ITEM EXPLANATION
Recently the City Council created a design review board for the village redevelopment area. State law requires that all agencies of the city adopt a local conflict of interest code. In order to comply with state law the City Council, which is the code reviewing body for all city agencies, must establish a deadline for submission to it of a conflict of interest code for the Design Review Board. The Design Review Board will be required to hold a public hearing on . the conflict of interest code and submit it to the City Council by the deadline contained in the resolution. The resolution requires the Design Review Board to consider the existing local conflict of interest code which applies to all city agencies, other than the Planning Commission and City Council, as its conflict of interest code. Because the members of the Design Review Board are also members of other agencies of the city which are required to file
disclosure statements under existing conflict of interest codes, the members will be able to meet their disclosure requirements as Design Review Board members by filing consolidated disclosure
statements. For example, the Planning Commissioners who are
required to file a disclosure statement under their conflict of interest code with the Fair Political Practices Commission would be able to meet their requirements for filing disclosure statements as members of the Design Review Board by filing a consolidated statement with the City Clerk as well as with the Fair Political
Practices Commission. Members of the Housing and Redevelopment Advisory Committee who are also members of the Design Review Board would be able to file one consolidated statement with the City
Clerk to meet their obligations under both codes.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA ESTABLISHING THE DATE FOR
SUBMISSION OF A CONFLICT OF INTEREST CODE FOR
THE DESIGN REVIEW BOARD, DIRECTING THE DRAFTING
AND SUBMISSION FOR APPROVAL OF SAID CODE AND
APPROVING THE PROCEDURE FOR THE HEARING AND
CONSIDERATION OF SAID CODE.
WHEREAS, the City Council of the City of Carlsbad,
California according to the provisions of the Political Reform
Act of 1974 is the code reviewing body for city agencies; and
WHEREAS, by the adoption of Ordinance No. 1254 the City
Council has created the Design Review Board; and
WHEREAS, the City Council on March 3, 1981 approved an
amended local conflict of interest code applicable to all other
city agencies except the Planning Commission and the City
Council; and
VXlEREAS, according to the provisions of the Political
Reform Act of 1974 the Design Review Board must prepare a local
conflict of interest code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
1. The City Council as the code reviewing body of the
City of Carlsbad hereby establishes January 18, 1983 as the
deadline for submission to it of a conflict of interest code for
the Design Review Board.
2. The City Council hereby approves the rules of for
procedures of approval and adoption of a conflict of interest
code as adopted by Resolution No. 5789 of the City Council of
the City of Carlsbad on June 5, 1979 as the rules of procedure

for adoption of the conflict of interest code by the Design
Review Board with the following exception:
