RECOMMENDED ACTION:
Introduce Ordinance No. /ay 7 amending Section 2.24.070 of the Carlsbad Municipal Code to eliminate the four affirmative vote requirement for Planning Commission action.
STATEMENT OF MATTER:
This is a technical amendment to clarify the voting requirement for Planning Commission actions. Certain sections of state law require a greater than majority of the quorum vote, e.g. general plan and specific plan amendments require an affirmative vote of a majority of the Planning Commission members.

ORDINANCE NO. 1247
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2,
CHAPTER 2.24 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 2.24.070 TO
CLARIFY THE VOTE REQUIREMENT FOR CERTAIN
PLANNING COMMISSION ACTION.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 2 Chapter 2.24 of the Carlsbad
Municipal Code is amended by the amendment of Section 2.24.070
(b) to read as follows:
(b) Except when otherwise provided by law, a majority
vote of the quorum shall be required for any Planning Commissio
act ion.
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certif
to the adoption of this ordinance and cause it to be published
at least once in the Carlsbad Journal within fifteen days after
its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 2nd day of March 3
1982, and thereafter
