RECOMMENDED ACTION:
Staff is reconunending that the City Council schedule September 7,
1982 as the third General Plan Land Use Element hearing for
1982.
ITEM EXPLANATION
On August 14, 1981, the City Council adopted a schedule for
amendment to the Land Use Element of the General Plan. This
schedule (City Council Resolution No. 6631 attached) established
2 hearing dates and their application deadlines. Since state law
only permits three amendment hearings a year, the Council decided
to float the third hearing and use it at Council discretion.
The hearing dates for 1982 are shown on the adopted schedule as
June 1 and November 16. Several developers have missed the
application deadline for the June 1, 1982 hearing because their
project required an EIR. Their EIR's should be completed by mid-
summer. They have requested that the Council utilize the
floating hearing in either August or September since waiting for
a November hearing would cause them over 2 months of delay.
Although there is no requirement that the city actually utilize
its three General Plan Amendments every year, utilization of a
third hearing in September may be beneficial to the city of
Carlsbad. The city is currently negotiating with the County for
a city operations site. A general plan amendment may be a
necessary result of these negotiations. A September 7th date
would allow enough time for the completion of the EIR on this
project.
If the Council decides that September 7 is appropriate for the
third hearing, staff would recommend that the deadline for
applications close on June 1, 1982, for projects not requiring an
EIR. Due to time constraints, new projects requiring EIR's would
have to wait until November.
FISCAL IMPACT
The determination to hold a third hearing will have no direct
fiscal impact on the city. Some staff time will be utilized in
processing the applications, but this will occur regardless of
the hearing date.

on lines' 1-10 (page .2) of Resolution No. 6426 as approved on

RE: HUNTINGTON BEACH COMPANY
Dear Frank:
The other day I spoke with you regarding the
Huntington Beach property lying northerly of
Palomar Airport Road just west of Palomar Airport.
We have been working for this company for some time
now and had originally anticipated being on the June 1
general plan amendment hearing scheduled before the
City Council. For a number of reasons we are not
going to make the June 1 schedule and would prefer
not waiting until the regularly scheduled general
plan amendment hearing in November.
We understand that the City may be processing a
general plan amendment as it relates to the possible
acquisition of the portion of County property lying
north of Palomar Road and east of El Camino Real.
Should the City decide to proceed with this, possibly
an August hearing, we would like to join that same
general plan amendment schedule for the Huntington
Beach property.
We have received a letter from your associate planner,
Mr. Charles Grimm, outlining the current schedule for
the Huntington Beach property as it relates to the
environmental process. In reviewing the schedules with
our client, it is important for them to proceed with
the general plan amendment for their project as soon

to request that City Council set a third general
plan amendment hearing for August 1982.
