RECOMMENDED ACTION: -v
Adopt Resolution No. 7037 declaring the intention to vacate a portion of
Oak Avenue and setting a public hearing for 6 p.m., November 2, 1982.
ITEM EXPLANATION:
A request to vacate a portion of Oak Avenue was made by C.S.R. Realty. The
City currently has 80 feet of right-of-way. There has been no improvement
on either side of the street.
Staff has reviewed the vacation and concluded that only 60 feet of right-of-way
is required for this street, and there is no plan to widen the street to
existing 80 feet right-of-way.
The utility companies have been notified of the vacation.
and San Diego Gas and Electric have indicated that they have service lines
along the proposed street vacation and requested an easement. Staff recommends
that this vacation be conditioned for street improvement by the property owner.
Pacific Telephone
FISCAL IMPACT:
Approval of this vacation will result in approximately 1,430 square feet of
land to be returned to tax rolls.

LEGAL, DESCRIPTION OF A 10' WIDE PORTION OF OAK AVENUE TO BE VACATED.
A 10.00 foot wide portion of Oak Avenue along the Northwesterly line of Block 18 as shown on the Map of the Town of Carlsbad in the City of Carlsbad, County of San Diego, State of California, according to the Map thereof No. 535 filed in the Office of the County Recorder of said San Diego County on May 2, 1888, and more particularly described as follows:
Beginning at the North corner of said Block 18; thence along the Northwesterly boundary of said Block 18, South SO27 ' 00" West, 136.75 feet to the Easterly line of Carlsbad Boulevard (Old Highway 101, 100.00 feet wide); thence leaving said Easterly line of Carlsbad Boulevard, Northeasterly 24.86 feet along the arc of
a 29.06 foot radius tangent curve with a central angle of 49°00'45'' concave Southeasterly to a point of tangency with a line that is
10.00 feet measured at right angles, Northwesterly of said North- westerly boundary of Block 18; thence parallel to said Northwesterly boundary of Block 18, North 55°27'00'' East, 114.81 feet to the Northwesterly prolongation of Northeasterly boundary of said Block 18; thence along said Northwesterly prolongation South 34'33' 00" East, 10.00 feet to the Point of Beginning.
Excepting from this vacation an easement for all existing utilities.

The City Council. of the City of Cirlsbad, CcL-f.iEornia, does hereby
resolve as follows:
1. The City Council of the City of Carlsbad hereby declares its
intention to proceed under the provisions of Public Streets, Highways,

and Service Easement Vacation Law of 1981 to vacat.e a portion of Oak Avenue
located between Carlsbad Boulevard and Lincoln Avenrie.
2. A public hearing shall be held at the City Couccil Chambers at
1200 Elm Avnr.ue, CasSsSad, California, at 6 p-m- on November 2, 1982, for
the purpcse of hearing all persons interested in OK ohjectinq to said
proposed vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
