Specifically, the applicant requests a reduction of the number of units from 19 to 18 by eliminating the northernmost unit on the third floor. This result in a density of 26.4 du/ac, within the General Plan r o€ 20-30 du/ac designated on this site. This request is being made because the originally approved for this project indicated an incorrect site acerage of .8 a The actual acreage of this site is .68 acres. Based on the correct acreage, the actual approved density is 27.9 du/ac, units per acre higher than the density of 23.7 du/ac which h incorrectly represented at the City Council meeting. This error was discovered at the Coastal Commission hearing as a result, a condition was placed requiring the applicant secure a letter from the city verifying that the project doc exceed a density of 23.7 du/ac. Since the project does excc this density, the applicant will be subject to further Coas? Commission review. Staff believes that the proposed changes are minor in naturt should be approved. In effect, the project will be reduced unit; no other development standards will be affected. The represented density will increase from the incorrect 23.7 dt to 26.4 du/ac. Coastal Development Permit 6-82-007 9 e STAFF REPORT DATE : April 20, 1982 TO : City Council FROM : Planning Department SUBJECT: CT 81-44/CP-190, AMERICAN WEST - Request for a minor revision to a 19 unit tentative tract map and condo- minium permit on property located on the east side of Carlsbad Boulevard between Tamarack Avenue and Sequoi Avenue in the RD-M zone. I. PROJECT DESCRIPTION The applicant is proposing to reduce the number of units from to 18 by eliminating the northernmost unit an the third floor. This will result in a density of 26.4 du/ac. The applicant is requesting that the City Council find this change to be a minc revision to the previously approved tentative tract map and condominium permit. This amendment is being processed because the oriqinal plans f this project indicated an incorrect acreage which affected thc project's overall density. On the submitted exhibits, the applicant represented the acreage of the site as .8 acres whil in reality, it is .68 acres. As a result, the City Council approved a project which they thought had a density of 23.7 dL when in reality it had a density of 27.9 du/ac. This error was discovered at the Coastal Commission hearing ar the Coastal Commission placed a special condition on the apprc of the project which stated: Prior to transmittal of the coastal development perm the applicant shall submit to the District Director i letter from the city of Carlsbad Planning Department verifying that the density of the project does not exceed 23.7 dwelling units per acre based on the acrc for the project site that the city allows for determ ing density (see attached Coastal Permit). Since the project exceeds this density, the city cannot write letter. The applicant is unwilling to reduce the project by units to comply with a density of 23.7 du/ac. EXHIBIT 1 9 0 Background The City Council originally denied a 21 unit project for this site, on September 1, 1981. The Council was concerned with tk density of the project and directed the applicant to redesign project to reduce its massiveness and lower its height. On October 21, 1981 the applicant submitted a revised plan for l! units, which slightly reduced the height and massiveness of tl project. According to the information supplied by the applic( this redesign would have reduced the density to 23.7 du/ac. Despite strong oppostion from the surrounding residents, this project was approved by both the Planning Commission and City Council. As mentioned previously, the discrepancy in the acreage of the site was discovered when this project was submitted to the Coastal Commission. 11. ANALYSIS 1. Are the proposed revisions minor in nature and substantially in conformance with the previously approved tentative tract map and condominium permit Discussion As mentioned previously, the applicant is proposing to reduce the number of units from 19 down to 18 by eliminating the northernmost unit on the third floor. This will result in a density of 26.4 du/ac. The original plan for this project, du/ac. When denying this project the City Council expressed concerns about the density and massiveness of the project. T second plan for this project, which was approved by the city, represented the density as being 23.7 du/ac when in reality i was 27.9 du/ac. As shown by these figures, the proposed revisions will result in a density almost identical to the fi pro j ect . The Council should be aware that staff has concerns about the size of this project in relation to the existing structures i the vicinity. Staff feels that the massive design of this project is out of character with the existing buildings in th area. However, staff feels that the proposed reduction in density makes the project more acceptable. The elimination o the northernmost unit on the third floor will help to reduce massive appearance of the building. As shown on the elevatio the revised project will step-up from both the north and sout which provided for 21 units, represented the density as 26.25 ends * In summary, the proposed revisions will result in less dwelli units, but a greater density due to the acreage error on the previously submitted plans. Overall, the revised project wil have less effect on the neighborhood than the previously approved pro] ect . -2- e 0 Recommend at ion Staff has reviewed the proposed revisions and recommends that the City Council find them minor in nature and substantially : conformance with the previously approved tentative tract map i condominium permit. I e PROJECT-DESCRIPTION- AND- BACKGRCUND -- The applicant' proposes to construct a 13 unit condominium pro]( on a .8 acre parcel located. as described above. The project s consists of a number of parcels with a single family dwellinq ( the southerrmost parcel. The subject property gently slopes tc the west until it get;; close to the surrounding streets, then slopes dcwn steeply froin a few feet to nearly fourteen feet ;zt the southwesterly corner of the property. On June 4, 1980, the Floir Devco Company submitted a similar pr ject to the Pianning Department. At that time, the project cc sisted of 21 units and the building height was slightly higher than this project. The Plmninq Commission recommended appro\ of the proposed project at their meeting of August 12, 1981. The proposed development was considered by the City Council at: people who lived in the vicinity protested the project. Many these people were concerned about the present lack of parking the vicinity. Also, a number of the citizens complained about the massive appearance of the proposed structure. Each of the units will have at least one patio or balco! oriented to take advantage of the ocean views, Design Criteria As previously menti.oned, this is essentially the same project that was reviewed by the Planning Commission at their August 1981 meeting, In an attempt to make the project more accepta to the surroundinq residents and the City Co:incil, the applic has reduced the number of dwelling units from 21 to 19. Staff stil.1 has concerns about the size of the project in rela. tion to the existing structures in the vicinity.
