HD.@fl MTG. 6/15/82 AMENDMENT TO A PRECISE DEVELOPMENT PLAN FOR THE EXPANSION OF THE ENCINA CITYATTY F TYf DEPT. pL TREATMENT PLANT - PDP-l(A) CITY MGR.* RECOMMENDED ACTION: Both the Planning Staff and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING PDP-l(A), per Planning Commission Resolution No. 1962. ITEM EXPLANATION This amendment would permit the expansion of the Encina Treatment Plant from its current 18 million gallon per day capacity to a 22.5 million gallons per day capacity. The expansion would involve the addition of a sixth primary sedimentation tank and associated piping and equipment. The site configuration will not change as a result of this amendment. The expansion is Phase III-A of the phasing program for the plant. Phase III-A should have been part of the Phase III project, however, eligibility could not be obtained from either the State or Federal Government as indicated in the letter from Dennis Reid, General Manager, attached to the staff report. The Planning Commission found that the expansion is consistent with the Public Facilities Element of the General Plan and with the P-U zone. Through staff review and Planning Commission hearing, all issues on this matter have been satisfactorily resolved. ENVIRONMENTAL REVIEW The Planning Director has determined that this project has already been considered in conjunction with a previously certified environmental document and, therefore, has issued a Notice of Prior Environmental Compliance dated April 28, 1982, which was approved by the Planning Commission on May 26, 1982. FISCAL IMPACT The expansion of the plant will allow additional building activity is the Encina Sewage area and will create a need for additional public services. The cost of providing these services should be offset by the payment of public facility fees and by requiring developers to provide the public improvements needed to serve their projects. EXHIBITS A. The proposed Precise Development Plan ensures the compatibility of the development with surrounding development for the following reasons: a) Conditions are imposed as part of this approval that mitigate all significant impacts resulting from the project. b) The development is located in a depressed area that can easily be buffered in order to prevent adverse impacts to adjacent properties. The proposed project conforms to the California Environmental Quality Act, and the Carlsbad Environmental Protection Ordinance since: 4 An EIR has been prepared and certified by the lead agency. b) Adequate measures to mitigate significant impacts .are included as part of the required approvals. cl The city, acting as responsible agency, has considered this EIR in approving the project. d) Other environmental agencies have conditionally approved the project. The proposed Precise Development Plan provides for necessary public improvements as necessitated by the development since conditions are imposed which require such improvements. Conditions: Planning Department 1) Development of the site shall occur as shown on Exhibit "A", dated March 31, 1982, except for minor modifications which may be approved by the City Engineer. 2) All previous conditions of PDP-1, City Council Resolution No. 5812, are no longer applicable and shall be superseded by the 3 ) conditions of approval contained herein. In addition to the approval of the development indicated in the exhibits noted in Condition No. 1, all other requirements listed in this approval shall be indicated on the final Precise Development Plan. The landscaping shall be designed to screen facilities from views along I-5, and surrounding properties, Plans shall include fast growing tall trees, as well as a combination of shrubs and ground cover. Plants shall be drought tolerant to the maximum extent feasible, and fire retardant where necessary. Said landscape and irrigation shal be installed immediately upon completion of construction excep that all screening landscaping shall be installed upon completion of grading, prior to any construction. The placement of equipment on any roof tops shall be screened from views along I-5 and from adjacent properties and subject to the approval of the Planning Director. All lighting shall be designed in a manner that will not adversely affect nearby residences or public roadways. A lighting plan shall be subject to the approval of the Planning Director. Grading plans shall be approved by the City Engineer or his designee, prior to the issuance of a building permit. Said plans shall include provisions to limit grading to the minimum area necessary for construction of the facilities. Surfaces shall be graded to direct runoff toward designed drainage facilities and away from cut and fill slopes. Land shall not be cleared of vegetation except immediately before grading, and all slopes shall be established for erosio control immediately upon completion of such grading. Native vegetation shall be retained wherever feasible. A noise study shall be performed by a qualified noise expert i order to.establish acceptable noise levels at the property lin of the treatment facility. Based on this study and subject to the approval of the City Engineer, all noise producing mechanisms and facilities shall be shielded and buffered in such a manner so as to reduce noise levels to the acceptable level. All influent wastewater shall be pretreated in order to remove odors. In addition, the screening structures, grit removal tanks, primary sedimentation tanks, and all open channels, including primary effluent channels, shall be covered and ventilated in order to remove odors. Odor removal towers are required and shall be delineated on th final Precise Development Plan, subject to the approval of the City Engineer. All necessary public improvements shall be installed subject t the approval of the City Engineer. Said improvements shall include the extension of the existing 10" water line along Avenida Encinas, from the northerly boundary of the treatment facility to its southerly boundary. Special provisions to control dust which is generated by grading activities shall be'approved by the City Engineer prior to commencement of grading. As part of Phase III, a sludge disposal study was completed and sludge disposal methods were included in the project design. If the JAC Board of Directors determines that a method of sludge disposal other than that incorporated into Phase III is feasible, such method may be implemented upon approval of the City of Carlsbad. Upon approval, the applicant shall submit a reproducible copy of the Precise Development Plan which incorporates all requirements of the approval to the City Manager for signature. Prior to signing the final Precise Development Plan, the City Manager shall determine that all applicable requirements have been incorporated into the plan and that all conditions of approval have been satisfactorily met or otherwise guaranteed. The .final signed Precise Development Plan shall be the official site layout plan for the property and shall be attached to any application for a building permit on the subject property. Fire Department 18) Fire hydrants shall be placed on the site as required and approved by the Fire Marshall. I. DESCRIPTION The applicant is requesting an amendment to a Precise Development Plan to allow for the Phase III (A) expansion of the Encina Water Pollution Control Facilities located as described above. The proposed expansion is one of a number of phased capacity increases which will be accomplished over several years. ?hase III (A) will involve the addition of a sixth primary sedimen- tation tank and associated piping and equipment. As.shown by Exhibit "A", all of the construction will take place within the confines of the site. The proposed expansion will bring the capacity of the Encina Plant to 22.5 million gallons per day of wastewater treatment capacity. As mentioned earlier, this is one of a number of phased capacity increases. Further expansion in the future will require the preparation of a supplemental Environmental Impact Report and another amendment to the Precise Development Plan. II. ANALYSIS \ Planning Issues . v 1. Is the site adequate in size to handle the proposed expansion and will this expansion be adequately screened from adjacent properties and public right-of- way. ' 2. Will the growth inducing impacts of the plant expansion be consistent with the General Plan? Discussion . As shown on Exhibit "A", the site is. adequate in size and shape ,to handle the proposed expansion. Upon completion of the pro- posed expansion, rows of eucalyptus trees will be placed along the edges of the site. These trees, along with additional land- scaping which will be required as a condition of approval for PDP-l(A), should provide adequate screen'ing of the site from adjacent roadways and residential areas. . c. The EIR for this project (copy attached)' which has been certified by the Encina Water Pollution Control Facilities has an extensive discussion of growth inducing impacts of this expansion. The EIR points out that the Phase III (A) expansion is not expected to induce growth beyond that which has been projected by the Carlsbad General Plan. The EIR also explains in a more technical manner, the details of the proposed expansion. Since the Phase III (A) expansion is in conformance with SANDAG'S Series V growth forecasts and the Carlsbad General Plan, staff is recommending approval of PDP-l(A), III. ENVIRONMENTAL REVIEW The Planning Director has determined that this.project has already been considered in conjunction with a previously certi- fied environmental document and therefore, has issued a Notice of Prior Environmental Compliance dated April 28, 1982. A copy of the environmental document is on file in the Planning Department. IV. RECOMMENDATION . It is recommended that the Planning Commission Adopt Resolution No. 1962, recommending Approvalof PDP-l(A), to the City Council based on the findings and subject to the conditions contained therein. Now being pro- posed is the Phase III-A project which includes only the equipping of the'6th primary sedimentation tank at a cost of $585,000 (see page 8 of Environmental Impact Report for description). The Phase III-A Project should have been a part of the Phase III.Project, but eligibility could never be obtained from the State and Federal Governments. It was felt that since this expansion is to be funded by local monies only, that it should be treated separately from the grant funded project. Submitted for your review are copies. of the recently certified EIR for w the Phase III-A Project and the Seventeenth Supplement. The Seventeenth Supplement is a. joint powers agreement between the six agencies of Encina 'which designates Leucadia County Water District as the lead agency and authorizes Leucadia County Water .District to do the EIR, the design and construction of the Phase III-A Project.
