RECOMMENDED ACTION:
Adopt Ordinance No. 1251, providing that a vacancy on the City
Council shall be filled in accordance with state law.
ITEM EXPLANATION:
Per Council discussion at their meeting of April 6, 1982, the City
Attorney has prepared the attached ordinance which provides that
a vacancy on the City Council shall be filled in accordance w4_th
state law. If the ordinance is adopted, and a vacancy occurs on
the City Council, Council would have the option of either appointing
to fill the unexpired term within thirty days, or calling a special
election to fill the vacancy.
Council, at their adjourned meeting - of April 13, 1982, introduced
the ordinance, and it is returned for their adoption,
FISCAL IMPACT:
Cost of a Special Election would range from $2000.00 to $15,000.00,
depending upon the circumstances.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
2 OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2
CHAPTER 2.04 OF THE CARLSBAD MUNICIPAL CODE BY
3 THE DELETION OF SECTION 2.04.030 TO PROVIDE
THAT A VACANCY ON THE CITY COUNCIL SHALL BE
4 FILLED IN ACCORDANCE WITH STATE LAW.
5 The City Council of the City of Carlsbad, California,
6 does ordain as follows:
7 SECTION 1: That Title 2, Chapter 2.04, of the Carlsbad
8 Municipal Code is amended by the deletion of Section 2.04.030.
9 EFFECTIVE DATE: This ordinance shall be effective
10 thirty days after its adoption, and the City Clerk shall certify
11 to the aoption of this ordinance and cause it to be published at
