Adopt Resolution No. ITEM EXPLANATION: Carlsbad Tract 80-9(A) - known as The Wadows - is a 301-unit subdivision located west of klrose Avenue and north of Corintia Street. cant is requesting that the tentative map be extended for a one-year period ending January 15, 1984. The appli- The tentative map was originally approved on JGly 15, 1980, per Resolutions Nos. 6233, 6234, and 6235 and subsequently revised on October 20, 1981. A one-year extension of time was granted on January 5, 1982, per Resolution No. 6752. The applicant agreed to pay public facilities fees with the original application. Planning and Engineering staffs have reviewed this project and recommend one additional condition be required. a requirement for the developer to execute the revised Public Facilities Fee Agreement as per the latest City Council Policy No. 17. has signed an agreement to waive a prohibition of new conditions. The Tentative Map is due to expire. 1Je hereby request an extension o.f 'time on these maps. I feel that it would be in our best interest to have a meeting with your planning and cnginccrinq staff prior to formal submittal o€ thc rcvisions so that any issues might be clarified at that time. RESOLIJTION NO. 7119 A RESOLITI'ION OF THE CITY COUNCIL OF FE CITY OF CAlUSBAD, CALIFORNIA, APPROVING AN EXTENSION OF TIME FOR TENTATIVE bW Cl' 80-9(A) , INCLUDING PUD-ZO(A) AND CP-60, SWCT TO CERTAIN CONDITIONS WHEREAS, Section 66473.5 of the Subdivision Map Act provides hat a tentative subdivision map may not be approved unless it is consistent with all applicable general and specific plans; and WHEREAS, the City Council of the City of Carlsbad on the 15th day of July, L980, adopted Resolutions No. 6233, 6234, and 6235 approving, with conditions, kntative Map CI' 80-9, Condominium Permit CP-60 and Planned Unit Development 'UD-20; and WHEREAS, the City Council of the City of Carlsbad on the 3rd day of qovember, 1981, adopted Resolution No. 6720 amending Tentative Map CT 80-9(A) md Planned Unit Development PUD-ZO(A), Council has found that public facilities are inadequate; and WHEREAS, said Tentative Subdivision Map will expire on January 15, 1983, ' md the applicant has requested an extension of time which cannot be approved mless the subdivision can be brought into conformity with the general plan; md WHEREAS, the addition of certainconditionsof approval to the subdivision #ill allow it to be found to be in conformity with the general plan and the leveloper has requested the imposition of such conditions and agreed to comply lJith them; and WHEREAS, The approval of an extension of Tentative Map CT 80-9(A) subject to such conditions, in lieu of denial of the map, will allow the project to go Eorward avoiding the unnecessary delay to the City and to the Developer involved iJith denial and the new application which would then be approved subject to the 4 .. 1 2 z 4 E c 7 E S IC 11 12 12 ' 14 15 16 17 la 19 20 21 22 23 24 25 26 27 28 same set of conditions; and WHEREAS, both the Developer and the City wish to extend the map subject to the additional condition; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: A. That the above recitiations are true and correct; B. That Tentative Map CT 80-9(A), PUD-20, and CP-60 are hereby extended €or one year from January 15, 1983 to January 15, 1984, subject to the execution md fulfillment of all the conditions of Resolutions No. 6233, 6234, 6235, 6720 md 6752, and the following additional condition: (1) This approval is expressly conditioned on the payment by the applicant of a public facilities fee as required by City Council Policy No. 17, dated February 24, 1982, and effective April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee. If said fee is not paid as promised, this application will not be consistent with the General Plan and the project cannot proceed and this approval shall be void. C. That the agreement for waiver of prohibition against the imposition of :onditions upon the approval of an extension of a tentative subdivision map dated JanUary 6, 1983 between The Wcdward Ccmpam 'es and the :ity of Carlsbad, marked Exhibit A and attached hereto, is approved and the Mayor is authorized to execute such agreement on behalf of the City. D. That this extension is approved in reliance upon said agreement. Any Legal challenge to or failure to perform said agreement or the conditions of this -esolution shall render this approval void and the map shall not be final.
