RECOMMENDED ACTION:
Staff is recommending that the City Council certify EIR 81-9 by
minute motion and direct the Attorney's office to prepare
documents approving GPA-62(A), 62(B), 62(C) and MP-149(J).
ITEM EXPLANATION:
On April 20, 1982, the City Council scheduled the city's floating
general plan amendment hearing for September 7. The city is
permitted to amend the Land Use Element three times during the
year. This will be the second amendment. The third amendment
has already been scheduled on a yearly basis for the last meeting
in November. The following general plan amendments and related
items are to be considered at tonight's meeting:
EIR 81-9/GPA-62(A) - A request from the Huntington Beach Company
to amend the Land Use Element near Palomar Airport from Non-
Residential Reserve to Planned Industrial. An EIR was also
processed with this application.
GPA-62(B)/MP-149(J) - The Daon Corporation is requesting an
amendment to the Land Use Element on the east side of Rancho
Santa Fe Road from Travel Service to Community Commercial. A
corresponding Master Plan amendment is also being processed.
GPA-62(C) - The city is processing an amendment to the Land Use
Element for property north of Alga and west of El Camino Real to
change the land use from Residential Low-Medium Density to
Residential Medium Density.
The Planning Commission heard these items on August 25 and
recommended certification of EIR 81-9 and approved of the
amendments to the general plan and La Costa Master Plan. For
more information, please see the attached staff reports to the
Planning Commission.
FISCAL IMPACT
Other than staff processing time, there will be no fiscal impact
to the city from the proposed amendments.
ENVIRONMENTAL REVIEW
GPA-62(A) was processed in conjunction with an environmental
impact report scheduled for certification at tonight's meeting.
Negative Declarations of non-significant impact were issued for
GPA-62(B), 62(C), and MP-149(J).

WHEREAS, a verified application for an amendment to the
General Plan designation and requirements for certain property
located as shown on Exhibits "A", dated August 25, 1982, attached
and incorporated herein, have been filed with the Planning
Commission; and
WHEREAS, said verified applicaitons constitute request for
amendment as provided in Title 21 of the Carlsbad Municipal Code;
and
WHEREAS, the Planning Commission did, on the 25th day of
August, 1982, hold a duly noticed public hearing as prescribed by
law to consider said requests: and
WHEREAS, at said public hearing, upon hearing, and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the General Plan Amendment.

B) That in view of the findings made and considering the
applicable law, the decision of the Planning Commission is to
recommend APPROVAL of GPA-62(A) , as described on Exhibit "A",

Findings;
1) The site is physically suitable in size and shape to
accommodate the proposed land use designation for reasons
stated in the staff report.
2) Uses allowed in the proposed, Planned Industrial, land use
designation are compatible with surrounding land uses for
reasons stated in the staff report.
3) The projects are consistent with all city public facility
policies and ordinances since:
a) Sewer service is not required for these projects and
subsequent development of the property will require the
availability of sewer service to serve such developments or
construction cannot occur.
b) The applicant has agreed and is required by the inclusion
of an appropriate condition to pay a public facilities fee.
Performance of that contract and payment of the fee will
enable this body to find that public facilities will be
available concurrent with need as required by the General
Plan.
4) An Environmental Impact Report has been prepared and the
Planning Commission has recommended, by minute motion,
certification of the EIR to the City Council. The Draft
Environmental Impact Report has been amended to include the
comments and documents of those testifying at the public
hearing and responses thereto. The Planning Commission
certifies that the Environmental Impact Report has been
completed in conformance with the California Environmental
Quality Act and the State guidelines and that the Planning
Commission has reviewed, considered and evaluated the
information contained in the report. The Environmental Impact
Report as so amended and evaluated is recommended for
acceptance as the Final Impact Report as recommended is
adequate and provides reasonable and feasible alternatives
thereto, including "no project."

WHEREAS, on August 25, 1982, the Planning Commission, of
the city of Carlsbad, held a public hearing on EIR 81-9 pursuant to
the provisions of Title 19 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission has considered the
comments and documents of all those persons testifying at the
public hearings; and
WHEREAS, the Planning Commission has received EIR 81-9
according to the requirements of Title 19 of the Carlsbad Municipal
Code; and
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the city of Carlsbad as follows:
1. That the foregoing recitations are true and correct.
[2. That the Environmental Impact Report EIR 81-9 will be amended
to include the comments and documents of those testifying at
the public hearing and responses thereto hereby found to be in
good faith and reason by incorporating a copy of the minutes to
said public hearings into the report.
That the Planning Commission finds and determines that the
Environmental Impact Report EIR 81-9 has been completed in
conformance with the California Environmental Quality Act, the
state guidelines implementing said Act, and the provisions of
Title 19 of the Carlsbad Municipal Code and that the Planning
Commission has reviewed, considered and evaluated the
information contained in the report.
That the Environmental Impact Report EIR 81-9 as so amended and
evaluated, is recommended for acceptance and certification as

STAFF REPORT
DATE: August 25, 1982
TO: Planning Commission

SUBJECT: EIR 81-9/GPA-62 (A) - HUNTINGTON PALOMAR - Request to
amend the Land Use Element of the Gener-al Plan from
Non- Residential Reserve to Planned Industrial.
I.PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting that the Land Use Element of the
General Plan be amended to redes ignate property located on the
north side of Palomar Airport Road and approximately one mile
east of Interstate 5 from Non-Residential Reserve (NRR) to
Planned Industrial (PI). An Environmental Impact Report was
prepared for this project (EIR 81-9) and must be certified
before any approval to amend the General Plan.
The applicant is proposing a large industrial park on the 110
acre project site currently located in the county. The
surrounding land uses include the Signal Landmark Airport
Business Center site, adjacent to the east; proposed Macario
Canyon Park, to the north; Koll Carlsbad Research Center, to the
northeast; the Ecke Agricultural Preserve, to the west and vacant
industrial and Non- Residential Reserve property, to the south
across Palomar Airport Road.
The project site is characterized by rolling hills and some steep
slopes requiring substantial amounts of grading. A portion of
the site may be impacted by a higher potential for aircraft
accidents associated with Palomar Airport. Annexation, a zone
change, a specific plan and a tentative subdivision map will
eventually be processed for the subject property.
EIR 81-9
I. IMPACTS
1 . Airport Impacts
A* Crash Hazard; The EIR identifies a crash hazard
area over the project and recommends that either no
development or low intensity development occur in
this area. Staff believes that this impact can be
mitigated through development restrictions
incorporated in the required specific plan.
B. Noise: Noise levels created by overhead aircraft,
and secondarily from vehicular traffic along
College Boulevard and Palomar Airport Road, may
reach or exceed 65 dBA CNEL at the eastern extremes
of the project site. These levels are not
considered incompatible with industrial use by HUD
or city of San Diego standards. However, aircraft
noise impacts can be mitigated by incorporating
sound-proofing measures in the building design.
2. Topography
The natural topography of the site is predominately
characterized by gently rolling hills with some steep
slopes and corresponding valleys. Approximately 14
acres of slope are .in excess of 25 percent. The EIR
indicates that the project will create significant, but
unavoidable, impacts to the visual quality of the site.
The project will substantially alter the existing
topography by grading required to provide the large
flat pads necessary for industrial development.
Mitigation can be provided by contour grading to
maintain the appearance of natural hillsides, special
landscaping, reduced grading, and special setbacks in
the more visible areas of the site, such as along
Palomar Airport Road.
3. Traffic Circulation
The EIR indicates that the project will generate
approximately 10,000 trips per day. Through a daily
volume capacity analysis, deficiencies on Palomar
Airport Road were identified west of the project site
and east of El Camino Real. Future traffic problems are
anticipated at the intersections of Palomar Airport
Road and El Camino Real. The deficiencies on Palomar
Airport Road and operational problems at the identified
intersections will occur without the proposed project
due to the volume of projected traffic generated by
other future developments in the area. The Huntington
Palomar project represents only a five percent increase
in future traffic growth. These impacts can be
mitigated by revised geometries at the intersection of
Palomar Airport Road and College Boulevard,
construction of College Boulevard across the project
site along with an area-wide approach to road and
intersection improvements and some modifications to the
project's internal circulation system.
Staff believes that EIR 81-9 has been prepared in compliance
with the city's Environmental Protection Ordinance and
adequately identifies and recommends mitigation measures for
potential impacts on the environment.

I. ANALYSIS
Planning Issues
1. Has the applicant provided sufficient justification
that this area of NRR should be reclassified to PI?
2. Is the proposed use the most appropriate for the site?
piscussion
The Non-Residential Reserve (NRR) classification of the land use
plan holds areas of land in reserve for future non-residential
uses. The Land Use Element states that the burden of proof to
reclassify this area rests with the developer or owner. The
developer is indicating that a light industrial park is the most
appropriate use for this site because other uses are less
compatible with the nearby airport than industrial uses. The
applicant has also indicated that the property is adjacent to
other industrial uses and is therefore compatible. Also, the
general plan indicates that the NRR category is designed for non
residential type uses which is consistent with the proposed
industrial use. Staff concurs with the applicant's
justification. The proposed industrial park would be consistent
with existing and future uses in the area and would be less
impacted by the airport than other non-residential uses. For
these reasons, staff believes that industrial use is the best
use for the site.
It is anticipated that the specific plan, required for this
property because of its proximity to the airport, will ensure
proper access to the site, standards for development and an
overall high quality industrial park.
RECOMMENDATION
It is recommended that the Planning Commission APPROVE
Resolution Mo. 2003, recommending to the City Council .
CERTIFICATION of EIR 81-9.
It is also recommended that the Planning Commission ADOPT
Resolution No. 2002, recommending APPROVAL of GPA-62 (A), based
on the findings contained therein.

SUBJECT: GPA-62(B)/MP-149(J) - DAON CORPORATION - A request to
amend the Land Use Element of the General Plan and the
La Costa Master Plan from Travel Service (TS) to
Community Commercial (C) on property located on the
southwest corner of Rancho Santa Santa Fe Road and
Mision Estancia.
I. PROJECT DESCRIPTION
The applicant is requesting an amendment to the Land Use Element
of the General Plan to change a nine acre site from Travel
Service Commercial (TS) to Community Commercial (C). The request
also includes an amendment to the La Costa Master Plan which
would make the land use in that document consistent with the
proposed general plan change. Please see Location Map
(attached).
II. ANALYSIS
Planning Issues
1. Is the proposed general plan amendment appropriate for the
site?
2. Is the proposed designation compatible with existing and
proposed land uses in the area?
Discussion
Travel Service (TS) is the current general plan designation on
the subject property. The general plan indicates that the TS use
category is primarily for motels, hotels, restaurants and service
stations which cater to the traveling public. Based on the types
of uses allowed and the location of the subject property, staff
feels "that the property is more suitable for the Community
Commercial designation. The amount of tourist oriented or
stop-over type traffic necessary to support the Travel Service
land use could be better found near 1-5, Highway 78 or El Camino
Real.
The applicant is proposing the Community Commercial (C) designa-
tion for the subject property. Staff feels that this would be an
appropriate use for the site. The general plan states that the C
designation should provide a wide range of retail trade (market,
banks, restaurant, drug stores, etc.), should be located at the
intersection of arterials, and should be between six and twelve
acres in size. The property meets this criteria, as it is
located at the future intersection of Rancho Santa Fe Road and
Mision Estancia, both arterial streets. The property is nine
acres in size.
MP-149(J)
The master plan is an implementing tool of the general plan and
should be consistent with that document. As a result, the
applicant is proposing changes to the master plan text which
correspond to the proposed amendment above (see Exhibit "ft",
attached). Staff feels these changes are consistent and would
also propose an additional condition to- the master plan text
which would require a La Costa development plan (site develop-
ment plan) for development of the property. Staff feels this
would give the Planning Commission the ability to review the
project for proper access to the proposed commercial area.
III. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this amendment
will not have a significant effect on the environment and,
therefore, has issued a Negative Declaration on August 9, 1982.
IV. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2010 recommending APPROVAL of GPA-62(B), and
Resolution No. 2011 recommending APPROVAL of MP-149(J) to the
City Council based on the findings contained therein.

SUBJECT: GPA-62(C) - CITY OF CARLSBAD - A request to amend the
land use element of the general plan from Residential
Low-Medium Density (RLM) to Residential Medium Density
(RM).
I. PROJECT DESCRIPTION
The city is requesting an amendment to the land use element of
the general plan from Residential Low-Medium Density (RLM 0-4
du/ac) to Residential Medium Density (RM 4-10 du/ac) on property
located north of Alga Road approximately 500 feet west of El
Camino Real. The land involved in this amendment consists of the
westerly portions of four parcels fronting on El Camino Real
(Exhibit "A"). The combined acreage of the properties involved
in this general plan amendment is approximately 17.6 acres. The
property involved in this general plan amendment' is covered with
native vegetation and slopes down to the east. The city is
initiating this amendment to clarify the location of the
boundaries for the RM designation in this area.
II. ANALYSIS
Planning Issues
1. Is the proposed land use amendment to Residential Medium
Density an appropriate use for the site?
2. Would the proposed general plan amendment adversely impact
the surrounding properties?
Discussion
Staff feels the proposed general plan amendment from Residential
Low-Medium (0-4 du/ac) to Residential Medium (4-10 du/ac) is an
appropriate use for this site. One of the general plan policies
for residential areas is to locate multiple-family residences
adjacent to commercial areas. As shown by Exhibit "B", the land
involved in this general plan amendment is immediately adjacent
to commercially designated property. Staff feels that approval
of this amendment would create a transition area between the
commercial properties along El Camino Real and the Residential
Low-Medium properties to the west.
It is also the intent of the general plan to allow land use
designation boundaries to follow property lines whenever
possible. It is easier to prepare a comprehensive development
plan for a parcel when the entire parcel has the same general
plan designation.
The northernmost parcel involved in this general plan amendment
has two general plan designations at the present time, RM and
RLM . Approval of this amendment would allow all of this parcel
to have a general plan designation of RM.
Approval of this general plan amendment would not have an adverse
impact on the surrounding properties. As shown by Exhibit "B",
the area involved in thi$ amendment merges into area designated
RM to the north. The property to the south is already designated
RM while the property to the east is designated Community
Commercial (C). As mentioned previously, this amendment would
create a good buffer between the RLM and C areas.
At the present time, all of the surrounding properties are
vacant. Traffic generated by the development of the subject
properties at a higher density should not adversely impact the
existing single family residential project to the southwest.
When the subject properties do develop, they will have potential
access onto Alga Road or a future extension of Dove Lane.
The three southernmost parcels already have a zoning of RD-M
which would be consistent with the proposed general plan designa-
tion. The northernmost property involved in this amendment is
presently within a county island, but most likely will be zoned
RD-M when it annexes to the city.
Overall, staff feels that the requested general plan amendment
to RM would be appropriate and compatible with the surrounding
properties.
111 • ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that approval of
GPA-62(C) will not have a significant impact on the environment
and, therefore, has issued a Negative Declaration on July 29,
1982.
IV. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2009 recommending APPROVAL of GPA-62(C),
based on the findings contained therein.
