TITLE: ZONE CODE AMENDMENT: FREEWAY SERVICE FACILITY SIGNS - CITY OF CARLSBAD

RECOMMENDED ACTION:
RECOMMENDATION :
Both the Planning Staff and Planning Commission recommend that
this application be APPROVED and that the City Council introduce
Ordinance No. 9642.
ITEM EXPLANATION:
This item is an amendment to the Zoning Ordinance regarding freeway service facility signs. This item was previously reviewed by the City Council, but at that time, a concern arose
that the permitted sign area was excessive. The ordinance does not presently set an overall maximum sign area when more than two uses are identified on a freeway sign, but allows each use to have 150 square feet of sign area per use. Staff and the Planning Commission have addressed this issue and agree with the City Council's concern. Therefore, with this additional item,
three modifications to the existing ordinance are requested:
1) A new definition for a ''freeway service facility;"
2) A revision to the maximum sign height allowed for such
facilities which would be thirty-five feet measured from the elevation of the freeway roadway: and
3) A revision to the maximum area for such signs which
would allow one-hundred fifty square feet for one use
and an absolute maximum of two-hundred fifty square feet
when two or more uses are identified on a freeway sign.
Staff and the Planning Commission believe that this ordinance
will provide for a more consistent review of freeway service
facility signs.
Commission approval of sign heights greater than thirty-f ive
feet for facilities that are located on lots which have extreme
topographical constraints.
The ordinance would provide for Planning
Through staff review and Planning Commission hearing, all
issues on this matter have been satisfactorily resolved.
ENVIRONMENTAL REVIEW:
The Land Use Planning Manager has determined that this project
will not cause any significant environmental impacts and,
therefore, has issued a Negative Declaration, dated July 3, 1982,
which was approved by the Planning Commission on July 14, 1982.
A copy of the environmental documents is on file in the Land Use
Planning Office.

OF CARLSSAD, CALIFORNIA, RECONMEXDING APPROVAL OF
A ZONE CODE AMENDNENT, AMENDING TITLE 21 OF THE
CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS
21.41.030(6) AND 21.61.070(3)(B) TO MODIFY REQUIRE-
MENTS REGARDING FREEWAY SERVICE FACILITIES.

WHEREAS, at said public hearing, u2on hearing and
considering all testimony and argumnts, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows::
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission reccmrnends APPROVAL of ZCA-143, according to
Exhibit "A", dated October 13, 1982, attached hereto and madz :
part hereof, based on the following findings:
Findingsr-
1) That' the proposed amendment will allow freeway s~rvice
facilities to be adequately identified from the freeway.
That approval of this amendment will ensure that freeway service facilities will receive equitable treatment regardiwg
sign height and sign area regulations.
3) That the project will not cause any significant environmenf::sl impacts and a Negative Declaration has been issued by the Ls~d Use Planning Manager on July 3, 1982 and approved by the Planning Commission on July 14, 1982.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.41 OF THE
CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION
21.41.030(6) AND 21.41.070(3)(B) TO MODIFY REQUIREMENTS
REGARDING FREEWAY SERVICE FACILITIES.
The City Council of the City of Carlsbad, California, does
brdain as follows:
SECTION 1: That Title 21, Chapter 21.41 of the Carlsbad
lunicipal Code is amended by the amendment of Section 21.41.030(6)

(6) "Freeway service facility" means a lot or parcel ocated at the apex of a freeway interchange quadrant which contaim )ne or more of the following uses, a restaurant, a motel, or an lutomobile service station. When two or more adjoining lots or larcels are joined in ownership, share common access by means of
*ecorded easement or have an approved common parking-facilities llan, they may be considered a freeway service facility for purpose:
If this chapter. In no event, however, shall any lot or parcel or lortion thereof located more than 660 feet from the apex of a reeway interchange quadrant be considered part of a freeway service acil ity .
SECTION 2: That Title 21, Chapter 21.41 of the Carlsbad
unicipal Code is amended by the amendment of Section
1.41.070(3)(B) to read as follows:
(B) One freestanding sign, not supported by a building, tc
le a maximum of thirty-five feet in height measured from the
levation of the freeway roadway immediately adjacent to the roposed location of the sign. The sign shall be no more than wenty-five feet in width and otherwise as stated in Table 2 below.

' The Planning Commission may after public hearing approve an
increase in the height of a freeway service facility sign up to 50 feet if it finds that the increased height is necessary because of severe constraints on view caused by topography, natural vegetation, or existing buildings."
EFFECTIVE DATE: This ordinance shall be effective thirty
lays after its adoption, and the City Clerk shall certify to the
idoption of this ordinance and cause it to be published at least

ZCA-143 - CITY OF CARLSBAD - An amendment to the Zoning
Ordinance to modify regulations regarding signing for freeway service facilities.
I. PROJECT DESCRIPTION AND BACKGROUND --
This amendment to the Zoning Ordinance, to modify the definition
of freeway service facilities and to also alter the present sign
height regulations for these facilities, was approved by the Planning Commission on July 14, 1982. When the item was reviewed by the City Council, a concern arose that the permitted sign area was excessive. Staff had not reviewed the sign area regulations of the ordinance at the time the original staff report was done;
this item addresses these regulations. The ordinance presently does riot set an overall maximum sign area when more than two uses are identified on a freeway sign, but allows each use to have 150
square feet of sign area per use.
11. ANALYSIS -
Staff has addressed this issue and agrees with the City Council's
concern. Therefore, staff proposes the following change to

With this change, staff believes this amendment meets the intent
of both the Planning Commission and City Council; therefore,
staff recommends APPROVAL of ZCA-143.

111. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on July 3, 1982,
which was approved by the Planning Commission on July 14, 1982.
IV. RECOMMENDATION
It is recoinmended that the Planning Commission ADOPT Resolution
No. 2023, recommending -~_I_ APPROVAL of ZCA-143 to the City Council
based on the findings contained therein.
