RECOMMENDED ACTION:
Council approve Resolution No. 6997 authorizing the Mayor to
execute a contract with Mr. Glenn M. Reiter and Associates for professional services.
ITEM EXPLANATION:
Mr. Reiter developed a proposed scope of work to develop a detailed
Master Plan for utilization of reclaimed water in the City of' Carlsbad. The proposal and scope of work were discussed by the
Council at their workshop session on July 13, 27 and August 11. The scope of work has been restructured to focus on the Lake
Calavera Hills service area and several tasks will be conducted
by staff.

FISCAL IMPACT:

Funds are available in Fund 51-243-2450 (Water Enterprise -

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING AN
AGREEMENT BETWEEN THE CITY OF CARLSBAD AND
GLENN M. REITER & ASSOCIATES FOR CONSULTING
SERVICES TO DEVELOP A WATER RECLAMATION MASTER
PLAN FOR THE LAKE CALAVERA HILLS RECLAMATION
FACILITY.
THE CITY COUNCIL of the City of Carlsbad, Czilifornia
hereby resolve as follows:

1. That an agreement between the City of Carlsbad and Glenn
M, Heiter & Associates for consulting services to develop a
water reclamation inaster plan for the Calavera Hills Water Re-
clamation Facility service area, a copy of which is attached
hereto marked "Exhibit A" and made a part hereof is hereby
approved.
2. That the Mayor of the City of Carlsbad is hereby author-
ized and directed to execute said agreement for and on the behalf
of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the

MkEREAS , the Consult ant has the experience and qualificati.ons

WHEREAS, it is understood that the Consultant shall. be an
independent coiitractor of the city;
NOW', TI-IEREFORE , the parties hereunto agree as follows :

(7) CIIANGES IN THE SCOPIZ OF THE PROJECT: - -
If conditions beyond 'the control of the Consultant necessitate
a change in scope of the project after work under Section (1.) above
has comiencecl, the Consultant shall submit his written estimate of

undertaking any additional work.
(8) KFSPONSIUlLITY OF CONSULTANT:

(9) OvJNERSIIIP OF DOCUMENTS :

All maps, studies, sketches, work sheets and documents as
herein recpireCi are the property of the City whether the work for
which they are made be executed or not. In the event this contract
is terminated, all. documents, plans, work sheets, etc. shall- be
delivered forthwith to the City.
SUSPENSION Ol? T'ERMLNATION OF' SERVICES :

the work done undcr it at any tine without cause by giving thc

by written notice of termination.
In the event of tcrmination, the Consultant shall bc paid for
the work accomplished to the date of termination in accordance
with Secti.ons (4) and (5).

Upon request of the City, the Consultant shall assemble the
work product and put .the same in proper order for proper filing
a'nd. closing and deliver said product to the City.
The Consliltant will. indemnify the City against and hold i.t
harmless from all and any cost, expense, or lj-ability for damages
on account of injury or death to persons or damage to property
resulting from or arising out- of or in any way connected with the
performance by Consultant of this Agreement, including the
defense of any action arising therefrom.

effect, cause to be maintained in force and effect an insurance

or eniplollee of the City, either before, during or after the
execution of this contract shall affect or modify any of the terms

This contract shall be effective on and from the day and year
