Introduce Ordinance No.?byL/ revising the Park Dedication Ordinance.
ITEM EXPLANATION:
At its June 22, 1982 meeting the City Council amended the Park Dedication Ordinance by adopting Ordinance No. 9637, which excluded existing dwellings from the requirements of dedicating land or paying park-in--lieu fees.
Staff believes the Council's intent was to exempt existing single family dwellings that are part of a lot split from having to pay a parks fee, not to exempt apartment buildings which are converted to condominiums. The ordinance proposed for adoption will clarify the Council's position regarding condominium conversions and other planned developments when buildings are existing.
FISCAL IMPACT:
Adoption of Ordinance will require the developer to pay park-in-lieu fees of $464 to $888 per unit for condominium conversions. If this change is not made, the City will lose this income.

ORDINANCE NO. 9644
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 20, CHAPTER 20.44 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS
20.44.040 AND 20.44.050 TO ALLOW AN EXCEPTION FROM PARK DEDICATION REQUIREMENTS FOR EXISTING RESIDENCES.
The City Council of the City of Carlsbad, California does ordain as
fol 1 ows:
SECTION 1. That Title 20, Chapter 20.44 of the Carlsbad Municipal Code
is amended by the amendment of Section 20.44.040 to read as follows:
20.44.040 Standards and formula for dedication of land. If the City Council determines that a park or recreational facility is to be located in whole or in part within the proposed subdivision to serve the immediate and future needs of the residents of the subdivision, the subdivider shall, at the t,ime of the filing of the final or parcel map, dedicate land for such facility pursuant to the following standards and formula:
The formula for determining acreage to be dedicated shall be as follows:

The total number of dwelling units shall be the number permited by the City on the property in the subdivision at the time the final map or parcel map is filed for approval, provided, however, that except for subdivisions which consist of the convers.ion of existing buildings or mobile home parks into condominiums or other planned developments, any existing residential unit or units whether or not the unit or units wil be replaced, shall be subtracted from the total.

EFFECTIVE DATE: This ordinance shall be effective thirty days after
its adoption, and the City Clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in the Carlsbad Journal
within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meetingofthe Carlsbad City
Council held on the 7th day of September , 1982, and thereafter
PASSED AND ADOPTED at a regular meeting of said City Council on the 5th
