, nor membership or activity in
22
partisan political organizations. Such statement shall be filed
23
in the office of the City Clerk at the time the candidate's
24
nomination papers are filed. Such statement may be withdrawn,
25
but not changed, during the period for filing nomination papers

and until 5:00 P.M. of the next working day a'fter the close of

the nomination period.

SECTION 2'. SPANISH LANGUAGE. The City clerk shall
provide a Spanish translation of the candidate's statement to be
made available to any voter upon request, -and shall so indicate
. its availability in the Voter's Pamphlet.
K SECTION 3. ADDITIONAL MATERIALS. No candidate will be6
f permitted to include additional materials in the sample ballot
package.
SECTION 4; PAYMENT. Each candidate filing a
candidate's statement shall be billed for the services rendered,
a sum not greater than the actual prorated costs of printing and
handling; and such bill shall be due and payable immediately
up on receipt thereof.
SECTION 5. That the City Clerk shall provide each
candidate, or .the candidate's representative, a copy of this
resolution at the time nominating petitions are issued.
SECTION 6. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same in
•\Q the book of original resolutions of said City; and shall make a
minute of passage and adoption thereof in the records of the
20 proceedings of the City Council of said City, in the minutes of
21 the meeting at which time the same is passed and adopted.
