RECOMMENDED ACTION:
Staff recommends the introduction and adoption of Ordinance No. J2L 1 amending various titles in the Carlsbad Municipal Code, by the amendment of several sections, to correct assorted position and departmental designations.
ITEM EXPLANATION:
Various position and department designations have been changed in the past
di thout necessary changes being made throughout the Carlsbad Municipal Code. attached ordinance accomplishes these changes without any substantive changes to regulations.
The
FISCAL IMPACT:
The only fiscal costs were 48 hours of staff time to research the Carlsbad Yunicipal Code and to prepare the ordinance plus costs for codification.

ORDINANCE NO. 1261
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING VARIOUS TITLES IN THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SEVERAL SECTIONS TO CORRECT
ASSORTED POSITION AND DEPARTMENTAL DESIGNATIONS.
The City Council of the City of Carlsbad, California does ordain as
follows:
SECTION 1: That title 2, Chapter 2.08, Section 2.08.050, of the
Carlsbad Municipal Code is amended to read as follows:
"2.08.050 Location of city offices -- Office hours. The office for the conduct of business of the city clerk, city treasurer, building and planning director and city engineer shall be located in such place as the city council by resolution may establish.
Such resolution shall be passed at least two weeks in advance of any
change and to be published once in a legal newspaper of general
circulation of the city. Such office shall be kept open for the transaction of official business between the hours of eight a.m. and five p.m., Saturdays, Sundays and legal holidays excluded."
SECTION 2: That Title 2, Chapter 2.24, Section 2.24.030 of the
Carlsbad Municipal Code is amended to read as follows:.
"2.24.030 Absence from meetings. If a member of t!ie planning
commission is absent from three successive meetings of the commission without cause, the land use planning manager shall inform the mayor
of such absence, who may therewith remve the member from the
commi ss ion without further notice . 'I
SECTION 3: That Title 2, Chapter 2.44, Section 2.44.030 of the Carlsbad Municipal' Code is amended to read as follows:

"2.44.030 City service. The provisions of this chapter shall apply
to all offices, positions and employees in the service of the city, except:
(1) Elective officers;
(2) Members of appointive boards, commissions and committees; (3) Persons engaged under contract to supply expert, professional or technical services for a definite period
of time;
(4) Volunteer personnel who receive no regular compensation from the city; (5) City manager;
(6) Assistant city manager; (7) Adminsstrative assistants;
(8) (9) City attorney; All department heads hired on or after November 7, 1975;
(10) Assistant city attorney;

(11) Emergency employees who are hired to meet the iminediate requirements of any emergency condition, such as extra- ordinary fire, flood or earthquake which threatens life or pro per ty ;
Employees, other than those listed elsewhere in this section, who are employed less than half time, which is. defined as employees who are expected to or do work less than one thousand forty hours in any one fiscal year."

Carlsbad Municipal Code is amended to read as follows: SECTION 4: That Title 2, Chapter 2.48, Section 2.40.030(7) of the
"2.48.030 Definitions .
(7) 'Employee, management' means any employee having signifi- cant responsibility for formulating and administering city policies and programs, including but not limited to the following positions:
Administrative aide; Administrative assistant I; Administrative assistant 11; Assistant city attorney; Assistant city manager; Assistant finance director; Assistant 1 ibrary director; Building and planning director; Central services director; City attorney; City engineer; City manager; Community redevelopment manager; Executive assistant; Fire battal ion chief;
Land use planning manager; Library director; Maintenance director; Parks and recreation director; Parks superintendent;. Personnel director;

SECTION 5: That Title 5, Chapter 5.04 of the Carlsbad City rlunicipal
Code is amended by the amendment of Sections 5.04.120 and 5.04.142 to delete the designations of "building inspector" and "publ ic wcrks director", respectively, and insert the position designations of "building and-planning d i rector I' and "ma i n ten a nc e d i rector I' , res pec t i v e 1 y .

SECTION 9: That Title 6, Chapter 6.12 of 'the Carlsbad Flunicipal Code is amended by the amendment of Sections 6.12.070, 6.12.080, 6.12.100, and
6.12.110 to delete the designation of "building inspector", and insert the position designation of "building and planning director" wherever appearing in the sections.

SECTION 27: That Title 18, 'Chapter 18.32 of the Carlsbad Municipal Code is amended by the amendment of Section 18.32.010 to delete the designation of "city building department" and insert the position designation of "building and planning director."
SECTION 28: That Title 18, Chapter 18.36 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.36.010, 18.36.050 and 18.36.060(d) to delete the designation of "director of building and housing", and insert the posstion designation of "building and planning director" wherever appear- ing in the sections.
SECTION 29: That Title 18, Chapter 18.40 of the Carlsbad Municipal Code is amended by the amendment of Section 18.40.110 to delete the designation of "director of building and housing", and -insert the position designation of "building and planning director."
SECTION 30: That Title 19, Chapter 19.04 of the Carlsbad Municipal Code is amended by the amendment of Sections 19.04.QGO(d), 19.04.115 and 19.04.200 to delete the designations of "planning director", "manager" and "planning department", respectively, and insert the designations of "land use planning manager" and "land use planning office", 'rkspectively, wherever appearing in the sections.

SECTION 52: That Title 21, Chapter 21.55 of the Carlsbad Municipaj Code is amended by the amendment of Section 21.55.070(b) to delete the designation of "building director", and insert the position designation of "building and planning director".
SECTION 53: That Title 21 Chapter 21 -60 of the Carlsbad Municipal Code is amended by the amendment of Sections 21.60.010 and 21.60.030 to
delete the designation of "bul'lding department", and insert the position designation of "building and planning director" wherever appearing in the sections.
SECTION 54: That Title 21, Chapter 21.70 of the Carlsbad fkmicipal
Code is amended by the amendment of Sections 21.70.010, 21.70.030, 21.70.050, 21.70.060 and 21.70.140 to delete the designation of "planning director", and insert ,the position designation of "land use planning manager" wherever appearing in the sections,
EFFECTIVE DATE: This ordinance shall be effective thirty days after
its adoption, and the city clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in the Carlsbad
Journal within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
Council held on the 21st day of December , 1982, and thereafter,
PASSED AND ADOPTED at a regular meeting of said city council held
on the 4th day of JZIIXB~ , 1983., by the following vote, to wit:
