Hfl CITY ATTYXd CALAVERA HILLS WATER RECLAMATION FACILITY MASTER PLAN CITY MGR. RECOMMENDED ACTION: Council approve Resolution No. 6997 authorizing the Mayor to execute a contract with Mr. Glenn M. Reiter and Associates for professional services. ITEM EXPLANATION: Mr. Reiter developed a proposed scope of work to develop a detailed Master Plan for utilization of reclaimed water in the City of' Carlsbad. The proposal and scope of work were discussed by the Council at their workshop session on July 13, 27 and August 11. The scope of work has been restructured to focus on the Lake Calavera Hills service area and several tasks will be conducted by staff. to proceed. Council approved the staff recommendations on August 11 FISCAL IMPACT: The not to exceed cost to develop the Master Plan is $12,000. Funds are available in Fund 51-243-2450 (Water Enterprise - Professional Services) for this project. EXHIBITS: A. Resolution No. . REITER & ASSOCIATES FOR CONSULTING SERVICES TO DEVELOP A WATER RECLAMATION MASTER PLAN FOR THE LAKE CALAVERA HILLS RECLAMATION FACILITY. THE CITY COUNCIL of the City of Carlsbad, Czilifornia hereby resolve as follows: does 1. That an agreement between the City of Carlsbad and Glenn M, Heiter & Associates for consulting services to develop a water reclamation inaster plan for the Calavera Hills Water Re- clamation Facility service area, a copy of which is attached hereto marked "Exhibit A" and made a part hereof is hereby approved. 2. That the Mayor of the City of Carlsbad is hereby author- ized and directed to execute said agreement for and on the behalf of the City of Carlsbad. In the event this contract is terminated, all. documents, plans, work sheets, etc. shall- be delivered forthwith to the City. SUSPENSION Ol? T'ERMLNATION OF' SERVICES : --I_p- Thc City shall have the right to terminate this Agrceiiient and the work done undcr it at any tine without cause by giving thc Consultant vcrbal notice as to termination date, to be confirmcd by written notice of termination. In the event of tcrmination, the Consultant shall bc paid for the work accomplished to the date of termination in accordance with Secti.ons (4) and (5). -3- _- Upon request of the City, the Consultant shall assemble the work product and put .the same in proper order for proper filing a'nd. closing and deliver said product to the City. The Consliltant will. indemnify the City against and hold i.t harmless from all and any cost, expense, or lj-ability for damages on account of injury or death to persons or damage to property resulting from or arising out- of or in any way connected with the performance by Consultant of this Agreement, including the defense of any action arising therefrom.
