RECOMMENDED ACTION:
The Planning Commission is recommending CERTIFICATION of EIR 82-1 and EIR 82-5
by minute motion, and is recommending that Council direct the Attorney's Office
to prepare documents APPROVING GPAs 64(A), 64(C)f 64(D)(in part) and 64(G); and
DENYING GPAs 64(B)f 64(E) and 64(F).
ITEM EXPLANATION

GPA-64 is the third and final amendment to the Land Use Element of the General
Plan for 1982. This hearing involves consideration of 2 EIRs and 7 proposed
land use amendments to the general plan, two of which are appeals of Planning
Commission decisions.
GPA-64(A); A request to redesignate property on the south side of Highway
78 east of El Camino Real from low-medium density (0-4 du/ac) to Travel
Service, Professional and Related Commercial and Open Space. The EIR
identified significant irreversible impacts from the project on the
riparian habitat and on air quality. The Planning Commission approved
changes to the Land Use Element as proposed, but did not, at this time
approve the applicant's proposal to have a crossing over Highway 78 (Rancho
del Oro) and a freeway on-ramp and off-ramp. An application for an
amendment to the circulation element for the proposed Rancho del Oro
overpass has been submitted by the applicant for consideration in the near
future. Also a, Specific Plan was noticed for tonights hearing but was
continued by the Planning Commission. Until a decision is made by the
Planning Commission, the Council cannot consider the specific plan. Staff
is recommending denial of this GPA because of the impact on the riparian
area and traffic and circulation problems.
GPA-64(B); Appeal - A request to redesignate property on the west side of
El Camino Real and south of Palomar Airport Business Park from lovMtiedium
and medium density (4-10 du/ac) to Planned Industrial. The Planning
Commission and staff are recommending denial. The Planning Commission did
feel that more study on this area was necessary before findings for
approval could be made.
GPA-64(C); Request to redesignate property at the southeast corner of El
Camino Real and Laurel Tree Lane from Non-Residential Reserve to Planned
Industrial. No issues were identified and the Planning Commission and
staff recommend approval.
GPA-64(D); Joint request by City and County to redesignate property north-
east of the intersection of El Camino Real and Palomar Airport Road from
Governmental Facilities and Open Space to Planned Industrial. The Planning
Commission and staff recommend approval of Planned Industrial on 26 acres
owned by the city, but it was felt that the alignment of Los Monos Road
must be established before a determination can be made on the County
property. The request for the 150 acres owned by the County was denied
without prejudice.

GPA-64(E); Appeal - A request to redesignate property located on the
north east corner of proposed College Boulevard and El Camino Real from
low-medium density to Community Commercial. The Planning Commission
denied both the negative declaration and the amendment feeling that an EIR
is necessary before access to the property can be determined. This item
was appealed too late to notice for this hearing and has been noticed for
the Council's December 7th meeting.
GPA-64(F); Request to redesignate property south of Palcmar Airport Road
and east of Laurel Tree Lane from low and low-medium density to medium
density and Neighborhood Commercial. An EIR was requested, but processing
was never started by the applicant. Denial is to satisfy city timing
responsibility (one year to approve project) as mandated by state law.
GPA-64(G): Clean-up amendment to make the Land Use Element consistent with
the recently adopted Parks and Recreation Element.
ENVIRONMENTAL REVIEW
EIRs were prepared for items 64(A) and 64(D). A statement of prior compliance
was issued by the Land Use Planning Manager for 64(G). Negative declarations
were approved by the Planning Commission with the exception of GPA-64(E). The
negative declaration was denied and is being appealed to the Council along with
the project.
FISCAL IMPACT
There will be no direct fiscal impacts on the city from GPA-64. Item 64(D) is a
step toward utilization of funds needed for the city operations facility.

9 the provisions of Title 19 of the Carlsbad Municipal Code; and
10 WHEREAS, the Planning Commission has considered the
11 comments and documents of all those persons testifying at the
12 public hearings; and
13 WHEREAS, the Planning Commission has received EIR 82-5
14 according to the requirements of Title 19 of the Carlsbad Municipal
15 Code;
16 NOW,.THEREFORE, BE IT RESOLVED by the Planning Commission
17 of the City of Carlsbad as follows:
18 1. That the foregoing recitations are true and correct.
19 2. That the Environmental Impact Report, EIR 82-5, will be amended
to include the comments and documents of those testifying at
20 the public hearing and responses thereto hereby found to be in
good faith and reason by incorporating a copy of the minutes to
21 said public hearings into the report.
22 3. That the Planning Commission finds and determines that the
Environmental Impact Report, EIR 82-5, has been completed in
23 conformance with the California Environmental Quality Act, the
state guidelines implementing said act, and the provisions of
24 Title 19 of the Carlsbad Municipal Code and that the Planning
Commission has reviewed, considered and evaluated the
25 information contained in the report.
26 4. That the Environmental Impact Report, EIR 82-5, as so amended
and evaluated, is recommended for acceptance and certification
27 as the final Environmental Impact Report and that the final
Environmental Impact Report as recommended is adequate and
28 reasonable and feasible alternatives thereto, including no
project.

5. That each and every significant environmental impact identified
in the Environmental Impact Report would be overruled or
counterbalanced by changes or alteration in the project which
would mitigate against said adverse impacts or, in certain
circumstances, that mitigation of such adverse impacts would

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN AMENDMENT TO THE
LAND USE ELEMENT OF THE GENERAL PLAN FROM RESIDENTIAL
LOW MEDIUM (RLM) DENSITY TO TRAVEL SERVICE (TS),
PROFESSIONAL AND RELATED COMMERCIAL (0) AND OPEN SPACE
(OS) FOR PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE
OF HIGHWAY 78 BETWEEN THE TWO HAYMAR DRIVE CUL-DE-SACS.

WHEREAS, a verified application for an amendment to the
general plan designation for certain property located as shown on
on Exhibit "A", dated October 12, 1982, attached and incorporated
herein, have been 'filed with the Planning Commission; and
WHEREAS, said verified applications constitute a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 27th day of
October, 1982, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, at said public hearing, upon hearing, and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the general plan amendment.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That in view of the findings made and considering the applicable
law, the decision of the Planning Commission is to APPROVE
GPA-64(A), as described on Exhibit "A", dated October 12, 19S2.
Findings

land uses are more appropriate for this location than
3 residential because of the existing and projected noise impacts
to the site from Highway 78 and Marron Road.

The loss of biologic resources associated with the modified
land uses provide a buffer between the highway and the existing
residential uses to the south. The residential to the south
are, in turn, buffered from the professional uses by topography
and the open space of the SDG&E easement. The proposed uses are
also more compatible with the existing surface mine to the east.
preserves the Buena Vista Creek riparian habitat as well as
uses are more compatible with the preservation of the riparian
habitat area than residential uses. Potential human impacts are
minimized due to the lack of daily presence of children and
significant and potentially significant impacts which are either

B. Potential cumulative significant impacts on air quality are
also offset by the benefits of the project as noted above.
In addition, the location of additional employment and
commercial facilities provides a shopping and employment
convenience for existing and future residents of the region,
The grouping of facilities may also serve to reduce travel
distances and reliance on the automobile in the future,
thereby helping to reduce long term impacts.

impacts. Implementation of the additional mitigation
7 measures contained in the EIR will further reduce potential
impacts to an insignificant level.

E. Hydrology and Water Quality - Elimination of the majority of
9 the proposed development adjacent to Highway 78 and in the
steep slope areas in the southeast corner further reduces
10 the potential for on site sedimentation. Preservation of
the majority of the floodplain area and implementation of
11 f mitigation measures contained in the EIR reduces potential
impacts to an insignificant level.

F. Biological Resources - Project modifications to preserve a
13 total of 29 acres of the riparian habitat and 18 acres of
supporting natural habitat, especially along the northern
14 perimeter of the riparian area, reduces the ..impacts as
identified in the EIR. The total loss of three acres of
15 the riparian habitat and additional supporting habitat,
however, is still deemed to be an unmitigated significant
16 adverse impact.
17 G. Archaeological Resources - Preservation of the area
adjacent to Highway 78 and in the southeastern corner will
18 preserve three of the identified sites, thereby reducing
the impacts identified in the EIR. Implementation of the
19 additional measures noted in the EIR reduces the overall
impact to one of insignificance.

H. Visual Aesthetics - Eliminating the majority of the
21 development adjacent to Highway 78 will eliminate any
potential "freeway strip effect". The addition of the Q
22 overlay zone and implementation of the other measures
contained in the EIR reduces potential impacts to an
23 insignificant level.
24 I. Traffic Circulation - Potential traffic impacts at Marron
Road and El Camino Real can be reduced to an insignificant
25 level by the construction of turning lanes and medians as
recommended in the EIR and in comments from the City Traffic
26 Engineer.

1) The proposed 0, RP, and CT zones are in conformance with the
open space, professional office and travel service commercial
land use designations of the general plan for this property.
2) The Q overlay zone will provide an opportunity for the City to
review all future site development plans for the property,
thereby ensuring compliance with zoning regulations and design
standards. Review of future building plans will ensure
development of a quality project which is harmonious with
surrounding development and the overall architectural character
of the city.
3) An Environmental Impact Report was prepared which identified
impacts of the proposed project. These impacts can either be
mitigated or- overriding considerations exist as described
below.
A. The loss of biologic resources associated with the modified
project, while significant, are offset by the social and
economic benefits of the proposed land uses and circulation
system. The proposed land uses are more conducive to pre-
servation of the habitat areas being retained and eliminate
the potential undesirable living environment caused by
traffic noise on Highway 78 and Marron Road. The proposed
uses are also less subject to impacts from the existing
surface mine located east of the property. Development of
office and commercial uses will provide jobs and additional
sales tax and property tax to the City.
B. Potential cumulative significant impacts on air quality are
also offset by the benefits of the project as noted above.

WHEREAS, a verified application for an amendment to the
General Plan designation for certain property located, as shown
on Exhibit "A", dated October 12, 1982, attached and incorporated
herein, have been filed with the Planning Commission; and
WHEREAS, said verified applications constitute a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 27th day of

Findings:
1 ) The property is physically suitable for industrial development
because the site is relatively level and is surrounded on three
sides by property designated for industrial development.
2) The uses allowed in the proposed planned industrial land use
designation will be compatible with the surrounding land uses.
3) The project is consistent with all City public facility
policies and ordinances since:
a) Sewer service is not required for these projects and subse-
quent development of the property will require the
availability of sewer service to serve such developments or
construction cannot occur.
b) The applicant has agreed and is required by the inclusion
of an appropriate condition to pay a public facilities fee.
Performance of that contract and payment of the fee will
enable this body to find that public facilities will be
available concurrent with need as required by the the
general plan.
4) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Land
Use Planning Manager on October 7, 1982, and approved by the
Planning Commission on November 3, 1982.

good faith and reason by incorporating a copy of the minutes of

Environmental Impact Report EIR 82-1 has been completed in
24 conformance with the California Environmental Quality Act, the
I state guidelines implementing said Act, and the provisions of
25 Title 19 of the Carlsbad Municipal Code and that the Planning
Commission has reviewed, considered and evaluated the informa-
26 tion contained in the report.
27 4. That the Environmental Impact Report EIR 82-1 as so amended and

E) Archaeological Resources
Impact: Project implementation will disrupt four
archaeological sites at their present locations on
site.
Mitigation: A qualified archaeologist will
determine the significance of the archaeological
deposits identified on the property through a test
program designed to investigate the site's extent,
depth and contents. Recommended testing will be
required in the specific plan or by a qualified
archaeologist.
F) Biological Resources
Impact; Development on the mesa will eliminate the rare
and endangered species of orcutt's brodiaea.
Mitigation: The needs of the citizens of Carlsbad
for centrally located public facilities including
police and fire protection override this impact.
Bulbs will be replanted if feasible.
G) Circulation
Impact: The project will generate 9,300 trips per day
on nearby roadways.
Mitigation: The project has been significantly
reduced to mitigate this impact.
H) Air Resources
Impact: Grading and construction activities represent a
source of fugitive dust which, along with construction
exhaust emissions, could have a short term impact on
local air quality.
Impact: Industrial uses could potentially subject the
area to the accidental release of toxic or noxious
emissions.
Mitigation: Grading has been significantly reduced
to mitigate this impact. City ordinances prohibit
nuisance-type industrial uses.
I) Acoustic Environment
Impact: Construction activities will increase noise
levels on a short term basis.
Mitigation: The specific plan will require that
construction be limited to daytime hours only.

PROPOSED TEXT - LAND USE ELEMENT CLASSIFICATIONS
8. Community Parks
Community parks are leisure facilities of 20 to 50 acres
specifically designed to serve the broader recreational
needs of several neighborhoods. They are best located near
major arterials and when possible, near junior and senior
high schools. Additionally, they are intended to provide
diversified activity, both active and passive to meet the
needs of the populations surrounding them. The land use map
indicates specific locations for Stagecoach Park and Alga
Norte Community Park. The other community park locations
indicated on the map are approximate and are intended as a
planning tool. Based on projections of population and
community needs,, a community park site should be located in
the general vicinity shown. These park sites are
anticipated to be dedicated and developed in conjunction
with surrounding development.
9. Special-Resource Areas
Special-Resource Areas are local amenities under the
jurisdiction of the City of Carlsbad that have either city-
wide or potential regional significance. Although they are
usually greater than 100 acres in size, it is not size alone
that makes them significant. Significance is found within
each site's unique potential to attract users from a greater
distance than a local facility. Consequently, the
facilities offered at a special-resource area have a
specialized use attractive to users locally and beyond.
Designated special-resource areas, within the Carlsbad
sphere of influence include:
Buena Vista Lagoon
Agua Hedionda Lagoon
Batiquitos Lagoon
State Beaches
Macario Canyon Park
Lake Calavera
Rancho Carrillo
10. Special-Use Facility
A special use facility is a local recreational facility of
only one or two activity-type uses (tennis courts, pool,
etc) and are generally 1-5 acres in size. Special use
facilities may be developed and maintained by either
private, public or joint-effort funding. These facilities
may also be developed on school district property as a joint
effort with the school districts.

SUBJECT: EIR 82-5, GPA-64(A), ZC-264, SP-185 - SOUTHERS - A
request to certify EIR 82-5; amend the land use element
from residential low medium (RL!*]) density to travel
service (TS), professional and related commercial (O),
and open space (OS); change the zoning to correspond
with the requested general plan amendment, and approval
of a specific plan.
I.PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting an amendment to the land use element,
a zone change and approval of a specific plan for 96.8 acres
located on the south side of Highway 78 approximately .5 miles
east of El Camino Real {see attached location map). The proposed
amendment is from residential low medium density (RLM 0-4 du/ac)
to travel service (TS), professional and related commercial (O),
and open space.(OS). The proposed zone change is from R-l-10,000
to commercial tourist (CT), residential-professional (R-P) and
open space (OS). The applicant is also proposing a specific plan
to implement the general plan and zoning on the site. The pro-
posed project would involve the construction of an overpass
(Rancho del Oro) from Oceanside over Highway 78 into Carlsbad.
An Environmental Impact Report (EIR 82-5) was prepared for this
project and must be certified prior to any action on the project.
II. EIR 82-5
Major Impacts:
1. Biological Resources
Implementation of the proposed land use changes would cause
significant adverse impacts to the riparian biological habitat on
site. This riparian woodland, growing within the floodplain of
Buena Vista Creek, represents one of the better stands of this
rare and declining habitat in coastal San Diego County. The
habitat supports a high diversity of wildlife species and is
rated as a very good potential habitat for a number of declining
bird species. Development of the site under the proposed GPA
would cause the approximate 32 acres of riparian habitat on site
to be reduced to 29 acres. In addition, a large portion of the
peripheral, supportive habitat, which includes freshwater
marshland, floodplain and upland vegetation, would be eliminated
from the site. The total effect of development under the
proposed GPA would be a major reduction in species' diversity and
carrying capacity of the remaining riparian habitat to such an
extent that its viability as a biological resource would be
reduced.
2 . Hydrology and Water Quality
Development of the site under the proposed GPA land use
designations entails a potentially significant increase in
sediment yield from the site during the earthwork and construc-
tion phase of development including the construction of Rancho
del Oro. These potential erosion and sedimentation impacts could
be mitigated by the implementation of a comprehensive erosion
control program in conformance with the City of Carlsbad's
grading ordinance. Increases in runoff and pollutants from
urbanized surfaces on the project site following development may
be anticipated but are considered a very small incremental
contribution to the total runoff and contaminant load from the
entire watershed area, and are not considered significant.
3. Traffic Circulation
The significant traffic circulation impact associated with the
proposed land use change, assuming completion of an interchange
at Rancho del Oro Road and SR 78, would occur at the El Camino
Real/Marron Road intersection, since Marron Road is not planned
to be extended east of the project site to College .Boulevard as
part of this project.
The City of Carlsbad would need to implement mitigation measures
to reduce the impacts on the Marron Road/El Camino Real inter-
section if the site is developed at the proposed GPA land use
designations until the completion of the street network in the
area. The options for mitigation include extension of Marron
Road to connect with College Boulevard, thereby improving the
level of service to acceptable levels for the existing inter-
section configuration.
The level of service at the El Camino Real/Marron Road inter-
section could also be improved by providing dual left-turn lanes
on Marron Road, and could be further improved by providing a
right-turn lane and one left-turn lane on Marron Road. These
improvements could be squeezed into the existing right-of-way or
more comfortably accommodated with a minor street widening.
Buildout of the project site under the proposed land use designa-
tions with a single access from Marron Road would be contrary to
City of Carlsbad policy, which indicates a maximum acceptable
cul-de-sac length of 600 feet. This would be an impact until
Marron Road is constructed to College Boulevard when properties
to the east of the site are developed or the Rancho del Oro Drive
interchange is completed.
4. Air Quality
Any major change in land use will cause a discrepancy in the
RAQS (Regional Air Quality Strategy) forecasts. Mitigation

measures include carpool programs and employer encouragement of
transit use.
Staff also feels that a significant impact exists from the cuma-
lative impacts created by the project. A cumulative impact is a
variety of problems or impacts which are of less significance on
their ov/n but together create a significant impact on the
environment. This impact would include affects on the lagoon,
damage to the habitat area during construction of the Rancho del
Oro bridge, visual impacts and alteration of landf orrns.
EIR 82-5 was prepared in accordance with California Environmental
Quality Act and has adequately identified and discussed the
environmental impacts. For these reasons, staff is recommending
CERTIFICATION of EIR 82-5.
III. GPA-64(A)
A. ANALYSIS

The existing general plan shows all of the 95.8 acres as 0 to 4
dwelling units per acre. The applicant's proposal would create
the following land use acreages:

The proposed property .is heavily constrained by the riparian
habitat which bisects the property on the north side and by the
steep topography on the south side. Land use and development of
the property should reflect the sensitive nature of the site.
The proposal by the developer preserves a major portion of the
riparian habitat. Grading for office use is proposed for the
hills on the south side of the property. The EIR indicates that
implementation of the proposed land use changes would cause
significant adverse impacts to the riparian biological habitat on
site. The riparian woodland represents one of the better stands
— 3—
of this rare and declining habitat in coastal San Diego County.
The proposed project would be eliminating approximately three
acres of riparian habitat and some of the supportive marshland
located adjacent to it. Destruction of streamside habitat is
contrary to the goals and policies of the City's Open Space and
Conservation Element of the General Plan.

Development of the site as proposed entails a potentially
significant increase in sediment yield during earthwork of the
site. Sedimentation from grading, particularly in the office/
professional area could be detrimental to Buena Vista Lagoon.
Erosion control measures along with reduced grading could
mitigate this impact.
Traffic from the proposed project would be four times greater
than the RLM (0-4 du/ac) designation existing on the site.
Assuming completion of the Rancho del Oro overpass, as the
project could not exist without it, a significant impact would be
created at the intersection of Marron Road and El Camino Real.
The EIR indicates that this impact can be mitigated to a level D
(acceptable, but not good) by requiring the developer to improve
Marron Road to College Boulevard. Mitigation to level C
(acceptable) can also occur by providing dual left-turn lanes
onto Marron Road, and by providing a right-turn lane and a
left-turn lane on Marron Road at El Camino Real. This mitigation
would require a street widening.
The City Engineer (see memo attached, dated October 20, 1982)
disagrees with the traffic assessment provided by the EIR. It
is the position of the City staff that traffic problems
originating in Oceanside will be brought into Carlsbad by Rancho
del Oro and by higher generation rates produced by a more
intense land use. Impacts will be especially severe at the
intersection of Marron Road and El Camino Real (Plaza Camino
Real).
Construction of Rancho del Oro creates many problems for the
proposed project. The State Department of Fish and Game has
indicated that if Rancho del Oro has to be constructed it should
be farther east. The proposed bridge location is over a wide
section of the riparian habitat and could have less impact on a
narrower portion a short distance upstream.
In the Cal-Trans comments on the EIR, similar problems were
identified. Cal-Trans indicated that there are no plans for an
overpass in this area and no funds are available. It was also
stated that the proposed Rancho del Oro overpass is located too
close to the historic adobe house located off Hayman Drive and
should be relocated.
It should be recognized that the developer has made great effort
to try and satisfy staff's concerns and the impacts identified
in the EIR. The applicant has reduced the amount of proposed

land vise and drafted a proposed specific plan which is not a
developement requirement of the site. Unfortunately, the site
is so constrained that staff does not feel that the project as
proposed solves the problems associated with the site.
In summary, staff's major objections to the project are the
construction of Rancho del Oro as proposed, which creates traffic
and biological impacts, and the amount of development proposed
which creates a loss of habitat, increased traffic and visual
impacts. Staff feels that alternative 2 (residential medium-high
density and open space with a riparian buffer) as identified in
the EIR would be more appropriate for the site. That would
cluster residential units on the south side of the property and
eliminate the need for the Rancho del Oro overpass.
IV. ZC-264 - Analysis and Discussion
The zoning proposed is consistent with the land uses proposed
for the general plan. Staff's concerns for the zoning are the
same as for the proposed general plan amendment. For this
reason, staff is recommending DENIAL of ZC-264.
V. SP-815 - Analysis and Discussion
Approval of the specific plan hinges on approval of the general
plan amendment and zone change. Since staff is recommending
DENIAL of the general plan amendment and zone change, staff also
recommends DENIAL OF SP-185. If the general plan amendment and
.zone change is approved, both staff and the applicant feel that
more work is needed on this document. In the instance that these
items are approved, staff would recommend that the specific plan
be sent back to staff for further review. Early concerns involve
the following areas:
- consistency with City specific plan format
- development standards
- pad location in office areas
- amount of development proposed
- adequacy of area management program
- bridge funding sources
- phasing and improvements
RECOMMENDATION
Staff is recommending that the Planning Commission ADOPT
Resolution Ho. 2042 recommending to City Council CE RTIFICATION of
EIR 82-5, and ADOPT Resolutions 2038, 2043 and 2044, DENYING
GPA-64(A), ZC-264 and SP-185.

Some additional comments on the proposed project:
1. Whether or not the Rancho del Oro intersection at Highway 78 and the
extension to Marron Road comes into being is a policy decision.
Although it is being promoted as a way to relieve traffic congestion
at Marron Road and El Camino Real, it will not operate in a vacuum.
I believe that traffic from Oceanside and increased traffic that is
inevitable from the Southers site will more than offset any relief
so that the intersection will not benefit El Camino Real.
2. Some discussions have taken place regarding the level of service at
Marron Road and El Camino Real. It should be pointed out that the
calculations used to assign a level such as "C" or "D" are only one
• of a number of factors to be considered. The large number of existing
driveways on Marron Road just east of El Camino Real are not considered
in such an evaluation but are sure to have a serious adverse effect on
the performance of the street.
3. Any change to the general plan that permits higher traffic generation
from the site is bound to reduce the service levels on the streets,
especially at the intersections.
4. The newest plan submitted results in only a small reduction in traffic
and would not result in any change in recommendations. It is, however,
an improvement.
5. Parcel E at the intersection of two freeway ramps and Rancho del Oro
"is unacceptable because it has only 260 feet of frontage and .any
access would conflict with turning movements at the ramps. It also
violates our intersection spacing of 600 feet minimum on a secondary
arterial.
6. Once our computer model has been completed (probably March 1983) a run
can be made with Rancho del Oro inserted and land uses changed and the
impacts on traffic volumes more objectively shown.

I. PROJECT DESCRIPTION AND BACKGROUND
The subject property is approximately 26 acres in size and is
located on both sides of El Camino Real immediately south of
Palomar Airport Business Park (see attached location map). The
western majority of the property (21 acres) in currently
designated for Medium Density Residential uses (4-10 du/ac). The
eastern portion (5 acres) has .a Low-Medium Residential Density
designation (0-4 du/ac). The applicant is requesting that the
entire property be changed to Planned Industrial.
The largest portion of the property, west of El Camino Real is
relatively flat, draining to the north-west. The 200-foot wide
SDG&E Power easement just touches the southwest corner as it runs
toward the La Costa area. The eastern lot is topographically
extreme, sloping steeply away from El Camino Real. A greenhouse
business presently exists on both sides of El Camino Real on
property immediately to the south. Residential land use
designations surround the property on all sides except Palomar
Airport Business Park (Planned-Industrial) which borders the
western property to the north. The subject proerty is outside,
but adjacent to, the airport influence area.
II. ANALYSIS
Planning Issues
1) Is there sufficient land use justification to change
the general plan to provide for industrial uses on this
site?
2) Would the proposed redesignation be compatible with
future land uses in the area?
III. Discussion
The text of the land use element of the General Plan provides
that the City shoud "Preserve and enhance the character of the
City as a desirable residential community", and that industrial
uses should be provided to allow for two things. One, for a
"reasonable tax base", and two, for "opportunities for
employment of local citizens." The intent appears to be a
caution as to over-providing for industrial areas which will
affect the over-all "balanced residential" nature of the
community.
Ifi addition, a major goal of the housing element of the general
plan is:
"To assure that the amount and type of housing development
or redevelopment is compatible and convenient with the
locations of major facilities and services and in
particular with major transportation and transit routes, as
well as major employment centers."
The location of the subject property is such that staff
considers it a valuable housing support of the vast industrial
area to the north. As such, the proposed redesignation would
decrease the multiple-family supply of housing convenient to a
major employment center.
The City Engineering Department has indicated that to minimize
access points onto a prime arterial, any access onto El Camino
Real from the subject property would be required to consolidate
access with other properties in the area. The Palomar Airport
Business Park has a self-contained circulation network serving
only the lots within the industrial area. No provision was made
to include the subject property into this system. If the site
is redesignated to Planned Industrial, the only access
alternative would involve a traffic mix of industrial and
residential traffic. The impact of adding industrial traffic to
a residential collector or neighborhood street, would be
considerable. At the present time, the circulation element
indicates the residential area around the subject property to
contain only collector and neighborhood streets.
The General Plan allows that either property lines, streets, or
topography should be used to designate land use boundaries.
Neither the northern nor the southern property line of the
parcel is superior to the other in providing such a boundary.
The absence of topographic features and the fact that the street
system of the existing business park is self-contained,
excluding this parcel, do not justify a boundary change. Staff
believes that the existing northerly boundary formed by the
Palomar Airport Business Park is a good boundary between
industrial and residential and that industrial use should not be
extended to the south along El Camino Real.
Staff feels that to maintain the balance between residential,
industrial and commercial uses, the subject property is more
desirable to the City in a residential use, and feels that it
would be inappropriate to grant this request at this time.

IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,•
therefore, issued a Negative Declaration on September 21, 1982.
V. RECOMMENDATION • .
Staff is recommending the the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2027 DENYING GPA-64(B).

I- PROJECT DESCRIPTION
The applicant is requesting an amendment of the Land Use Element
of the General Plan from non-residential reserve (NRR) to planned
industrial (PI) for property located on the south side of Palomar
Airport Road, west of Laurel Tree Lane. The land involved in
this amendment has an area of approximately 29 acres. This site
is relatively level and covered with weeds and shrubs, but has
been used for agricultural purposes in the past.
II. ANALYSIS
1. Is the proposed land use of planned industrial an appropriate
use for the site?
2. Would the proposed general plan amendment adversely effect
the surrounding properties?
Discussion
Staff feels that planned industrial is an appropriate use for
this site. The general plan designation of non-residential
reserve (NRR) is essentially a holding category to be utilized
until an appropriate non-residential use is found for the
property. A planned industrial (PI) designation would include
primarily light industrial uses developed via a business park
scheme. The general plan states that the burden of proof to
reclassify areas in non-residential reserve lies with the
developer. The developer feels that PI is the best use for the
site because it is within the Palomar Airport Influence area and
adjacent to Palomar Airport Road. In addition, the properties to
the north, east and west of this site have been designated for
industrial use.
Since the property will be surrounded on three sides by indus-
trial uses, the proposed PI designation v/ould be consistent with
existing and future uses in the area and would be less impacted
by the airport than other non-residential uses. The bluff along
the southerly edge of this site should adequately separate
industrial uses on this site from any future residential uses
that may occur to the south. A specific plan, which is required
for the development of all properties of greater than 25 acres
within the Palomar Airport Influence area, will properly adapt
this use to the topography and configuration of the site and set
standards for the development. For these reasons, staff feels
that the requested designation is proper for the site-
III. ENVIRONMENTAL. REVIEW

and, therefore, has issued a Negative Declaration on October 7,

IV. RECOMMENDATION

Request to amend the Land Use Element of the General
Plan from open space and governmental facilities to
planned industrial.
I. PROJECT DESCRIPTION AND BACKGROUND
The subject property is an irregularly shaped 176-acre parcel
located generally east of El Camino Real and north of Palomar
Airport Road (see attached map). The site includes the recently
purchased City Operations Center property (26 acres) directly
north of the Palomar Transfer Station. The remaining 150 acres
includes the slopes, valleys and related riparian areas of much
of the Auga Hedionda Creek watershed. The City property is
presently designated for governmental facilities in the general
plan. The remaining area is designated open space. The entire
site is within the airport influence area. No structures
presently exist on site.
The presently undeveloped Carlsbad Oaks Industrial Park lies to
the east of the property. The airport crash-hazard "clear" zone
lies to the south. Beckman Industries and Costa Real Water
District buildings are to the west, with the undeveloped Tootsie
K residential area to the north.
Topographically, the site is dominated by the City Operations
Center plateau which is (as is the entire site) covered by
natural vegetation. The remainder of the site is characterized
by eroded hillsides containing valleys and canyons of varying
degrees and steepness. On-site elevations range from 100 to 400
feet above sea level.
Access to the city owned property is presently acquired through
the Palomar Transfer Station property. A dirt road following the
Buena Sanitation Sewer easement generally follows the southerly
property line. Most of the site is inaccessible except on foot.
II. EIR 82-1 - MAJOR IMPACTS
•*- * Landform and Topography
Impacts: Industrial use will involve considerable grading in
some areas to create building pads. Mitigation will depend on
the type and location of uses proposed.
2. Hydrology
Impacts: The existing natural streambed will be potentially
impacted by the grading necessary to create building pads for
development. Earth moving activities present the potential for
accelerated soil erosion, sedimentation and water quality impacts
to water bodies during the construction period. Mitigation could
include the use of sedimentation basins, retention of riparian
area, and will also depend on the size of the proposal.
3. Archaeological Resources
Impacts: Development of the property could significantly impact
the five archaeological sites that are located within the project
boundaries. Mitigation includes either preservation or further
investigation by a qualified archaeologist.
4. Biological Resources
Impacts: Development on the mesa will probably eliminate
existing sensitive vegetation, including the rare and endangered
orcutt's brodiaea. Vegetation present in the steeper areas east
of the mesa will probably also require removal to accommodate
development. Development above or along the drainages could
degrade existing riparian habitat by siltation. Impacts to
biology cannot be mitigated to an insignificant level without
greatly reducing the project area.
Staff feels that EIR 82-1 was prepared in accordance with the
California Environmental Quality Act and has adequately
identified and discussed the environmental impacts. For these
reasons, staff is recommending CERTIFICATION of EIR 82-1.
111• GPA-64(D) - ANALYSIS
Planning Issues
1) What affect would the proposed uses have on the environment?
2) Is the site suitable to accommodate planned industrial uses?
Discussion
Based upon numerous staff field surveys of the site, accompanied
by the data provided by the Environmental Impact Report, it is
apparent that the plateau area (City Operations Center property)
is the only readily buildable portion of the property. Consider-
able grading will be required to create industrial building pads
in all other areas of the property. The environmental consultant
for the project indicated that it is possible to accommodate two
large building pad areas exclusive of the city property. One
possible pad lies near the southern property line (39 acres),
and the other is in the northeast central portion of the site

(43 acres). It was also noted that in some areas, earthwork
including 75-foot cuts and 100-foot fills would be required. The
EIR indicates that the use of these pads could create severe
environmental impacts relative to sedimentation and degradation
of the riparian habitat/ particularly on the northern area of the
site near the sensitive Dawson-Los Monos Canyon.
The Circulation Element of the General Plan aligns Los Monos
Road through the subject property in an easterly to
northwesterly direction, connecting Melrose Avenue to College
Boulevard. The recent redes ignat ion of the Carlsbad Oaks
property from residential to industrial uses, however, will
result in the transport of industrial traffic through the
Toots ie K and other residential areas. Recent studies and
impact reports have indicated that this may not be the best
al ignment .
The City staff and surrounding property owners are presently
discussing alternative alignments of Los Monos to remedy this
situation. There appears little doubt that Los Monos Road will
cross the subject property at some point. The buildability of
any area other than the city property however, depends very
highly on the alignment of this secondary arterial.
Staff feels that the City Operations property is appropriate for
development at this time. Whether it is accessed through an
alternative alignment of Los Monos Road or through the present
easement, the site is relatively unconstrained. Those con-
straints that do exist can be addressed through the required
specific plan, which will be required because the property is
located within the airport influcence area.
Because there is still major discussion regarding the alignment
of Los Monos and because the various proposed alignments could

I. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting that the Land Use Element of the
General Plan be amended to redesignate two contiguous parcels of
property (17.5 acres and 2 acres) located at the northeast corner
of El Camino Real and future College Boulevard. The site is
presently designated low-medium density (RLM) residential (0-4
du's/acre). The request is for a community-commercial (C)
designation.
Presently, much of the property is in agriculture (that area
immediately south of present Sunny Creek Road). The remainder is
vacant. 'Surrounding land uses include low-medium density
residential uses to the north, east and west, and a combination
community-commercial/office/high density residential designation
to the south (vacant). Topographically, the site is not extreme.
It slopes mildly down from the south to a fairly wide valley
bottom (agriculture area) at the northern end of the site. Over
50% of the site is flat. Future College Boulevard will follow
the southern property line.
II. ANALYSIS
Planning Issues
1. Is the proposed general plan designation of community-commer-
cial the most appropriate for the site?
2. Will the proposed change in land use have a detrimental
effect on the traffic flow for El Camino Real and College
Boulevard?
III. DISCUSSION
From purely a land use perspective, staff feels that the proposed
designation of community-commercial is appropriate for the site.
El Camino Real is designated a prime arterial in the circulation
element of the general plan. As such, daily traffic volumes are
expected to be very high. Extensive residential designations
shown on the Land Use Element of the General Plan on both sides
of this highway has alerted staff to the fact that additional
conveniently located commercial uses may be necessary to accom-
modate the vast residential areas in this vicinity. While
discouraging strip commercial development, the general plan
indicates that sites
located at arterial intersections (such as at El Camino Real and
College Boulevard) are generally good locations to accommodate
neighborhood and community-commercial uses. This site also meets
the other general plan criteria necessary for community-commer-
cial use which includes adequate parcel size and a large enough
market area.
The subject site is relatively flat and of sufficient size to
accommodate commercial uses. Across future College Boulevard
from this site (southeast corner), the property is designated to
allow some comm-mity-commercial development (amount controlled by
specific plan). With the large and numerous residential
developments approved and projected (Calavera Hills, Carlsbad
Highlands, etc.) northerly along College Boulevard, staff feels
that the need exists for commercial development somewhere in this
area.
The site, however, is not a desirable commercial location with
regard to potential traffic impacts. The property is of
insufficient length (along future College Avenue) to meet the
City's intersection spacing policies. The City Engineer feels
that a high traffic generator (such as community-commercial)
would greatly impact the efficiency of the signalized
intersection at El Camino Real and College Boulevard. A
memorandum, dated October 6, 1982, from the City Engineer details
staff's opinion on this matter. This memo is attached to the end
of this staff report.
Should the applicant develop a design satisfying the staff that
these traffic problems can be mitigated, staff would recommend
approval of the project. Until an adequate circulation plan for
this whole area is established, approval is premature. Staff has
also began looking for more suitable sites for commercial devel-
opment in this area.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, issued a Negative Declaration on July 29, 1982.
V. RECOMMENDATION
Staff is recommending that the Planning Commission APPROVE the
Negative Declaration issued bv the Land Use Planning Manager and
ADOPT Resolution No. 2026 DENYING GPA-64(E).

The proposed GPA from RL-M to General Commercial causes the Engineering Depart-
ment concern for two reasons:
1. Interruption of the flow of traffic:
El Camino Real is a prime arterial and as such is designed to move large volumes
of traffic through the City at high speeds. Estimates of the ultimate traffic
volume on this street are at least 38,000 vehicles per day. Both Circulation
Element of the General Plan and Engineering Design Standards require street
intersections on El Camino Real to be no closer than one-half mile and prohibit
access to the street from driveways.
College Boulevard is a major arterial with an estimated ultimate traffic volume
of at least 24,000 vehicles per day. Intersection spacing should be no less
than 1200 feet and driveway access is prohibited. Intersection spacing closer
than 1200 feet may be considered if a "T" intersection is used. The property
on the east side of College Boulevard is already zoned for some commercial and,
due to geographical constraints may be required to have a street intersection
closer than 1200 feet from El Camino Real. If this turns out to be necessary,
it would be desirable to have the first intersection to the west about 1800 feet
or more from El Camino Real and have both of these intersections be "T's." A
signalized four-way intersection less than 1200 feet from El Camino Real will
reduce capacity and speed on the street, create operational problems and poten-
tially increase accidents.
Changing this property from residential to commercial will put enormous pressure
on the City to grant accesses onto the two arterials in violation of our standards,
Driveways on arterials and intersection spacing less than our standard reduce
the capacity of the street.
2. Increase in traffic volume:
Assuming this 18-acre parcel was fully developed to the maximum density permitted
by the RL-M designation, 760 trips would be generated by this site. If the site
were all office, approximately 5700 trips would be generated and if it were all
commercial, up to 15,000 trips might be generated depending on the exact type of
use. Therefore, the potential exists to increase traffic by as much as 20 times
if the general plan is changed.

/iThe potential increase is significant because with traffic projections from the
existing general plan, we are already estimating a failing level of service at
El Camino Real and Palomar Airport Road. The intersection of College Boulevard
and El Camino Real is recommended for special design (extra lanes) in the
Circulation Element Study just completed due to the high volumes of left turns
anticipated. The increase in traffic at the corner site coupled with reduced
intersection spacing would have an adverse impact on the level of service of
this intersection.
Conclusion:
The Engineering Department recommends that the proposed general plan amendment
be denied.

I.PROJECT DESCRIPTION AND BACKGROUND
On October 30, 1981, the applicant requested that the Land Use
Element of the General Plan be amended to redesignate property,
located on the south side of Palomar Airport Road just east of
Laurel Tree Lane, from residential low and low-medium densities
(RL, 0-1.5 du/ac and RLM, O-4 du/ac) to residential medium
density (RM, 4-10 du/ac) and neighborhood commercial (N).
The Land Use Planning Office determined that an Environmental
Impact Report would be necessary to analyze the potential impacts
relating to the proposed project. Staff solicited proposals,
with the applicant's authorization, for preparation of an EIR.
The City Council approved selection of the environmental
consultant, although expressing serious reservations regarding
increasing residential density on the project site.
Based on the concerns expressed by the Council and recipients of
the Notice of Preparation of an EIR, the applicant verbally
indicated to staff that they no longer wish to pursue the project
as originally proposed. Contracts for the preparation of the EIR
were never executed. The consultant did not begin work.
Staff has requested, but not received, a formal request for
withdrawal of the project from the applicant. As this project
has now been pending since October 30, 1981, staff believes that
the request should be denied without prejudice so that time
limits established by state law are not exceeded which would
automatically approve the project.
II. ENVIRONMENTAL REVIEW
It was determined that an Environmental Impact Report was
required for this project pursuant to the Carlsbad Environ-
mental Protection Ordinance, This report has.not been prepared.
III. RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution
No. 2040, recommending DENIAL of GPA-61(F) without prejudice,
based on the findings contained therein.

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Carlsbad
will hold a public hearing at the City Council Chambers, 1200 EM Avenue,
Carlsbad f California, at 7:00 p.rcu on Wednesday; October 27, 1982, to
consider approval of a general plan amendment to change the land use
designation from open space and governmental to planned industrial on
property generally located immediately east of the Palomar Transfer Station
on El Camino Real and more particularly described as:
A portion of Lots "A" and "B" of Rancho Agua Hedionda
according to Map No. 823 filed in San Diego County
November 16, 1896.
