SIGNS FOR FREEWAY SERVICE FACILITIES ZCA-143

RECOMMENDED ACTION:
Both the Planning Staff and Planning Commission recommend that this amendment be APPROVED and that the City Council direct the
City Attorney’s Office to prepare documents APPROVING ZCA-143.
ITEM EXPLANATION
This is a request to amend the Zoning Ordinance to modify the regulations regarding signing for freeway service facilities (motels, service stations, restaurants). Specifically the
amendment would modify the definition of freeway service facilities so that it applies to more tha’n one lot or parcel if they are joined in ownership, share common access or have an approved common parking-facilities plan. Presently the ordinance only allows the one lot or parcel located immediately adjacent to a freeway on-ramp or off-ramp to be considered a
freeway service facility. If this amendment is approved, still only one freeway-oriented sign would be permitted at each freeway on-ramp or off-ramp.

This amendment would also modify the present sign height regulations for freeway service facilities so that the height is
measured from the elevation of the freeway roadway adjacent to the location of the sign. Under the present ordinance freeway service businesses must abide by the same height regulations
regardless of their elevation with respect to freeway height. This part of the amendment is being accomplished at the
direction of the City Council so that all freeway service
facilities are treated equally.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated July 3, 1982, which was approved by the Planning Commission on July 14, 1982.
FISCAL IMPACT
This project will not cause any fiscal impacts.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CODE AMENDMENT, AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 21.41.030(6) AND 21.41.070(3)(B) TO MODIFY REQUIRE-
MENTS REGARDING FREEWAY SERVICE FACILITIES. APPLICANT: CITY OF CARLSBAD CASE NO: ZCA-I43
WHEREAS, the Planning Commission did, on the 14th day of
July, 1982, hold a duly noticed public hearing as prescribed by law
to consider said request; and
WHEREAS, at said public hearing, upon hearing and
:onsidering all testimony and arguments, if any, of all persons
iesiring to be heard, said Commission considered all factors
relating to the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
.. Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends APPROVAL of ZCA-143, according to Exhibit "A", dated July 14, 1982, attached hereto and made a part hereof, based on the following findings:

1) That the proposed amendment will allow freeway service
facilities to be adequately identified from the freeway.
2) That approval of this amendment will ensure that freeway service facilities will receive equitable treatment regarding sign height regulations.
3) That the project will not cause any significant environmental impacts and a Negative Declaration has been issued by the
Planning Director on July 3, 1982 and approved by the Planning Commission on July 14, 1982.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.41 OF THE CARLSBAD MUNICIPAL CODE BY THE AMEND-
MENT OF SECTION 21.41.030(6) AND 21.41.070(3)(B)
TO MODIFY REQUIREMENTS REGARDING FREEWAY SERVICE
FACILITIES.
The City Council of the city of Carlsbad, California, does
ordain as follows:
SECTION 1: That Title 21, Chapter 21.41 of the Carlsbad
Municipal Code is amended by the amendment of Section 21.41.030(6)
to read as follows:
located at the apex of a freeway interchange quadrant which contain
one or more of the following uses, a restaurant, a motel, or an
automobile service station. When two or more adjoining lots or
parcels are joined in ownership, share common access by means of recorded easement or have an approved common parking-facilities plan, they may be considered a freeway service facility for purpose of this chapter. In no event, however, shall any lot or parcel or portion thereof located more than 660 feet from the apex of a freeway interchange quadrant be considered part of a freeway servic
(6) "Freeway service facility" means a lot or parcel
- facility .
SECTION 2: That Title 21, Chapter 2
Municipal Code is amended by the amendment of
21.41.070(3)(B) to read as follows:

(B) One freestanding sign, not supported by a building, to be a maximum of thirty-five feet in height measured from the
elevation of the freeway roadway immediately adjacent to the proposed location of the sign. The sign shall be no more than
twenty-five feet in width and otherwise as stated in Table 2 below.

The Planning Commission may after public hearing approve an increase in the height of a freeway service facility sign up to 50 feet if it finds that the increased height is necessary because of severe constraints on view caused by topography,
natural vegetation, or existing buildings."
EFFECTIVE DATE: This ordinance shall be effective thirty
lays after its adoption, and the City Clerk shall certify to the
idoption of this ordinance and cause it to be published at least
mce in the Carlsbad Journal within fifteen days after its
idoption.

SUBJECT: ZCA-143, CITY OF CAR-LSBAD -- - An amendment to the Zoning
Ordinance to rnodiry reyulations regarding signing for
freeway service Eacilities.
I. PROJECT DESCRIPTION AND BACKGROUND - -
This amendment to the Zoning Ordinance would modify the defini-
tion of freeway service facilities and would also alter the pre- sent sign height regulations for these facilities.
The Planning Commission has recently considered several items regarding freeway service facilities which required both a definition and a sign height determination. This had two
results:
1) Staff became aware of the fact. that certain existing signs
for freeway service facilities identify businesses which are located on mere than one parcel.. Presently the ordinance only allows the one lot or parcel located
immediately adjacent to a freeway on-ramp or off-rmp to be considered a freeway service facilitiy. Often, a lot
that contains several freeway businesses may be divided up
into two or three lots for leasing or financing purposes.
2) The City Council requested that staff look into the height of freeway service signs in order to make the ordinance more equitable for these type of uses. At the present time, these businesses must abide by the same sign height regulations regardless of their elevation in respect to freeway height (see attached Exhibit "B" ) .
11. ANALYSIS -
Staff has addressed these issues and proposes the following
changes:
1) Amend Section 21.41.039(6) by the addition of the following words:
"When two or more adjoining lots or parcels are joined in
ownership, share common access by means of recorded ease-
ment or have an approved conmon parking-facilities plan,
they shall be considered a freeway service facility for
purposes of this chapter. In no event, however, shall any
lot or parcel or portion thereof located more than 660 feet from the right-ofway of a freeway on-ramp or off-ramp be
considered part of a freeway service facility."
- 2) Amend Section 21.47.070(3)(B) by the addition of the
following words:
"(B) One freestanding sign, not supported by a building, to be a maximum of thirty-five feet in height measured from
the elevation of the freeway roadway irnrnediately adjacent to the proposed location of the sign. The sign shall be no more than twenty-five feet in width and otherwise as stated
in Table 2 below.

IV. RECOMMENDATION __
It is recommended that the Planning Cominission APPROVE the
Negative Declaration issued by the Planning Director and ADOPT Resolution No. 1986, recommending APPROVAL of ZCA-143 to the City Council based on the findings contained therein. ---
