TITLE: VACATING A PORTION OF JAMES DRIVE
RECOMMENDED ACTION:
Adopt Resolution No. James Drive. 70 I J' , summarily vacating a portion of
ITEM EXPLANATION:
A request to vacate a surplus easement on James Drive was made by O'Day Consultants. The Engineering Department has reviewed the request and concluded that this portion of James Drive contains no usable access to adjoining properties. The utility companies were notified of the vacation. San Diego Gas and Electric requested an easement for overhead electric facilitv. There are no other utilities on the proposed portion of James Drive. Since a portion of James Drive is an excess right-of-way and is not required for street purposes, it could be summarily vacated under Section 8334 of Streets and Highways Code.
FISCAL IMPACT:
Approval of the above street vacation will result in approximately 334 square feet of land to be returned to tax rolls.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSRAD, CALIFORNIA SUPr,MARIL,Y VACATING AN EASE-
MENT OVER A PORTION OF JAPES DRIVE. -
hJHEFU3AS, that easement previously dedicated contains no public
facilities or appurl-enances, and provides no usable access to the
adjoining propcrty;
NOW, THEmFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
3.. The above facts are true and correct.
2. That, pursuant to Section 8334 of Chapter 1050 of the
California Streets and Highways Code, sai.d easement referenced
above, be summarily vacated.
PASSED, APPROVED, AND ADOPTED at a regular ineeting of the
City Council held on the - 21st day df Sepbnber I
