RECOMMENDED ACTION:
Adopt Resolution No. ^76 3 LJ raising school fees in the Encinitas
School District.
ITEM EXPLANATION;
The Encinitas School District has submitted a letter requesting
revision of school fees, the district has recertified overcrowding
in its attendance areas and is requesting that school fees collected
from developers, pursuant to SB201 and Chapter 21.55 of the Municipal
Code, be increased 7.5%. The fee increase is summarized as follows:

The present fees became effective October 1, 1981. The Municipal
Code allows the Council to adjust fees from time to time by resolu-
tion. The revised fees will become effective November 1, 1982.
The district has also reported how school fees have been used to
relieve overcrowding.

No direct fiscal impact on the City.

6 WHEREAS, pursuant to Chapter 4.7, Division 1, Title 7 of the
7 California Government Code, the City Council of the City of
8 Carlsbad, California has adopted a School Facilities Dedication

and Fee Ordinance (Carlsbad Municipal Code Chapter 21.55); and
WHEREAS, Section 21.55.150 of the Carlsbad Municipal Code
provides that the standards for the amount of fees to be required
pursuant to such ordinance shall be determined by the City Council
and set by resolution. The City Council's determination is to be
made after consideration of recommendations from the governing
board of the affected school district; and
WHEREAS, the City Council established standards for the amount
of fees to be required pursuant to Chapter 21.55 in Resolution
No. 5999; and
WHEREAS, the City Council is in receipt of recommendations
in regards to revised amount of fees from the Encinitas Union
School District. Their recommendation is attached hereto as
Exhibit A, and is made a part hereof; and
WHEREAS, the City Council fully considered the matter at
the regular meeting of October 19, 1982 at which the City
Council determined to concur in the revised standards as recom-
mended by the Board of the Encinitas Union School District.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the standard for the amount of fees to be required
as a condition of approval for residential developments within
that portion of the City of Carlsbad, which is also within the
boundaries of the Encinitas Union School District, shall be as
contained in Exhibit A.
C. This determination is based upon the City Council's
concurrence in the recommendations made by the Governing Board of
the Encinitas Union School District, including the facts support-
ing such recommendations as contained in Exhibit A.
D. Unless the decision-making body especially determines to
the contrary, the City Council hereby determines that the following
findings and requirements shall apply to any residential develop-
ment of fifty units or less:
1. All such developments shall be required to pay fees
in accordance with the schedule in Exhibit A.
2. The City Council has reviewed that portion of the
General Plan which applies to the Encinitas Union
School District and finds that it provides for the
location of public schools.
3» That the fees to be paid shall be used for the
purpose of providing interim school facilities.

That the fees to be paid for each unit bear a
reasonable relationship to the burdens placed
on the School District by such unit and that the
fees will be used to mitigate that burden.
That the school facilities to be funded by the fees
are consistent with the City's General Plan.

E. The standards adopted by this resolution do not at this

time require the dedication of land. The.Encinitas Union School

District is developing standards regarding such dedications.
When the District is prepared to make their recommendation in
that regard, the City Council intends to amend this resolution
to include provisions for requiring the dedication of land as
they determine to be in the public interests.
F. Effective Date The fee schedule approved by this
Resolution shall become effective on November 1, 1982.

The following letter is in response to Section 21.55.260 (Fee Fund Records
. and Reports) of the above-named ordinance. The Encinitas Union School

During the 1981-82 school year, the District expended $31,751. for consul-
tant! services for/future facility needs, two. relocatable classrooms and

The Board of Trustees took action at its Regular Meeting on August 17, 153;
to identify all attendance areas in the.District as overcrowded for the
,1982-83 school year. The Board also revised its policy in the availability
of facilities, modifying the developer fee, to take into consideration the
increase cost of providing temporary classrooms. The new fee schedule is

Financial Assistance from Developers
It is the intent and purpose'of the Board in adopting this policy
that adequate school facilities shall be available to meet the
needs of students coming from all residential units in the District
The District's commitments to completed and future dwelling units,
secured by agreements, have taxed District facilities beyond ac-
ceptable limits.
Financial assistance will be established annually on a per bedroom
or like room basis for all units. In an effort to meet needs
caused by changing conditions, the administration will continually
enter negotiations to bring all developments into compliance with
the fee. Agreements with developers will be made so that the
agreed fee is paid in such manner as to have facilities available
when students arrive.
During the base year of 1980, the fee is $400. per bedroom or like
room. All agreements shall include an inflation factor based on
the Engineering News Record Index (ENRI) for Southern California
which will be applied at execution of the agreement.

The adjustment will be applied by Board resolution in August of
each year. It shall use the 1980 figure as base with compounding
of annual inflation factor. Further, subject to ratification by
this Board, the Superintendent of this District is authorized to
negotiate with developers and land owners, and to enter into agree-
ments on behalf of this Board according to terms and conditions set
forth in the documents entitled "Security Agreements Between Owner,
Developer, and Encinitas Union School District," and "Secured Agree-
ment Between Owner as Developer and Encinitas Union School District"
respectively.
This policy, and accounting of dwelling units covered by agreements
will be received in March and August of each year at the first
Board meeting of the month.

The Encinitas Union School District fees were set at $400.00 per bedroom for
1979-80.
In 1980-81 the ENR (Engineering News Record Index) was used $400 X 6.62% ~
$426.00 per bedroom
For 1981-82 the ENR (Engineering News Record Index) is still being used
$426 X 9.33% = $465.00 per bedroom.
The Encinitas Union School District developer fees' will be $465.00 per
bedroom beginning 8/1/01 to 7/31/82.

The following letter is in response to Section 21.55.260 (Fee Fund Records
and Reports) of the above-named ordinance. The Encinitas Union School
District maintains a separate account for all fees paid under this ordi-
nance. There were receipts of $55,298. with a rebate to certain owners in
La Costa covered by the La Costa Agreement of $5,400.

IN SCHOOL ATTENDANCE AREAS

Member , and carried, the following Resolu-
tion is adopted:
WHEREAS since 1974, the Encinitas Union School District
has grown in enrollment from 1,868 to 3,035; and
WHEREAS, in this period of time, the District has
approved agreements with developers for the construction of
housing units in excess of 4,500 units; and
WHEREAS, in this period of time, the District has chosen
to use year-around scheduling to mitigate the overcrowding
of schools; and
WHEREAS, the following housing patterns exist in District
schools:

SCHOOL - CITY COMMITTEE
At its meeting August 5, the School - City Committee referred
to Council and Board the following recommendations:
1. SCHOOL FACILITIES PLAN
(a) That the plan projecting school facilities needs to
buildout be approved in concept, and
(b) that the plan be presented to other school districts
within the city limits, and
(c) that city staff restudy location of community parks
in order to locate school sites and parks on contiguous
lands.
2. MASTER MAINTENANCE AGREEMENT
That administration prepare a joint use agreement to carry
out the following policy.
(a) That City have option to schedule use of any school
grounds for community recreation provided the City
agrees to pay 50% of the cost of maintenance and
renovation of turfed areas used.
(School-City maintenance staff to provide figures
on number of acres and annual maintenance cost.)
(b) That City schedule after-school use of school grounds
except the High School.
(c) That community or city use of high school grounds be
scheduled by high school staff on a permit basis.
(d) That city use of high school gym be subject to following
conditions:
— School charge $30/hour
-- City Supervisor in gym at all times
— Locker rooms not open to public.

(e) That city maintain and schedule community use of
tennis courts subject to school paying 50% of cost
of nets and reconditioning of courts.
3. SWIMMING POOL
Committee is seeking policy guidance on pool usage. The
following alternatives were discussed.
(a) No change. School use of pool be governed by existing
agreement which provides that city and school share
maintenance cost based on proportionate hours of use.
(1982 M&O cost of pool is about $17 per hour.)
(b) Allow school use of pool without charge.
(c) Charge the cost of school use against the $200,000
buy-out provision in existing agreement.
(The agreement set a value of $200,000 on the 5-acre
site. If city terminates agreement then city must
pay District $35.87 for each day from termination
date to July 30, 1992.)
(d) Trade-off free pool use for free cultural center use.
It is requested that Council approve or modify above alternatives
and instruct City Manager to take necessary action to implement
Council's decisions.

COUNCIL ACTION:
8-10-82 Council approved the reconmendations on the school facilities plan and
master maintenance agreement, and requested that the school district
make a proposal regarding the Swimming Pool.
