ITEM EXPLANATION: EIR 81-10 is a focused EIR that addresses the impacts created by a proposed zone change and mobile home subdivision for property located on the west side of El Camino Real just south of the Country Store (map attached). The focused EIR was a result of concerns by the Planning Commission expressed during the first public hearing on this item in November of 1981. The major concerns addressed in the EIR involve grading, traffic and compatibility with existing single family residences to the south and west of the subject property. The Planning Commission and Planning staff feel that all impacts have been adequately discussed and that recommended mitigation measures properly reduce the potential impacts. Location Map 4e EIR 81-10 (previously distributed) 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 1967 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING CERTIFICATION OF ENVIRONMENTAL IMPACT REPORT (EIR 81-10) FOR A PROJECT GENERALLY INCLUDING A ZONE CHANGE TENTATIVE MAP AND MOBILE HOME PARK FOR 5 ACRES LOCATED ON THE WEST SIDE OF EL CAMINO REAL APPROXI- MATELY .4 MILES SOUTH OF KELLY DRIVE. APPLICANT: A.~DERSON CASE NO: EIR 81-10 WHEREAS, on May 26, 1982, the Planning Commission, of the 8 city of Carlsbad, held a public hearing on EIR 81-10 pursuant to the 9 provisions of Title 19 of the Carlsbad Municipal Code; and 10 WHEREAS, the Planning Commission has considered the 11 comments and documents of all those persons testifying at the public 12 hearings; and 13 WHEREAS, the Planning Commission has received EIR 81-10 14 according to the requirements of Title 19 of the Carlsbad Municipal 15 Code; 16 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission 17 of the city of Carlsbad as follows: 18 1 • I 19 I 12. 20 21 22 3. 23 24 25 26 4. 27 28 That the foregoing recitations are true and correct. That the Environmental Impact Report EIR 81-10 will be amended to include the comments and documents of those testifying at the public hearing and responses thereto hereby found to be in good faith and reason by incorporating a copy of the minutes to said public hearings into the report. That the Planning Commission finds and determines that the Environmental Impact Report EIR 81-10 has been completed in conformance with the California Environmental Quality Act, the state guidelines implementing said Act, and the provisions of Title 19 of the Carlsbad Municipal Code and that the Planning Commission has reviewed, considered and evaluated the information contained in the report. That the Environmental Impact Report EIR 81-10 as so amended an evaluated, is recommended for acceptance and certification as the final Environmental Impact Report and that the final Environmental Impact Report as recommended is adequate and provides reasonable information on the project and all reasonable and feasible alternatives thereto, including no project. ·- 1 5. 2 :3 4 5 6 • That each and every significant environmental impact identified in the Environmental Impact Report would be overruled or counterbalanced by changes or alteration in the project which would mitigate against said adverse impacts or, in certain circumstances, that mitigation of such adverse impacts would not be feasible under the circumstances and under the economic and social needs objectives and concerns in providing the private improvements all as identified in the Environmental Impact Report and which, if the project were to be approved, would be included as conditions of approval of project.
