RECOMMENDED ACTION:
It is recommended that the City Council uphold the decision of the Planning Commission in requiring certain street improvements in conjunction with the development of a motel at the Pea Soup Andersen's project.
ITEM EXPLANATION
This item is an appeal &the Planning Commission's decision to require street improvements in conjunction with the Pea Soup Andersen's development at the northwest corner of Palomar Airport Road and Paseo del Norte. A condition of the site development plan (SDP 80-11(A)) for this project required that the applicant install street improvements along Paseo del Norte from Palomar Airport Road to Car Country. The Planning Commission previously modified the condition to require street improvements to the main entrance to the restaurant with the remaining improvements to be installed in conjunction with the motel. Construction of the first phase of the motel (72 units) is nearing completion and
the applicant is requesting to defer installing any additional
improvements. The Planning Commission considered the applicant's request at it's meeting of November 24, 1982 and as a compromise,
the Commission approved the City Engineer's recommendation to only require full street improvements up to the entrance of the motel. The City Engineer's recommendation is explained in detail
in his memo attached to this agenda bill.
The applicant disagrees with the compromise approved by the
Planning Commission and is appealing the Commission's decision to the City Council.
ALTERNATIVE ACTIONS
Should the City Council wish to approve the applicant's appeal, an alternative which has been discussed with the applicant is to barricade off the entrances to the motel from Paseo del Norte and require traffic entering the motel to go through the main entrance to the restaurant (Avenue of the Flags). Although somewhat circuitous, there is an on-site driveway that connects the restaurant and the motel parking lots. This would reduce the traffic concern on Paseo del Norte in front of the motel. The barricade could be removed when the street improvements are installed. An improvement agreement would be needed from the applicant to insure that the improvements are installed by a certain time (i.e., 12 or 18 months) or prior to occupancy of the second phase of the motel.

The applicant has also discussed with staff the possibility of
temporary improvements up to the motel entrance but nothing specific has been submitted for staff review. The applicant has
indicated that he may present a more specific proposal for temporary improvements at the Council meeting.
FISCAL IMPACT
There will be no fiscal impacts to the city resulting from this
item.

The traffic study prepared by Weston Pringle and Associates was only received today and there has not been sufficient time to review it. Initial comments are:
1. It does not address the left turn movement problem above.
2. The traffic analysis ignored future traffic generation from the east side of Paseo del Norte.
