CITY MGRY 2 The Planning Staff, Redevelopment Advisory Committee and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING ZCA-14O/ZC-257. ITEM EXPLANATION This item involves four considerations by the City Council which are as follows: 1) Approval of the Village Design Manual (Exhibit A). This document was prepared by the Housing and Redevelopment Advisory Committee and contains the guidelines and regulations relating to land use and design within the Redevelopment Area. The Manual has also been reviewed by the Planning Commission. Approval of a zone code amendment to create a new zoning classification; the Village Redevelopment (V-R) Zone, which would implement the Village Design Manual and the city's adopted Redevelopment Plan. The new zone (Exhibit B) was prepared by the City Attorney's Office and provides a legal basis for utilizing the Village Design Manual. The zone would also provide the procedures for approving projects within the Redevelopment Area. 3) Approval of an ordinance (Exhibit C) creating the Design Review Board which will review all proposed projects within the Redevelopment Area. Originally, staff was recommending that the Planning Commission be designated as the Design Review Board, however, both the Planning Commission and the Housing and Redevelopment Advisory Committee are recommending that the Board be comprised of representatives from both the Planning Commission and the Advisory Committee. Exhibit C reflects the recommendation of the Commission and the Ad v i sor y Comm i t t ee . 4) Approval of a zone change to apply the new zoning classification (V-R Zone) to all the properties located within the Redevelopment Area (refer to attached location map) Through staff review and Planning Commission public hearing, all issues on this matter have been satisfactorily resolved. I 1 AGENDA BILL PAGE TWO ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated March 30, 1982, which was approved by the Planning Commission on May 26, 1982. A copy of the environmental documents is on file in the Planning Department. FISCAL IMPACT This project will not create any fiscal impacts. Whenever a project would require a permit or: -a_nprovgI under tr-2 provisions of this title not withstanding this chapter, the redevelopment permit shall be deemed to sati.sfy the requireme?,ts for such permit or approval provided, however,. thac in considering the redevelopment permit for said project the 9esFgn Review Board and the Housing. and Redevelopment Commj..ssion shElT apply t.he provisions of .this chapter and the provisions of this title otherwise applicable to such o;ther permit or ap?roval fsr the project. 21.35.130 Exemptj.ons. -_I_ The Housing and RedeveLopmerr Commission is authorized to grant exceptions frcm the limits, resf-rictions and controls established by this chapter if the Commission finds that the application of certain provisions of this chapter would result in practical difficulties or unnecessary hardships which would make developent inconsis te:t with the general purpose and intent of the Carlsbad Village Arsa Redevelopment Plan; there are exceptional circumstances or conditions unique to the property or the proposed dev.?lopment which do not generally apply to other properties or develo2m:z.s which have the same standards, restrictions and controls; the Granting of an exemption will not be injurious’or materially detrimental to the public welfarer other properties or improvements in the project, area; and the granting of an exemption will not contradict the standards established in tk? Village Design Manual. An application for exexption shall be processed in the same manner established by this chapker for t redevelopment permit. The Design Review Board shall consist of f'ive members, three of which shall be members of the Planning Commission, two of which shall be members of the Housing and Redevelopment Advisory Committee. Appointments to the Design Review Board shall be made by the City Council. Members shall serve one year terms and may be reappointed to consecutive terms. The Building Official, the Land Use Planning Manager and the City Attorney shall be ex-officio members of the Board. No ex-officio members shall be entitled to vote. 2.26.030 Meetings. The Board shall meet regularly once a month on the first.Thursdav of each month or more often if necessary for the transaction of business. In the event that a regular meeting falls on a legal holiday, said meeting shall be held on the next succeeding business day. I . PROJECT DESCRIPTION This item involves three considerations by the Planning Commission which are as follows: 1) Review of the Village Design Manual. 2) Approval of a zone code amendment to create a new zoning classification (Village Redevelopment Zone) which would implement the Village Design Manual and the city's adopted Redevelopment Plan. I 3) Approval of a zone change to apply this new zoning classif- ication to all properties located within the Village Redevelopment Area (refer to attached location map). 11, ANALYSIS The city's Village Redevelopment Plan was adopted by the City Council last year. In order to implement the plan, the Housing and Redevelopment Advisory Committee approved a Village Design Manual which provides guidelines and regulations relating to land use and design within the Redevelopment Area. Prior to forward- ing the manual to the City Council, the Planning Commission is being requested to review the document. A copy of the manual is attached (Exhibit B) along with a report from the Redevelopment staff and the Advisory Committee (Exhibit C). In order to provide a legal basis for utilizing the Village Design Manual, the City Attorney's Office has prepared a new zone; the Village Redevelopment Zone (V-R) (Exhibit A). The zone would 1) adopt the land use classifications and development stan- dards of the Redevelopment Plan and Design Manual as the zoning for the Redevelopment Area, 2) would provide a procedure for approving projects within the area and 3) would designate the Planning Commission as the Design Review Board for all projects proposed in the Redevelopment Area. *. c The Planning Commission is also being requested at this time to apply the new V-R zone to all the properties located within the Redevelopment Area. Once this is done and approved by the City Council, the land use classifications recommended and allowed by the Design Manual can be implemented, On May 10, 1982, the Redevelopment Advisory Committee reviewed this report and recommended that ZCA-140/ZC-257 be approved but that the Design Review Board, rather than being the Planning Commission, be comprised of representatives from the Planning Commission, from the Redevelopment Advisory Committee, from Redevelopment staff and perhaps from the City Council. Because of the desire to expedite the processing of applications by not creating an additional review board, planning and redevelopment staff is still recommending that the Planning Commission be designated as the Design Review Board. The Committee also requested that Section 21.35.090 be amended to clarify that an application for a redevelopment permit may be referred to the Housing and Redevelopment Advisory Committee for a recommendation prior to be reviewed by the Design Review Board. This section of the ordinance has been modified to clarify this. 111. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant adverse effect upon the environment and, therefore, has issued a Negative Declaration on March ,30, 1982. IV. RECOMMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Planning Director and ADOPT Resolution Nos. 1955 and 1956, recommending APPROVAL of ZCA-740 and 2C-257 to the City Council based on the findings contained therein. HOUSING AND REDEVELOPMENT ADVISORY COMMITTEE RECOMMENDAT ION In November of 1981 the Housing and Redevelopment Advisory Committee accepted and approved the final draft of the Design Manual. Advisory Committee directed staff to forward the Design Manual to the City Council for adoption and to use in implementing the Village Area Redevelopment Plan. Staff had indicated to the Housing and Redevelopment Advisory Committee that it would be necessary to have the Design Manual reviewed by the Planning Commission prior to forwarding the Design Manual to City Council. prepared a report that answers some general questions most frequently asked regarding the Design Manual. Planning CommissionlDesinn Manual page 2 INTRODUCTION Section V-B of 1 imitations on the Redevelopment Plan establishes general controls and develoment that will occur within the Villaae Area. The implementing document' that will provide the development guiiel ines for rehabilitation, development or redevelopment of plans, projects within the Village Area will be established in a Design Manual. The Redevelopment Plan indicates that the Design Manual will include development objectives, land-use, and design criteria. It should address such areas as, building coverages, building setbacks, building height and building intensity; landscaping, streetscaping, plazas, enclosures and mall furniture. Finally the manual should be addressing such things as civic and environmental design features which establish character in the Project Area. BACKGROUND A draft of the Design Manual was first introduced on May 17, 1979, to the Redevelopment Project Area Committee. The Pro,ject Area Committee's task was to review and advise the Redevelopment Agency on redevelopment policy. Project Area Committee became the current Housing and Redevelopment Advisory Committee in November of 1979 as a result of the reorganization of the Redevelopment Agency and the Housing Authority into the Housing and Redevelopment Commission. of the draft Design Manual in May of 1980. The City Council authorized the use of the draft Design Manual as criteria for issuing sewer permits within the Redevelopment Area. Since August of 1980, the Housing and Redevelopment Advisory Committee (functioning as an interium Design Review Board) has been utilizing the design and land-use criteria established in the Design Manual to evaluate plans in the Redevelopment Area. The Design Manual is a supportive plan and embodies the guidelines and regulations for the implementation of the City of Carlsbad's Village Area Redevelopment Plan. land-use plan that addresses the physical structure, activity framework, and spacial relationships of the Village Redevelopment Area. Its specific provisions cover the heiuht and intensity of buildings; land- scaping, street furniture; open space; the sitting of structures; transportation and circulation; and matters which affect the overall appearance of the Vi 11 age Area. The Manual is an urban design and Whv is the Desian Manual needed? The implementation of the Village Redevelopment Plan and the comprehensive improvement of the Vi1 lage Area are the primary reasons for having a Design Manual. The intent of the Village Design Manual is to provide general design guidelines and regulations. The Manual should provide an understanding of the "type" and "quality" of development being sought by the Housing and Redevelopment Commission and it should be viewed as providing guidance and parameters rather than strict standards. What urban design guidelines are proposed? The Village Redevelopment Area should be redeveloped as an area which is particulary scaled to the pedestrian. Redevelopment Area should be developed with interesting shops, boutiques, restaurants, and service uses. gallaries, and shopping plazas should be encouraged. The speciality shops, services, and restaurants for the project area should be augmented by a setting which manifests urbanity. Enlighened sign control and the artistic selection of external graphics and street furniture are prerequisites for the establishment of the setting. The Village The employment of enclosures, arcades, What landscaping guidelines are proposed? The landscaping of the project area should be formaljmanicured. In the landscaped areas, enclosures, parks, and squares with cobblestone, tile or brick flooring; ornamental park furniture and lighting; fountaines, sculpture, and kiosks are appropriate. The development of commercial residential blocks, consisting of gound floor shops, and upper-floor residential apartments and studios, will increase the project area's viability and stimulate its trade. High intensity residential "Villages", (self-contained residential , recreationsal, commercial complexes) , appear to be suitable land-uses for the project area and should be encouraged in the Village Area. What architectural theme is proposed? In lieu of an architectural theme, the Housing and Redevelopment Commission and the Design Review Board should require architectural coordination among developments. This coordination will help to ensure compatibility of proposed development with the existing village scale. What development standards have been reviewed? Lot coverage, building coverage, building setbacks, building and structural height limitations, building intensity, sitting of buildings, structures, open space, landscaping, parking and circulation and signs. Will the Design Manual be the zoning for the Redevelopment Area?
