RECOMMENDED ACTION:
City Council adopt Resolution No. ln9tJ7 approving the amendment to the agreement between the City of Carlsbad and the Carlsbad Unified School District for the development, maintenance and use of the Jefferson/Buena Vista Elementar,y School Park Site.
ITEI4 EXPLANATION:
On November 10, 1981 the City Council approved the expenditure of revenue from the County's Eight Year Block Grant. $96,740 was earmarked for the development of the
Jefferson Elementary School Park Site.
The funding has been approved by the County.
there is specific wording that must be included in the aureement between the City
and School District before the project can begin.
However, accordina to HU@ regulations,
HUD CDBG regulations 24 CFR 570.000 (d) (2) state:
"(ii) Curing school hours the facility is not used for school purnose for !nore than four (4) hours each day."
The amendment that staff proposes to comply with the regulations reads:
"Public access will be granted at the Jefferson Elementary School Park Site by the approval of the Parks and Recreation Director and the Superintendent of
Schools between the hours of noon and 3:OO PF4 on school days."
Dr. Philip Grignon, Superintendent of the Carlsbad School District, reviewed the wording and found it acceptable.
The Board of Trustees of the Carlsbad Unified School District must also approve
this amendment.
FISCAL IMPACT:
The City will receive $96,740 from the County's Eight Year clock Grant to deve1or.1 the school site. The city will maintain the facility after completion at a cost of $16,500 per year.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
MENT BETWEEN THE CITY OF CARLSEAD AND THE
CARLSBAD UNIFIED SCHOOL DISTRICT FOR THE
ERSON/BUENA VISTA ELEMENTARY SCHOOLS FOR A
THE MAYOR TO EXECUTE SAID AGREEMENT.
OF CARLSBAD, CALIFORNIA, AMENDING AN AGREE-
DEVELOPMENT, MAINTENANCE AND USE OF JEFF-
CONMUNITY RECREATION PROGRAM AND AUTHORIZING
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. The certain agreement between the City of Carlsbad and
the Carlsbad Unified School District for development, maintenance
and use of Jefferson/Buena Vista Elementary Schools, approved by
Resolution No. 6718 and No. 6854, is hereby amended by revising
Page 2, Section I of that agreement to read:
a.. Page 2, Section 1: The District shall provide at no cost to the City for outdoor recreational
activities, access to and use of the multi- purpose athletic fields at the Jefferson/Buena Vista School sites on an after-school, weekend, holiday and summer vacation basis. The school will have exclusive use of the athletic fields
during the school year for 176 days from 8:OO a.m. to Noon. Restroom facilities shall be
provided when adequate supervision is available.
Public access will be granted at the Jefferson Elementary School Park site by the approval of the Parks and Recreation Director and the Superintendent of the District between the hours
of Noon and 3:OO p.m. on school days. !
2. The Mayor of the City of Carlsbad is hereby authorized
and directed to execute said agreement for and on behalf of the
City of Carlsbad.

City Council for the City of Carlsbad, California, held on the
7th day of September - , 1982, by the following vote, to
wit:
