HD.JLB&X CITY ATTY^ESL CITY MGR.£? 3** RECOMMENDED ACTION: Introduce Ordinance No.to permit lot depth to exceed three times its width for minor subdivisions under certain circumstances. ITEM EXPLANATION: CTi 01O The Code now requires that no lot can be created with a depth greater than three times its width. Although generally a reasonable requirement that eliminates awkwardly long lots, it occasionally prevents desirable subdivisions. Such a circumstance is that of the property of Mrs. Mary Saunders on Highland Drive. This lot is within a superblock that has many existing v.ery deep lots; Mrs. Saunders1 lot depth is nearly seven times its width. Dividing it in half with the interior lot served by a new public street provides a more practical lot size which is also more closely in conformance to the general plan. The problem is, this division cannot be accomplished without at least one lot depth exceeding the code. The proposed change would permit subdivisions like Mrs. Saunders1 by allowing the lot depth to exceed three times its width if that ratio is less than the depth to width ratio of the existing lot. The primary intent of this change is to permit further subdivision of existing lots in superbloc- areas. Land Use Planning has reviewed this proposed change and concurs with the recommended action. FISCAL IMPACT: •d o UJ§a:Q-a. The major impact will be the increase in property value that will accrue to owners who will be able to subdivide land that currently cannot be subdivided. Saunders, who is the property owner at 3264 Highland Drive. The rear property line of her lot adjoins the proposed extension of James Drive and would be part of the street dedication. (For the *. ^ . record, we are in favor of the proposed extension of James Drive). My mother is interested in splitting her property to form two lots total. (Please see sketch). However, as per my conversation with your associate, David Hauser, under a present ordinance this would not be possible because one of the lots would have to be longer than three times its width, which would make it non-conforming. However, the present lot length is more than seven times its width. What we would propose is to make one new conforming lot, 62.6?' by 18?', and one very nearly conforming lot, 61. ?1* by 200'. These dimensions are allowing for the 30' dedication on Highland and approximately 35' dedication on James Drive 0 Aside from the obvious benefits for us we feel that this proposal would be desirable to the City also by greatly reducing non- conformity of this property. Mr. Hauser suggested that it would be possible for you to bring this matter before the City Council and that a resolution could be reached. EXHIBIT "B" 1 2 3 4 ITS AVERAGE WIDTH UNDER CERTAIN CIRCUMSTANCES 5 6 8 10 11 12 13 14 15 16 17 18 19 ORDINANCE NO. 9629 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 20, CHAPTER 20.16 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SUBSECTION 20.16.010(8) TO PERMIT LOT DEPTH TO EXCEED THREE TIMES The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That Title 20, Chapter 20.16 of the Carlsbad Municipal Code is amended by the amendment of Subsection 20.16.010(8) to read as follows: "(8) Lot depth shall be at least 90 feet. Lot depth shall be no greater than [three times the average width except for minor subdivisions where the proposed lot depth to width ratio is less than that of the existing lot." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
