HD.8L~t^jt= HITY MGR.«^^ o LU § C£O_ O. os o Oo RECOMMENDED ACTION: The Planning Staff recommends that the resolution approving the initiation of annexation of Macario Canyon Park be APPROVED and forwarded to LAFCO for processing. ITEM EXPLANATION This item is a request by the city of Carlsbad for the initiation of annexation of 288 acres of city owned property referred to as Macario Canyon Park. The property is generally located east of Agua Hedionda Lagoon, south and west of El Camino Real as shown on the attached location map. City approval of this resolution precedes application submittal and processing by LAFCO. If LAFCO approves the annexation of this property to the city, the City Council must then approve the formal Resolution of Annexation to complete the proceedings. ENVIRONMENTAL REVIEW The City Council has certified an Environmental Impact Report (EIR-80-9) the Macario Park Plan on February 9, 1982. A copy of the environmental documents is on file in the Planning Department Office. FISCAL IMPACT No fiscal impacts would be created by initiating the annexation of this property to the city of Carlsbad. Fiscal impacts resulting from the actual annexation of the property will be addressed at the time the City Council considers the Resolution of Annexation. ATTACHMENTS A. Location Map RESOLUTION NO. 6805 1 2 3 AS THE MACARIO CANYON ANNEXATION. 4 n1 •'••'• iden-tified and described as Macario Canyon Annexation to the City T P•*• 16 17 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE INITIATION OF ANNEXATION PROCEEDINGS FOR CERTAIN UNINHABITED TERRITORY HEREINAFTER DESCRIBED AND DESIGNATED WHEREAS, the City of Carlsbad owns 288 acres located in the County and identified as Macario Canyon; and WHEREAS, the City of Carlsbad desires to annex said property into the City of Carlsbad; and WHEREAS, the City of Carlsbad is desirous of initiating proceedings for the annexation of the territory hereinafter of Carlsbad, County of San Diego, State of California, with the Local Agency Formation Commission; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, gs follows: 1. That the above recitations are true and correct. 2. That the aforementioned uninhabited territory included in the proposed annexation is hereby designated and shall hereafter be known as the Macario Canyon Annexation. 3. That the territory described as Macario Canyon annexation is uninhabited territory as defined by Section 35038 of the Government Code and is contiguous to the boundaries of the City. 4. That all requirements of law necessary to adopt this resolution initiating proceedings of the annexation of certain uainhabited territory pursuant to the provisions of the Municipal Organization Act of 1977 have been complied with. 5. That it does hereby approve the initiation of ""• proceedings for the annexation to the City of Carlsbad of that 2 3 4 5 6 7 8 10 15 17 certain real property located in the County of San Diego, State of California, designated as the Macario Canyon Annexation and more particularly described as follows: A parcel of land being a portion of Lot F and a portion of Lot G of Rancho Agua Hedionda, in the County of San Diego, State of Ca1ifornia, accord ing to map thereof No. 823 on file in the office of county recorder of San Diego County, described as follows: Beginning at point 9 of said Lot F: 1. thence north 0 * 29' 1 1" west, along the westerly boundary of said Lot F, 167.78 feet to a point on the arc of a _« nontangent 58.00 foot radius curve, concave westerly a ' radial line to said point bears south 55°03'22" east; 12 2. thence northerly along the arc of said curve through a central angle of 70°51'37" a distance of 71.73 feet to said westerly boundary; 14 3. thence, north 0°29'11" west 2092.42 feet to point 8 of said Lot F; 4. thence, north 6C47'51" east, 1219.60 feet to a point on the northerly line of said Lot F, distant south 87°23'24" east 2025.08 feet from point 6 of said Lot F; 5. thence, south 87°23'24" east 2417.19 feet to the northwest corner of the land described in deed to Howard G.
