EXHIBIT: Resolution No. mw l 1 2 3 . 4 5 6 7 a 9 10 11 12 2 t- is 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6926 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING AN AMENDMENT TO A PRECISE DEVELOPMENT PLAN FOR THE EXPANSION OF THE ENCINA WATER POLLUTION CONTROL FACILITIES (PHASE III-A) GENERALLY LOCATED AT 620.0 AVENIDA ENCINAS. APPLICANT: ENCINA WATER POLLUTION CONTROL FACILITIES. CASE NO.: PDP-l(A) WHEREAS, on May 26, .1982, the Carlsbad Planning Commission adopted Resolution No. 1962 recommending to the City Council that'precise Development Plan (PDP-l(A)) be conditionally approved. Said resolution is attached hereto as Exhibit A and is made a part hereof; and WHEREAS, the City Council of the City of Carlsbad, on 'June 15, 1982, held a public hearing to consider the Planning Commission's recommendations and received all recommendations and heard all persons interested in or opposed to Precise Development Plan (PDP-l(A)); and WHEREAS, An Environmental Impact Report was prepared and certified as complete in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972 and the California Environmental Quality Act for PDP-l(A) and the Planning Director has determined that this project is in prior compliance with said requirement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That the findings of the Planning Commission in Resolution No. 1962 constitute the findings of the City Council in this matter. . . 1 2 3 4 5 6 1 E c. The Precise Development Plan (PDP-l(A)) for the expansion of the Encina Water Pollution Control Facilities is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of all of the conditions of Planning Commission Resolution No. 1962. D. This plan shall supersede any consistent portions of PDP-1 as approved by Resolution No. 5812. APPLICANT: ENCINA WATER POLLUTION CONTROL FACILITIES CASE NO: PDP-l(A) WHEREAS, a verified application for certain property, to rit: A portion of Fractional Section 20, Township 12 South, Range 4 West, San Bernardino Meridian according to the U.S. Government survey approved October 25, 1875 and a portion of Lot "H" of Aqua Hedionda according to Map 823, filed November 16, 1896. las been filed with the city of Carlsbad, and referred to the . jlanning Commission; and WHEREAS, said application constitutes a request as lrovided by Title 21 of the Carlsbad Municipal Code; and I WHEREAS, the Planning Commission did on tkie 26th day of (jay, 1982, hold a duly noticed public hearing as prescribed by law LO consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Precise Development Plan; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Zommission as follows: . A) That the foregoing recitations are true and correct. U) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of PDP-l(A), based on the following findings and subject to the following conditions: . Findings: 1) The Precise Development Plan ensures the compatibility of the project with the city's General Plan for the following reasons: 1 2 3 4 5 c ‘i I I 1( 11 1: 1: 1J 1; 3-l 1' 1 a) The General Plan Land Use Element designates the subject property for a public utility use. b) Th.e project is consistent with the goal and policy of the public facilities element of the General Plan. The proposed Precise Development Plan ensures the compatibility of the development with surrounding development for the following reasons: 4 Conditions are imposed as part of this approval that mitigate all. significant impacts resulting from the project. b) The development is located in a depressed area that can easily be buffered in order to prevent adverse impacts to adjacent properties. The proposed project conforms to the California Environmental Quality Act, and the Carlsbad Environmental Protection Ordinance since: d ! An EIR has been prepared and certified by the lead agency. f b) Adequate measures to mitigate significant impacts are included as part of the required approvals. cl The city, acting as responsible agency, has considered this EIR in approving the project. d) Other environmental agencies have conditionally approved the project. The proposed Precise Development Plan provides for necessary public improvements as necessitated by the development since conditions are imposed which require such improvements. Conditions: Planning Department 1) Development of the site shall occur as shown on Exhibit "A", dated March 31, 1982, except for minor modifications which may be approved by the City Engineer. 2) All previous conditions of PDP-1, City Council Resolution No. 5812, are no longer applicable and shall be superseded by the conditions of approval contained herein. 3) In addition to the approval of the development indicated in the exhibits noted in Condition No. l,.all other requirements listed in this approval shall be indicated on the final Precise Deveiopment Plan. The landscaping shall be designed to screen facilities from views along I-5, and surrounding properties. Plans shall include fast growing tall trees, as well as a combination of shrubs and ground cover. Plants shall be * drought tolerant to the maximum extent feasible, and fire retardant where necessary. Said landscape and irrigation shal: be installed immediately upon completion of construction excep: that all screening landscaping shall be installed upon completion of gr.ading, prior to any construction. The placement of equipment on any roof tops shall be screened from views along I-5 and from adjacent properties and subject to the approval of the Planning Director. All lighting shall be designed in a manner that will not adversely affect nearby residences or public roadways. A lighting plan shall be subject.to the approval of the Planning Director. . '. Grading plans shall be approved by the City Engineer or his designee, prior to the issuance of a building permit. Said plans shall include provisions to limit grading to the minimum area necessary for construction of the facilities.. Surfaces shall be graded to direct runoff toward designed drainage facilities and away from cut and fill slopes. Land shall not be cleared of vegetation except immediately before grading, and all slopes shall be established for erosio; control immediately upon completion of such grading. Native vegetation shall be retained wherever feasible. A noise study shall.be performed by a qualified noise expert ir order to establish acceptable noise levels at the property lint of the treatment facility. Based on this study and subject to the approval of the City Engineer, all noise producing mechanisms and facilities shall be'shielded and buffered in such a manner so as to reduce noise levels to the acceptable level. All influent wastewater shall be pretreated in order to remove odors. In addition, the screening structures, grit removal tanks, primary sedimentation tanks, and all open channels, including primary effluent channels, shall be covered and ventilated in order to remove odors, Odor removal towers are required and shall be delineated on the final Precise Development Plan, subject to the approval of the City Engineer, All necessary public improvements shall be installed subject t( the approval of the City Engineer. Said improvements shall include the extension of the existing 10" water line along Avenida Encinas, from the northerly boundary of the treatment facility to its southerly boundary. Special provisions to control dust which is generated by grading activities shall be approved by the City Engineer prior to commencement of grading. . As part of Phase III, a sludge disposal study was completed and sludge disposal methods were included in the project design. If the JAC Board of Directors determines that a method of sludge disposal other than that incorporated into Phase III is feasible, such method may be implemented upon approval of the City of Carlsbad. Upon approval, the applicant shall submit a reproducible.copy of the Precise Development Plan which incorporates all requirements of the approval to the City Manager for signature. Prior to signing the final Precise Development Plan, the City Manager shall determine that all applicable requirements have been incorporated into the plan and that all conditions of approval have been satisfactorily met or otherwise guaranteed. The.final signed Precise Development Plan shall be the official site layout plan for the property and shall be attached to any application for a building permit on the subject property. 16) 17) Fire Department I - 18) Fire hydrants shall be placed on the site as required and approved by the Fire Marshall.
