Og O OO ITEM EXPLANATION: The attached ordinance would shorten the time limit for appealing planning commission actions on condominium permits and planned unit developments from fifteen to ten days. This is consistent with recent changes on the time limits for appealing actions on subdivisions. The ordinance would also permit concurrent hearings on general plan amendments and zone changes. This is consistent with new state law and should eliminate some delay on the development process. FISCAL IMPACT: None EXHIBITS: Ordinance No. / (0 / & o § | 1° ^> h- a:< <r 2 3 4 5 6 7 8 9 10 11 12 13 d-| 145° ii Ml »U. • -1 Sv UJ O Z ^ 8 Q 16 17J- 'is 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO.9616 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21 BY THE AMENDMENT OF CHAPTERS 21.45, 21.47, AND 21.52 TO SHORTEN THE APPEAL PERIOD FOR PLANNED UNIT DEVELOPMENT PERMITS AND CONDOMINIUM PERMITS FROM FIFTEEN TO TEN DAYS AND TO ALLOW THE CONCURRENT PROCESSING OF GENERAL PLAN AMENDMENTS AND ZONE CHANGES. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That Title 21, Chapters 21.45 and 21.47 of the Carlsbad Municipal Code are amended by the amendment of Sections 21.45.083 and 21.47.075, respectively, to replace the word "fifteen" with the word "ten" as it applies to the time for filing appeals, SECTION 2: That Title 21, Chapter 21.52 of the Carlsbad Municipal Code is amended by the amendment of Section 21.52.040 to read as follows: 21.52.040 Hearing_.Upon the filing of a verified application, or the adoption of a resolution of intention by the Planning Commission or the City Council, the Planning Commission shall hold one public hearing thereon, as required by Chapter 3, Title 1, of the Planning Act of the State of California, and notice of hearing shall be given as provided in Chapter 21.54. The hearing on a zone change may be held at the same time as a hearing on adopting or amending the general plan, or any element thereof, fcr the subject property. SECTION 3: That Title 21, Chapter 21.52 of the Carlsbad Municipal Code is amended by the amendment of Section 21.52.100 to read as follows: 21.52.100 Public hearing on commission's recommendations and amendments and appeals. Within not to exceed thirty days following receipt of the resolution from the Planning Commission recommending the adoption of the amendment or the filing of a written appeal from an order of the commission denying an application for amendment, as provided in this article, the City Council shall conduct a duly advertised public hearing on the mat-er public notice of which shall be given as provided in Chapter 21,54. 2 3 4 5 6 7 8 9 10 11 12 13 Q< CO „3 o*< i2&ii 14 __ <t. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a meeting of the Carlsbad City Council held on the 6th day of April , 1982, and thereafter PASSED AND ADOPTED at a meeting of said City Council held on the 20th day of April f 1932 by the following vote, to wit: AYES: Council Members Packard, Casler, Anear, Lewis NOES: None ABSENT: Council Menber Kulchin RONALD C.
