HQ\yD CITY ATTY \J f7~) CITY MGR.<Sfexl RECOMMENDED ACTION: Council adopt Resolution [$ 3 7 J which provides the JAC Administrator directions for payment of JAC attendance fees. ITEM EXPLANATION; The Basic Agreement as amended to JAC provides for the payment of attendance fees ($25 per meeting/ $50 per month maximum) to the official JAC representatives. City Staff may be appointed as a full time representative or an alternate. Currently the Utilities Director serves as an alternate and sits as a voting member when either of the primary representatives are absent. Under these circumstances he qualifies under the Basic Agreement to receive an attendance fee. This fee has been returned to the Treasury and ultimately is returned to the Sanitation Fund; however, this is viewed as an unnecessary administrative procedure that could be avoided simply by not receiving a fee. The matter was brought to the attention of the JAC for resolution. The JAC Counsel advised that the simple solution was a Resolution from the individual agencies to the JAC Administrator directing which members should receive attendance fees rather than an amendment to the basic agreement. A resolution to the JAC Admin- istrator (LCWD) is attached. FISCAL IMPACT: Minor administrative cost savings due to processing of warrants and accounting for returned attendance fees. EXHIBITS: A. Resolution No. '4 RESOLUTION NO. 6977 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD SETTING FORTH PROCEDURES FOR PAYMENT OF ATTENDANCE FEES TO CARLSBAD REPRESENTATIVES TO THE ENCINA JOINT ADVISORY COMMITTEE TO THE JAC ADMINISTRATOR. 4 5 WHEREAS Section 17.2 of*the Basic Agreement as amended by Section 7 of 5 the 7th Supplement to the Basic Agreement between Carlsbad and Vista Sanitation 7 District sets forth attendance fees for representatives to the Encina Joint 8 Advisory Committee and, 9 WHEREAS the representatives may be appointed from the Council, Staff or 10 the general public and, 11 WHEREAS staff are full time paid employees of the City and receive com- 12 pensation for such attendance as a part of their total compensation and 13 WHEREAS the return of and accounting for staff attendance fees reimbursed 14 back to the City Treasury are an unnecessary administrative cost. 15 NOW, THEREFORE, BE IT RESOLVED as follows: 16 1- The JAC Administrator is directed to pay attendance fees to elected and 17 apppointed officials only of the City of Carlsbad. 18 2.
