I1 RECOMMENDED ACTION:
Adopt Resolution No. bfv/ to vacate a portion of Oak Avenue and
Canyon Street.
ITEM EXPLANATION:
On May 18, 1982, the City Council adopted Resolution No. 6874 declaring
an intention to vacate portion of Oak Avenue and Canyon Street.
Utility companies were notified and responded that conflicts have been
resolved so they have no objections to the vacation,

RESOLUTION NO. 6891
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA
VACATING A POXTION OF OAK AVENUE
AND CANYON STREET.
The City Council of the City of Carlsbad, California,
does hereby resolve as follows:
WHEREAS the City Council, at a regular meeting held a
duly noticed public hearing as prescribed by law; and
WHEREAS said hearing was noticed by publication and
posting as provided in Resolution No. 6874 a resolution of
intention to vacate a portion of Oak Avenue and Canyon Street in
the City of Carlsbad; and
WHEREAS at said hearing the City Council did consider
the evidence 2nd testimony of all persons requesting to speak,
if any; and
WHEREAS based on said evidence and testimony the City
Council finds that the portion of Oak Avenue and Canyon Street
is unnecessary for present or future street purposes; and
WHEREAS this proceeding is conducted pursuant to the
provisions of the Public Streets, Highways and Service Easements
Vacation Law (Street and Highways Code 8 8300 et. seq.); --
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City oE Carlsbad as follows:
1. That the foregoing recitations are true and correct.
2. That a portion of Oak Avenue and Canyon Street,
located in the City of Carlsbad, County of San Diego, State of
California, and particularly described on Exhibit B, attached
hereto and by this reference incorporated herein, is vacated.

3. That the City Clerk shall record this resolution
with the county recorder as required by law and that this
vacation shall become effective upon recording with the county
recorder.
