PL CITY MI RECOMMENDED ACTION: Both the Planning Staff and Planning Commission recommend that this application be APPROVED and that the City Attorney be Planning Cornmission Resolution No. 1978. directed to prepare documents APPROVING CT 81-30/CP-174, per ITEM EXPLANATION This item is a request for approval of a 260 unit tentative tract map and condominium permit on 27.6 acres of land located on the northwest corner of Poinsettia Lane and Paseo del Norte in the P-C zone. Two issues were brought up during the public hearing: 1) The requirement of the developer to pay for a pro-rata share for both a traffic study and the Poinsettia Bridge overcrossings at 1-5 and the AT&SF Railroad (conditions 34 and 35) ; and 2) The agency responsible for providing water service to this project . Poinsettia Bridge Overcrossing and Traffic Study The applicant opposes both conditions 34 and 35 of the Planning Commission resolution of approval. Condition 34 refers to the traffic study for the. bridge overcrossing. The applicant believes the wording of this condition is too vague and is reluctant to agree to something that appears so open-ended. Condition 35 requires the financial participation of the applicant for the Poinsettia Bridge overcrossings at 1-5. The applicant believes that he should not be responsible for paying for any part of this bridge and suggests that public facility fees should be used instead. The Engineerinq Department has reconsidered these conditions and is recornmending to the City Council that bridge improvements be included as part of the public facilities fees. Therefore, the City Engineer is now recommending that conditions 34 and 35 be deleted. Water Service Jack Kubota representing the Costa Real Water District raised tk issue of water service to this project. The Planning Commissior is requesting clear direction from the Council as to how to handle this issue when it is brought up during Planning Commission hearings. The Commission believes the issue is a Cit Council policy issue and would prefer to defer any discussion of the issue .to the City Council level, The Commission would like Council direction to do sane. 0 0 AGENDA BILL PAGE TW No other issues related to this project exist and the Planning Commission is therefore recommending approval. NO. 19'98 -9- 0 0 STAFF REPORT 9 DATE : Jane 23, 1982 I TO: Planning Commission FROM : Planning Department SUBJECT: CT 81-30/CP-174 - PACESETTER - This item is a request for approval of a 260 unit tentative tract map and condominium permit on 27.5 acres of property located on the northeast corner of Poinsettia Lane and Paseo del Norte in the P-C zone, I, PROJECT DESCRIPTION The applicant is requesting approval of a 250 unit tentative tract map and condominium permit on 27.599 acres of land located as described above, The proposed subdivision consists of 260 units made up of 49 fourplexes and eight eightplexes. The project's overall density is 9.42 du'ss/acre which is at the high end of "Lhe 4-10 du's/acre range designated for this site by the General Plan, The fourplex units would range in floor area from '1161 square feet to 1242 square feet and each eightplex unit would be 960 square feet in floor area. Street access would be provided by a public street running through the interior of tne project which would connect Camino de connection to the project would be from Paseo del Norte. Discussion As proposed, the project meets all development standards of the Condominium Ordinance. Open recreation requirements are met by areas, The southern active recreation area consists of a large swimming pool, jacuzzi, two tot lots, picnic benches, barbeques, open play area and a restroom. The northern active recreation area consists of a volleyball court, jacuzzi, bzrbeque, tot: lot, picnic area and! open play area, Patios will be provided for many two dctive recreation areas and a series o€ passive recreation 0 0 picnic area and open play area. Patios will be provided for many of the units. Overall, the project provides over 200 square feet per unit of useable recreation area. The project satisfies all other development standards of the Condominium Ordinance. With respect to design criteria, the project is comprehensively desigr,ed and well intecjrated with the topography of the site. An abundance of open space has been provided to enhance the living environment of the units. No major design problems were found to be evident in this project, In addition, the project meets all the mandatory findings for a subdivision as outlined in Title 20 (Subdivision Ordinance). III e ENVIRONMENTAL REVIEW - The Planning Director has determined that this project will not have a significant impact on the environment and therefore has issued a Negative Declaration on February 4, 1982. AlthoughtheCity will continue to pursue that path, such funding does not appear likely and ’alternatives should be investigated, One alternative is a bridge benefit district. This option is na longer open for the Palomar Airport Road Bridge because develop- ment approvals have already been given for the vast majority of property that would be included in the benefit district. In the case of Poinsettia Lane Bridge, much of the land in a potential benefit district may remain in open space making the developer c remaining land pay a rather high proportional share of the cost. The Pacesetter project (CT81-30) €or example, would be required to pay between $50,000 and $100,000 for only 260 units dependins ~n assumptions and mount sf development, It can also be argued that both streets--and therefore the two bridges--serve a Parge area and, therefore, are a general benefj to the City. Palomar Airport Road is a regional route, bringins traffic from San Marcos to the freeway and beach; Poinsettia Lar will eventually connect to Alga Road and Carrillo Way and go tc the east City limits. Because of the general benefit to the City and the uncertain fui ing by other means, I propose we include these two bridge widen. projects in the Public Facilities Program and fund them with mol collected under public facilities fees, Estimates of the costs for planning purposes are: Palomar Airport Road bridge widenin( and ramp reconstruction--$2,000,000; Poinsettia Lane bridge wid1 ing and ramp ~econstruct~on--$1,500,000~ These two projects wi increase the total. HAGANAN, Research/Analysis Manager J&/Y SUBJECT: ADDITION TO PUBLIC FACILITIES FEE PROJECTS Based on our previous conversation of Tuesday, July 13 and your memo of July 14, I assurreyou are specif- ically asking if the public facilities fee can accommodate your two bridge projects (1-5 at Poinsettia and Palomar Airport Road), since other sources of funding present some difficulties to your department in their implemen- tation. As you may be aware, we just began refining the PFF report two weeks ago. We will be presenting it to the City Council and Planning Commission as part of the Public Facilities Management System (PFMS) at their July 27 meet- ing. The public facilities fee portion is based on the estimated buildout population of Carlsbad, which certainly with estimated costs which will obviously be refined. will be subject to adjustment, as well as a project list In short, there is no way to accurately answer your question until the PFMS is initiated and functioning for a while. However, recognizing the above stated quall’fic- ations, and based on the figures supplied by your depart- ment, it seems that the two projects can be accommodated without necessitating an adjustment in the PFF percentage of assessment.
