RECOMMENDED ACTION:
Approve Resolution No. z0V% transferring $25,700 from the contingency
account to the Macario Canyon Project account in the general fund to pay
taxes due on this property for 1981 and the first half of 1982.
ITEM EXPLANATION:
The County Assessor annually assesses taxes on all property within
San Diego County including government owned property that is outside the
boundaries of that local government. In this case, the city ownes the
Macario Canyon property which is within the county island areas inside
Carlsbad. Based on the county's interpretation of Article XIII, Section 11
of the State Constitution, the City of Carlsbad is required to pay
property tax on the Macario property inspite of the fact that this
property is held for general government purposes.
The amount requested above will cover all property taxes owing through
December 10, 1982. Since this property is scheduled for annexation
in the very near future, our obligation for future tax payments should
end soon.
FISCAL IMPACT:
This transfer will reduce the contingency account balance by $25,700 from
$1,033,722 to $1,008,022. Unless annexation is, accomplished soon, the city
will be assessed taxes of about $16,000 per year on these parcels until
annexation does occur. Jf these taxes are not paid by November 30, 1982
the city will owe and additional $250. t

1 RESOLUTION NO. 7086
2 A RESOLUTION OF THE CITY COUNCIL OF THP. CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE TRANSFER OF FUNDS TO COVER
PROPERTY TAXES DUE ON 14ACARIO CANYON.
5 WHEREAS, the City acquired title to various parcels in the unincorporated
6 Macario Canyon area on September 29, 1982; and
.7 WHEREAS, the County Tax Collector has notified the City of its
8 obligation to pay property taxes for 1981-82 of $17,469.97, and 1982-83
9 $8,145.45; and
10 WHEREAS, 1981-82 taxes must be paid to the County by November 30, 1982
11 to avoid further penalties of 1�% per month; and
12 WHEREAS, 1982-83 taxes (first installment) are due and payable to
13 the County on December 10, 1982,
14 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
3.5 Carlsbad does hereby approve the transfer c•f $25,700 from the contingency
16 account to the general fund Macario Canyon account to finance these tax
17 payments.
18 PASSED, APPROVED ;AND ADOPTED at a regular meeting of said City Council
