CITY ATTY CITY MGR, ~__ ~~ RECOMMENDED ACTION: Title Ordinance No rQyLy and set the matter for public hearing at the next regularly scheduled council meeting which falls more than 15 days from this meeting date. 1 ITEM EXPLANATION: The State of California adopted the 1981 National Electrical Code in October, 1 We are required by state law to enforce the provisions of that code within one of the state’s adoption. We have made three changes from the 1978 code; two are administrative and the third is a minor fee increase: 18.12.245 which requires approval of the administrative authority for the use of non-metallic cable in buildings other than residential. The 1981 code permits non-metallic cable in industrial buildings. The Fire Department and the Building and Planning Department recommend that non-metallic wiring (Romex) be prohibited in industrial buildings because of potential safet hazards. 18.12.250 which prohibits wiring on roof surfaces and requires approval for any wiring on the surface of a building. The city has a policy which prohibits roof mounted equipment. This new code section ensures that the intent of this policy is maintained regarding electri conduit or wiring. FISCAL IMPACT: The National Electrical Code does not publish a fee schedule. The only change from our fee schedule adopting the 1978 code are as follows: Increase issuance fee from $2 to $5 Increase temporary power permit from $5 to $10 Add a $25 fee €or test meter Increase minimum permit fee to $10 These increases are necessary to cover required electrical inspections. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 18;Chapter 18.12 of the Carlsbad Municipal Code is amended by the amendment of section 18.12.010 to read as follows: "18.12.010 Adoption of the National Electrical. Code. The 1981 edition of the Nat-ional Electrical Code, copyrighted b the National Fire Protection Association is hereby adopted by reference as the electrical code'of the city except for the changes, additions and amendments set forth in this chapter which shall supersede the provisicns of said code." SECTION 2: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code is amended by the amendment of sections 18.12.030, 18.12.040, 18.12.050, 18.12.130, 18.12.150', 18.12.18 and 18.12.200 to delete the title of "Director of BuilZing and Housing" and to insert the title of "Director of Building and Planning" wherever appearing in those sections. SECTION 3: That Title 18, Chapter 18..12, section 18.12.100 of the Carlsbad Municipal Code is amended by the amendment of subsection (a) to delete the word "sixty" and to insert the words "one hundred eighty" wherever they appear. SECTION 4: That Title 18, Chapter 18.12, section 18.12.220 of the Carlsbad Municipal Code is 'amended by the amendment of the schedule of fees to read as.follows: /// /// /// II * . t I1 e' 0 _- .. ' "18.12.235 Section 220-3 amended - Branch circuits required. Section 220-3 of the National Electrical Code is amended by the addition of subsection (e) to read as follows: "(e) Each appliance branch circuit shall be limited t two duplex receptacles above .counter area and within six feet c serviceable counter area. Convenience outlets or duplex receptacles shall not be in consecutive order but on alternate circuits." "18.12.240 Section 250-26.(c) amended - Grounding separately derived alternating-current systems. Section 250-21 (c) is amended by the addition of the following after the firs sentence: "The primary grounding method shall be that which is referred to as the 'Uffer Ground' consisting of 20 feet or mor1 of #4 (minimum) or larger copper conductor sized fron NEC Tab11 250-94 Grounding Electrode Conductor for AC Systems. from the bottom and three inch clearance from the sides of the concrete tooting and supported by two 84 or (larger) reinforci bars completely encased in concrete. The copper electrode conductor shall be continuous an! enbroken to its termination at the service connection. For single family residential use only, up to and including 200 amp service, the concrete encased electrode (rebar) may be used. The copper conductor shall be placed three inches up The following minimum requirements shall be followed: 1. The #4 ( 1/!2") or larger rebar to which the ground electrode conductor is connected must be a minimc of 20 feet long, unbroken. 2. The total developed length of rebar placed three inches up from. the bottom of the foundation must no less than 20 feet. Where splices are necessar to obtain the required 20 feet of rebar, they mu: be made so that the two bars overlap by no less t 15 inches and are secured by at least two steel t wires. Section 336-3 is amended to read as follows: cab dwe adm "Uses permitted or Not permitted. Type NM and Type NM les shall be permitted to be used in one- and two-family llings or multifamily dwellings and, with approval of the inistrative authority, other structures not exceeding three floors above grade. For the purpose of this article, the first floor of building shall be that floor which is designed for human habitation and which has 50 percent or more of its perimeter level with or above finished grade." "18.12.250 Article 225 Outside Branch Circuits and Feeders. Section 225-10 is amended - Wiring on Buildings. Section 225-10 of the National Electrical Code is amended by thl addition of the following: "The installation of outside wiring on roof surfaces shall not be allowed. The installation of outside wiring on surface of building shall have approval of the administrative authority." "18.12.255 Article 384-3 (f) Support and Arrangement of Bushars and Conductors. Section 384-3 (f) is hereby amended to read as follows: "(f) Phase Arrangement. The phase arrangement on three-phase busses shall be A, B, C from front to back, top to bottom, or left to right, as viewed from the front of the switchboard or panelboard. The C phase shall be that having the higher voltage to ground on 3-phase, 4-wire delta-connected systems. Other busbar arrangements may be permitted for additions to existing installations."
