RECOMMEN.OED ACTION:
Adopt Ordinance No. 3 ~£" Q amending Carlsbad Munici pa 1 Code, Chapter 10.40, to
establish violation en orcement procedures and fees.
ITEM EXPLANATION:
The State of California has recently passed AB189 authorizing monies to be collected
for use in the enhancing of criminal justice facilities.
AB189 provides that a surcharge of $1.50 be added to fines and forfeitures coming
from parking violations and other selected criminal offenses. San Diego County
has enacted legislature authorizing the surcharge and its collection.
Ordinance No. 3144 was adopted by the Carlsbad City Council on March 16, 1982, which
set parking violation fees, plus the authorization of the surcharge of $1 .50,
which is the portion to be distributed to the county. Since the passage of this
ordinance, it has come to the attention of the police department that the Depart-
ment of Motor Vehicles will not accept an uneven dollar amount, nor will the com-
pany thathandles our parking citations (SEICOM). By adding the $1.50 to our present
fee schedule, we hava an uneven amount.
The North County Municipal Court states that many of the cities in the county have
increased the surcharge by $0.50, making it an even amount of $2.00. Since the
county has made no allowance for the costs involved to the cities in collection
of these fees, it is felt that by charging thfa additionc11 $0.50 this would defray
the cost of collection and processing of the surcharge fees, satisfy Department
of Motor Vehicle's policy on even dollar amounts and not disrupt the citation pro-
cessing by SEICOM.
It is recommended that Ordinance No. 3144 be amended to allow for an increase of
$0.50 which would bring the surcharge to $2.00. The City would retain the addi-
tional $0.50 to defray all handling and processing costs
FISCAL IMPACT:
The fiscal impact for 1981-82 is estimated to be an additional $1500.00 collected.

ORDINANCE NO. 3150
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10,
CHAPTER 10.42 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDl-1F.NT OF SECTION 10.42.010(b) TO
·INCREASE THE SURCHARGE FOR PARKING VIOLATIONS
TO $2.00.

The City Council of the City of Carlsbad, California,
does ordain as follows:
·SECTION 1: That Title 10, Chapter 10.42 of the Carlsbad
Municipal Code is amended by the amendment of Section
10.42.010(b) to replace the number $1.50 with the number $2.00 in
·the second to last sentence thereof and to amend the last
sentence to read as follows:
. n$1. 50 of this surcharge shall be distributed to the
County pursu~nt. to Government Code Section 68073.4·."
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoplion, 'and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published
at least once in the Carlsb'1d Journ·a,1 within fifteen days ·at ~er
its adoption.
