'7053 conditionally vacating a portion of Oak Avenue ITEM EXPLANATION: The City Council , on October 19, 1983, ?dopeed Eesol tition No. 7037, a resolution of intention for vacating a portion of Oak Avenue between Carlsbad Boulevard and Lincoln Street. The City Council set November 2, 1982, at the hour of 6 p.m. as the time, and the City Council Chambers, 1200 Elm Avenue, as the place for a public hearing. utility companies were notified. Company requested an easement for their existing utilities. Staff recommends that this vacation be conditioned for street improvements adjacent to the area to be vacated, sidewalk tree planting, street lights, and curb and gutter. The cost of the improvements is estimated at $60,000. the City Clerk is instructed not to record this vacation until improvements are completed. The Pacific Telephone and San Diego Gas & Electric Improvements to be completed include As shown in the resolution, A time limitation of one year is also included. FISCAL IMPACT: Approval of this vacation will result in approximately 1,250 square feet of land to be returned to tax rolls. EXH IB ITS : 1. VICINJTY MAP 3 i .; 4 C c r 1 E s 1C 13 li 12 14 15 1E 17 le 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, VACATING A PORTION OF OAK AVENUE BETWEEN CARLSBAD BOULEVARD AND LINCOLN STREET The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That all publication and posting of notices regarding the proposed vacation of a portion of Oak Avenue pursuant to Resolution of Intention No. 7180 have been given as required by law. 2. That the City Council did hear the evidence offered by all persons interested in said proposed vacation and does find from all the evidence sub- nitted that a portion of Oak Avenue between Carlsbad Boulevard and Lincoln Street in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit "A" attached hereto and by this reference incorporated here- in, is unnecessary for present or prospective street purposes and does hereby nake this order vacating said portion of Oak Avenue. 3. That the vacation of said portion of Oak Avenue is conditioned upon the owners constructing street improvements along the frontage of the proposed vacation within a year. Such improvements shall include sidewalk, street lights, half street section, and trees. The City Clerk is instructed not to record this Resolution of Vacation until the terms of Condition 3 have been complied with. A 10.00 foot wide portion of Oak Avenue along the Northwesterly line of Block 18 as shown on the Map of the Town of Carlsbad in the City of Carlsbad, County of San Diego, State of California, according to the Map thereof No. 535 filed in the Office of the County Recorder of said San Diego County on May 2, 1888, and more particularly described as follows: Beginning at the North corner of said Block 18; thence along the Northwesterly boundary of said Block 18, South 55O27' 00" West, 136.75 feet to the Easterly line of Carlsbad Boulevard (Old Highway 101, 100.00 feet wide); thence leaving said Easterly line of Carlsbad Boulevard, Northeasterly 24.86 feet along the arc of a 29.06 foot radius tangent curve with a central angle of 49°00'45" concave Southeasterly to a point of tangency with a line that is 10.00 feet measured at right angles, Northwesterly of said North- westerly boundary of Block 18; thence parallel to said Northwesterly boundary of Block 18, North 55°27'00" East, 114.81 feet to the Northwesterly prolongation of Northeasterly boundary of said Block 18 ; thence along said Northwesterly prolongation South 34'33' 00" East, 10.00 feet to the Point of Beginning.
