ITEM EXPLANATION In response to Council's action at their meeting on June 29, 1982, documents have been prepared for Council action to call the election and implement their decision. FISCAL IMPACT The cost of the election, as estimated by Voters Office, is approximately $2,500. the Registrar of 1 2 3 4 5 6 7 8 10 11 12 13 14 15 17 18 22 24 25 26 27 28 RESOLUTION NO. 6933 _ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND COSTS THEREOF. _ WHEREAS, Section 10012 of the Elections Code of the State of California provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs th ereo f ; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. GENERAL PROVISIONS. That pursuant to Section 10012 of the Flections Code of the State of California, each candidate for elective office to be voted for at any Special Municipal Election to be held in the City of Carlsbad may prepare a candidate's statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description of no more than two hundred (200) words of the candidate's education and qualifications expressed by the candidate. Such statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. Such statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. Such statement may be withdrawn, but not changed, during the .period for filing nomination papers and until 5:00 P.M. of the next working day after the close of the nomination period. 1 2 3 4 5 8 9 10 11 12 13 14 15 16 1' 18 22 23 24 25 26 27 28 SECTION 2. SPANISH LANGUAGE. The City clerk shall provide a Spanish translation of the candidate's statement to be made available to any voter upon request, and shall so indicate its availability in the Voter's Pamphlet. SECTION 3. ADDITIONAL MATERIALS. No candidate will be permitted to include additional materials in the sample ballot package. SECTION 4. PAYMENT. Each candidate filing a candidate's statement shall be billed for the services rendered, a sum not greater than the actual prorated costs of printing and handling; and such bill shall be due and payable immediately upon receipt thereof. SECTION 5 . That the City Clerk shall provide each candidate, or the candidate's representative, a copy of this resolution at the time nominating petitions are issued. SECTION 6. RAUTE~NKRANZ , City 6)1 erk (SEAL) 1 RESOLUTION NO. 6934 2 A- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CALLING AND GIVING 3 NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY 4 NOVEMBER 2, 1982 FOR THE ELECTION OF A MEMBER OF THE CITY COUNCIL OF SAID CITY AS REQUIRED BY 5 THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES 6 I AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE ELECTION TO BE HELD ON SAID DATE. 7 WHEREAS, a vacancy in the office of a member of the 8 City Council was created by the election of City Council Member 9 Mary H. Casler to the office of Mayor of the City of Carlsbad on10 June 8, 1982; WHEREAS, the term of office in which said vacancy was created ends in June, 1984; NOW THEREFORE. RAUTENKRANZ, City Cflerk 27 n (SEAL) 28 1 2 3 4 9 10 11 12 13 15 16 17 18 19 20 21 opKitj 23 24 25 26 27 28 HELD ON THE SAME DAY. 5 WHEREAS, the City of Carlsbad has called 'an election to 6 be held in this City of Carlsbad on November 2, 1982; and 7 WHEREAS, Section 439.1 of the Administrative Code of 8 the County of San Diego authorizes the Registrar of Voters of RESOLUTION NO. 6935 A RESOLUTION REQUESTING THE BOARD OF SUPERVISORS TO CONDUCT THE ELECTION OF THE CITY OF CARLSBAD, ON TUESDAY, NOVEMBER 2, 1982 AND TO CONSOLIDATE THAT ELECTION WITH STATEWIDE ELECTION TO BE the County of San Diego to render specified services relating to the conduct of an election to any City which has by resolution requested the Board of Supervisors to permit the Registrar to render the services, subject to requirements set forth in that section; and WHEREAS, the City of Carlsbad called an election to be held on the same day in the same territory or in territory that is in part the same; WHEREAS, pursuant to Part 2.5 (commencing with § 23300), Division 14 of the Elections Code, the Board of Supervisors has authority to consolidate public district, city, county, or other political subdivision elections with each other and with a statewide election to be held on the same day; NOW, THEREFORE, BE IT RESOLVED, that pursuant to the , ! above-cited provisions, the Board of Supervisors of the County of San Diego is hereby requested to permit the Registrar of Voters to perform and render all services and proceedings incidental to and connected with the conduct of the s-ub^ect election of the City of Carlsbad, with the cooperation and assistance of the City 7 2_ Clerk of the City of Carlsbad, such services to include, but not 2 to be limited to the following activities as are appropriate to 3 the subject election: 4 1. Furnish a tabulation of the number of registered 5 voters in each precinct. 6 2. Examine the signatures on nomination papers or 7 petitions of candidates for public office. 8 3. Establish voting precincts, secure locations for 9 places, secure the services of election officers for each 10 precinct as required by law, and furnish a list of precincts, 11 polling places, and election officers for filing in the office 12 of the City Clerk of the City of Carlsbad. 13 4. Prepare and furnish to the election officers 14 necessary election supplies for the conduct of the election. 15 5. Cause to be translated, as appropriate, and 16 printed the requisite number of sample ballots, officical 17 ballots, polling place slips, rosters, tally sheets, and other 18 necessary forms. 19 6. Furnish and address the envelopes necessary to 20 mail sample ballots to the registered voters of the City of 21 Carlsbad. 22 7. Insert the sample ballots and other printed matter 23 into envelopes for mailing, and cause the same to be mailed, as 24 required by law. 25 8. Assemble the election material and supplies into 26 ballot bags and make necessary arrangements for their delivery 27 to the various precincts. 28 // 1 9. Distribute absent voter ballots as required by 2 law. 3 10. Receive the returns of the elections and supplies. 4 11. Sort and assemble the election material and 5 supplies in preparation for the canvassing of the returns of the Selection. 7 12.' Canvass the returns of the election, including the 8 absent voters ballots. 9 13. Furnish a tabulation of the number of votes given 10 in each precinct. 11 14. Make all arrangements and take the necessary steps 12 to pay the members of the precinct boards, the polling place 13 rentals, the persons returning the ballot bags, and to pay all 14 other costs of the election incurred as the result of services 15 performed for the City of Carlsbad and pay for the election 16 officials the amounts prescribed by the Board of Supervisors of 17 theCountyofSanDiego. 18 BE IT FURTHER RESOLVED that pursuant to the 19 requirements of the laws of the State of California relating to 20 General Law Cities within said State, the election of the 21 qualified electors of the City of Carlsbad was called for the 22 purpose of electing one (1) member of the City Council of said Cit; 23 for an unexpired term of office, which term ends in June, 1984. 24 BE IT FURTHER RESOLVED that the Board of Supervisors of 25 the County of San Diego is hereby requested to consolidate this 26 election with the Statewide Election to be held on the same 27 // 28 // day, in the same territory, or in territory that is in part the same. 3 BE IT FURTHER RESOLVED that if this consolidation is 4 ordered, then pursuant to Section 23306 of the Elections Code, 5 (a) the election shall be held in all respects as if there were 6 only one election; (b) only one form of ballot shall be used; 7 and (c) the Registrar of Voters of the County of San Diego shall 8 canvass the returns of the subject election as part of the 9 canvass of the returns of the election or elections consolidated 10 hereby . 11 BE IT FURTHER RESOLVED that if this consolidation is 12 ordered, then pursuant to Section 23305 of the Election Code, 13 within the territories affected by this order of consolidation, 14 the election precincts, polling places, voting booths and 15 polling h'ours shall, in every case be the same, and there shall 16 be only one set of election officers in each of the precincts. 17 BE IT FURTHER RESOLVED that the County of San Diego 18 shall be reimbursed in full for the services performed by the 19 Registrar of Voters for the City-of Carlsbad upon presentation 20 of bill therefor. 21 BE IT FURTHER RESOLVED AND ORDERED that the City Clerk 22 of the City of Carlsbad is hereby directed to deliver forthwith 23 certified copies of this resolution to the Clerk of the Board of 24 Supervisors of the County of San Diego and to the Registrar of 25 Voters of the County of San Diego. 26 // 27 // 28 // 1 PASSED, APPROVED AND ADOPTED at a regular 2 Meeting of the City Council of the City of Carlsbad on the 6th 3 day of July , 1982, by the following vote, to wit: 4 AYES: Council Manibers Casler, Lewis, and Kulchin 5 NOES: None 6 ABSENT: Council Member Chick ABSTAIN: Council Msniber Anear 8 / MARY H. jCASLER, Mayor if 10 ATTEST: 11 12 13 ALETHA L.
