RECOMMENDED ACTION:
Council consider recommendations of the Traffic Safety Commission
regarding Pasco del Norte and adopt:
A. An ordinance to restrict parking on a portion of Pasco del Norte
(Exhibit C);
B. An ordinance to include a portion of Pasco del Norte as a truck
route (Exhibit D); and
C. An ordinance to revise the speed limit on Pasco del Norte
(Exhibit E).
ITEM EXPLANATION:
At the March Traffic Safety Commission meeting, a group of residents
approached with a variety of concerns among which were excessive
trucks on Poinsettia Lane. They felt that in addition trucks were
using Pasco del Norte since the California 16' Motel was built.
They also complained of the narrowed street section and alleged
speeding on Pasco del Norte.
Staff presented four recommendations to help ameliorate the problems.
All four were adopted except that the Commission felt that the speed
posting should be 35 mph instead of 45 mph as staff recommended.
The results of the speed study are attached to the Staff Report.
The removal of parking would eliminate some of the complaints about
poor sight distance due to truck parking. In addition, the businesses
on the east side of the street have requested removal of parking to
prevent a pile up of trucks on that side. The revised 'no truck
route' would allow police to enforce the non -truck route status of
Pasco del Norte. The attached Staff Report addresses some of the
issues involved in speed signing.
FISCAL IMPACT.:
All items have minor fiscal impacts associated with revised posting
and striping as well as increased enforcement.

STAFF REPORT

SUBJECT: SPEED STUDY REPORT
On March 1, 1982, the results of a speed study were presented to the
Traffic Safety Commission. As the attached speed study indicates,
the critical speed 85th percentile in the area is 44 MPH uphill
and 46 MPH downhill. i
Based on these results and concerns expressed by the citizens, the

Traffic Safety Commission indicated that they were not satisfied
with the results. The issue here relates to the Vehicle Code (Sec-
tion 22358) which indicates that if a speed other than that mandated
by law is to be posted, it shall be supported by an engineering
s tudy .
In the past, certain areas have been posted as a result of findings
by the Engineering staff of conditions warranting reduced speed -
Levante and Alga. In accordance with a speed study, stafr recom-
mended an advisory speed limit posting of 45 MPH for Paseo del Norte
based on the 85th percentile and the lack of a sufficient number of
factors indicating a reduced posting would be required.
1. There is no significant accident picture in the area indicating
speed or pedestrian related accidents.
2. The Paseo del Norte is not, nor would it ever be, definable under
the current State law as a residential street.
3. There is no indication of school age or younger children who
might be imperiled by cars.
There are two factors which could normally be considered as backup
justification (but not sole justification) for a reduced speed post-
ing. They are not usually advanced as the sole justification.
1. There is poor sight distance at Caminito Madrigal - no signifi-
cant accident picture exists at this location.
2. There is a small volume of pedestrians who cross the street to
use the recreation area and R.V. storage area. It would normally
be assumed that the majority of those crossing the street were
not incapacitated.
Neither of the above factors should probably be used as a general
basis for reduced speed on an arterial, unless all consistency is to
be abandoned, since almost any arterial in the City can be alleged
to have at least one intersecting street which has poor sight dis-
tance and no unusual conditions involving pedestrians exist.
If ;he City adopts the 35 MPH speed limit without proper engineer -
in justification, it still can be posted, but may fall within the
in definition of a speed trap. It is normal p-actice for police
s to be requested by the courts for

a proper speed study if a motorist contests the posting. What has
happened in most instances is that the police have not been able to
sustain the infraction in court and they have tended to avoid en-
forcement which cannot be sustained by the courts.
It is therefore recommended that the street be posted 45 MPH based i
on the findings of the engineering study. The approach speed to
Caminito Madrigal could be posted 35 MPH but that seems inadvisable,
as speed limits in the opposite direction would be different and ;
possibly confusing to the driving public. i
Staff has prepared an ordinance ,-,hieh specifies 45 MPH. If Council
finds in concurrence with the Commission that a 35 nPH speed limit i
is more appropriate, then the 45 MPH in the ordinance should be
modified to 35 MPH.
l.f Council determines that 35 MPH speed limit is appropriate only
for the approach to Camino Madrigal, then a clause calling for an
exception to the 45 MPH ordinance is .appropriate:
"Except for 35 MPH shall be the legal speed for southbound
vehicles from 400 feet north of Caminito Madrigal to Caminito
Madrigal."

The City Council of the City of Carlsbad, California, hereby ordains as
fol lays:
SECTION' I: That Title 10, Chapter 10.32, Section 10.32.091 of the Carlsbad
Municipal Code is amended by the addition of Subsection (h) to read as follows:
"(h) Paseo del Norte from Palomar Airport Road Southerly 1150 feet."
EFFECTIVE DATE: This ordinance shall be effective thirty days after.its
adoption, and the City Clerk shall certify to the adoption of this ordinance
and cause it to be published at least once in the Carlsbad Journal within
fifteen days after its adoption.
