CM ClTI RECOMMENDED ACTION: Adopt Resolution No. b gb 6 approving agreement between Cj and San Marcos County Water District establishing policy for distribution of reclaimed water. ITEM EXPLANATION: San Marcos County Water District received approval (PDP-3) fi the City to activate a 1 MGD reclaimed water plant in 1980. PDP-3,contained 22 conditions. The minutes of the January 1: 1980 Council meeting show the following action was taken: RECLAIMED WATER PLANT Planning Commission Resolution No. 1578,recommending approval Council directed the City Attorney to prepare necessary documents approving PDP-3, as per Planning Commission Resolution 1578, with such modifications to provide for concern expressed by Council insofar as permitting use of reclaimed water within the confines of the City of Carlsbad, the eventual type 1 use of water, such pro- visions as may be necessary to provide a foundation for advising District of growth inducing impacts that will be mitigated, and such conditions as may be appropriate for San Marcos to handle additional solids in the event of an upset at the Encina Regional Facility. Resolution No. 6080, adopted by the Council February 5, 1980 tained two additional conditions: 23. Prior to approval of the final Precise Development Plan, the District shall enter into a service agree. ment with the City of Carlsbad to permit the Distric to distribute and dispose of reclaimed water from tl treatment plant to or on property within the incorpc ated limits of the City of Carlsbad. 24. Prior to approval of the final Precise Development Plan, the District shall enter into an agreement wi the City guaranteeing that the District will make available to the City reclaimed water from the trea ment of sewage at the plant. The amount of reclaim1 water made available to City shall be no less than equal to an amount proportionate to the amount of sewage produced in the City and treated at the plan Reclaimed water distributed by the District accordi to Condition No. 23 of this approval is deemed to h been made available to the City. 0 0 PAGE 2 AB# &fl5--%fJ’ Mtg. 5-4-82 Dept. CM -- Sari Marcos County Water District was not present at the Februi 1980 meeting and has continuously objected to conditions 23 ai During 1980 and 1981 the City Manager and City Attorney negot an agreement with San Marcos County Water District providing ownership and operation of a water reclamation outfall line a Palomar Airport Road. That outfall line is designed to carry effluent from the Meadowlark plant PDP-3. The outfall agreem was approved by City Council October 26, 1981, Resolution As part of that negotiation, the City Manager and City Attorn approved an agreement with San Marcos County Water District w would dispose of condition 23 and 24 of Resolution No. 6080. In effect, City acknowledges that San Marcos has the right to distribute reclaimed water within district boundaries in acco with applicable federal, state, and local ordinances. City a agrees to delete condition 24 which required San Marcos to ma available to the City an amount of reclaimled water proportion to the amount of sewage produced in Carlsb,ad. The agreement to change condition 23 and 24 was approved by S Marcos County Water District and signed by the Board in 1980. It has never been presented to Council. On Council agenda May 4, 1982 is a recommendation from the P1 Commission to approve PDP-3A to allow the Meakowlark plant to expanded from 1 MGD to 2 MGD. Planning Commission Resolution No. 1944 contains condition 20 and 21 which are identical to condition 23 and 24 of Resolution No. 6080. San Marcos Count Water District is still opposed to those conditions. In orde to resolve this problem, it is recommended that Council appro the agreement previously negotiated by the City Manager and a Resolution No. to gt 4 If this is done, Council could then delete conditions 20 and in PDP-3A.
