CITY CITY O § o oO RECOMMENDED ACTION: Adopt Resolution No. 7d£& rejecting bids and authorising the re- advertisement of Contract No. 1117 for the dredging and improvement of Buena Vista Lagoon in March, 1983. ITEM EXPLANATION: On August 17, 1982, City Council authorized the advertisement of the dredging and improvement of Buena Vista Lagoon. On September 9, 1982, one sealed bid was received from Art Broman General Engineering for the amount of $826,000. This was $12,000 less than the Engineering estimate $832,000. References were checked and the firm has good references. The California State Department of Fish and Game reviewed the bid and found it acceptable; unfortunately, they have not been able to clear the Hughes disposal site. By the most optimistic consideration, Hughes could only be available in late October. The final Coastal Commission permits have not been obtained by Hughes. Fish and Game have reconsidered and recommend that the City wait until March to dredge. Their feeling is that the money would be better expended in the Spring. The absolute cut-off date by the Coastal Commission of December would mean that mobilization money was spent to no avail. Their assessment was that it would be more prudent to wait until Spring. Therefore, they have not approved the bidders. FISCAL IMPACT: Sufficient funds in the amount of $990,000 are available in Account #18-81-07-312. This money will remain available until Spring. RESOLUTION NO. 7028 A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF CARLSBAD, CALIFORNIA, REJECTING BIDS AND AUTHORIZING THE RE-ADVERTISEMENT OF CONTRACT NO. 1117 FOR DREDGING AND IMPROVEMENT OF BUENA VISTA LAGOON. WHEREAS, bids have been received by the City of Carlsbad for Contract No. 1117; and WHEREAS, the California Department of Fish and Game has not approved the bid for this project by Art Broman General Engineering. WHEREAS, it now appears more prudent to wait until Spring to perform this work. 10 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 11 Carlsbad as follows: 12 1. The above recitations are true and correct. 13 2. The bid of $826,000 by Art Broman General Engineering for Contract. 14 No. 1117 for Dredging and Iitprovement of Buena Vista Lagoon is hereby rejected 15 and City Clerk is hereby authorized to release the bid bond. 16 PASSED, APPROVED AND ADOPTED by the City Council of the City of 17 Carlsbad at a regular meeting held the 5th day of October ,1982 18 by the following vote to wit: 19 AYES: Council Members Casler, Lewis, Chick, Kulchin and Anear 20 NOES: None 21 ABSENT: None 22 MARY/H. Casler City of Carlsbad 1200 Elm Avenue Carlsbad, CA 92008 Dear Mayor Casler: The Department vciuld like to request that the Carlsbad City Council reject the bid that was submitted for the Buena Vista Lagoon Restoration Project (City of Carlsbad Contract #1117). Time delays in the permit process, especially concerning one of the disposal sites, necessitates this action. Because of the impending rainy season, we feel that proceeding with the project this late in the year would jeopardize the effectiveness of the work. We are currently in the process of applying for permit amendments that would allow us to work in the spring, summer and fall of 1983. When we ascertain the response to these applications, we will request that the City readvertise the project and request bids. We fully appi'eciate the cooperation and effort that ttie City has extended us in the development of this project. The timely work of Mr. Larry Dossey and his staff is especially noteworthy and we look forward to our continued good working relationship.
