RECOMMENDED ACTION: Both the Planning Staff and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING ZC-253, per Planning Commission Resolution No. 1980. ITEM EXPLANATION This item is a request for a preannexational zone change from A-70-8 and R-S-3 (County) to R-1-7500 (city) on 42.7 acres of property located on the east side of Melrose Avenue approximately 600 feet north of La Costa Meadows Drive. The R-1-7500 zone would be consistent with the R-M (4-10 du's/acre) general plan designation for this site. This designation was adopted by the City Council on June 1f 1982. The subject property is adjacent to, but not within the city's sphere of influence. The Council adopted the R-M designation for this site so that a sphere of influence boundary change could take place. The Council's intent is to annex the property into Carlsbad so that the city can control access on the both sides of Melrose Avenue. The Planning Commission was able to make all the mandatory findings for a zone change. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not cause any significant environmental impacts, and therefore, has issued a Negative Declaration, dated April 29, 1982, which was approved by the Planning Commission on June 23, 1982. A copy of the environmental documents is on file in the Planning Department. FISCAL IMPACT; The applicant would provide all required public improvements for any future development on this site. APPLICANT: DAON CORPORATION 6 CASE NO; ZC-253 WHEREAS, a verified application for certain property, to wit: All those portions of the S.E. Quarter of Section 19, the N.E. Quarter of Section 30, and the N.W. Quarter of Section 29, Township 12 South, Range 3 West, San Bernardino Meridian, County of San Diego. has been filed with the City of Carlsbad, and referred to the JL& Planning Commission; and JLo WHEREAS, said application consititutes a request as14 provided by Title 21 of the Carlsbad Municipal Code; and15 WHEREAS, the Planning Commission did on the 23rd day o:16 * * June, 1982, hold a duly noticed public hearing as prescribed by17 law to consider said request; and 18 WHEREAS, at said public hearing, upon hearing and J_ -J considering all testimony and arguments, if any, of all persons relating to the Zone Change? and fc J* NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows:23 A) That the foregoing recitations are true and correct. 24 B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC-253, based on the following findings and subject to the following conditions: 26 27 "" 8 9 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 Findings: 1) The proposed R-1-7500 zone is consistent with the General Plan designation of R-M (Residential Medium; 4-10 du's/Acre) since this zone would permit a residential development with a density within the 4-10 du's/Acre range. 2) The uses allowed in the R-1 zone are compatible with surrounding land uses and zoning since residential development at a density similar to that which would be allowed at this site presently exists or has been approved on properties to the north, west and south of the subject property. 3) The traffic generated by uses allowed in the R-1 zone will not create an adverse impact to the existing or future street system in this vicinity for the reasons stated in the staff report. 4) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. 5) The Planning Director has determined that this project will not have a significant impact on the environment and therefore has issued a Negative Declaration on April 29, 1982, which was approved by the Planning Commission on June 23, 1982. Conditions •jo General Conditions 1. Approval is granted for ZC-253, as shown on Exhibit 'A1, dated June 8, 1982, incorporated by reference and on file in the Planning Department. 2. This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated May 12, 1982, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. I . PROJECT DESCRIPTION AND BACKGROUND The applicant requests. approval of a preannexational zone change from A-70-8 and R-S-3 (County) to R-1-7500 (City) on 42.7 acres of land located as described above. Rezoning of this property to R-1-7500 would implement the general plan land use designation of RM (4-10 du's/acre) designated for this sito. This designation was adopted by the City Council on June'1, 1982. As a point of background, the subject property is adjacent to, but not within the city's sphere of influence. The City Council adopted a land use designation. for this site so that a sphere of influence boundary change could take place. The Council's intent is to annex the property into Carlsbad so. that the city can control access onto Melrose Avenue on both the east and west sides of this street. • . Land uses surrounding this property include single family residential to the north and east, three approved subdivision maps (The Meadows, Meadowbrook and Meadowcrest) to the west and Rancho Santa Fe Road to the south. The proposed R-1-7500 zone is compatible with these surrounding ' land uses and with the R-M general plan designation on the property. II. ANALYSIS . - Planning Issues 1. Will traffic generated by uses in the R-1 zone have an adverse impact to the existing and future street system? Discussion The potential traffic impacts created by R-1 uses on the surrounding street system is the only issue associated with this zone change. Access 'to the property could be provided from either Melrose Avenue or Rancho Santa Fe Road. If the property is annexed into Carlsbad, the city would have the ability to control access points along Melrose Avenue at the time any development occurs. "... Staff believes that any traffic impacts could be minimized if access onto Melrose Avenue is strictly controlled. Since the R-1- zone is consistent with the R-M land use designation and since no adverse traffic impacts would be- created by uses allowed in the R-1 zone, staff is recommending •approval of ZC-253. 111• ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant, impact on the environment and therefore has issued a Negative Declaration on April 29, 1982. IV. RECOMMENDATION ' It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Planning Director and ADOPT Resolution No. 1980, recommending APPROVAL of ZC-253 to the City Council, based on .the findings and subject to the conditions contained therein.
