RECOMMENDED ACTION:
Approve Resolution LqYOauthorizing retention of special counsel.
ITEM EXPLAMATION :
The Costa Real Municipal Water District has filed a law suit against the city
concerning water service area boundaries. Council desires to defend the city
against such suit and to settle the matter by negotiation and/or legal pro-
ceedings in the best interests of all the citizens of Carlsbad. The law firm of Best, Best and Krieger is an experienced firm in dealing with water issues .
FISCAL IMPACT:
The total cost of legal counsel is difficult to estimate since the length and level of activity of counsel is dependent upon the district. Funds are
available in water reserves to cover these costs.

RESOLUTION NO. 6940
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RETAINING ARTHUR LITTLEWORTH AND BEST, BEST & KRIEGER AS SPECIAL COUNSEL
WHEREAS, the City of Carlsbad has been sued by the Costa Real
Municipal Water District (CRMWD) and,
WHEREAS, the City Council desires to retain special counsel to defend
City in said litigation and,
WHEREAS, Arthur tittleworth and Best, Best and Krieger, have many
years legal experience and expertise in the area of water matters;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carl sbad as fol 1 ows :
1. Arthur Littleworth and Best, Best and Krieger are hereby retained
as Special Counsel to handle legal matters connected with the CRMWD lawsuit.
2. Mr. Littleworth is further authorized to serve on the negotiating
team representing the City to seek interim and long-range solutions to this
dispute.
3. The City Manager is hereby authorized to coordinate Mr. Littleworth's
efforts on behalf of the City.
4. The City Manager is authorized to pay Mr. Littleworth for services
rendered from Fund 41-57-10-2470 (Water - Professional Services).
