Council approve Resolution No. 71/4 sweeping agreement. to amend contract ITEM EXPLANATION: Jim Reid, District Manager of North County Contract Sweeping is requesting an amendment to the previously Council approved street sweeping contract. The amendment clarifies the curb mile cost of sweeping for streets that are added to the City street system. Examples are streets in new s~bdivisions, alleys or parking lots. Additional special work is also clarified by this amendment. Staff concurs with this request. FISCAL IMPACT: None until streets are added to City street system. EXHIBITS: 1. RESOLUTION NO. 7116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE AMENDMENT OF THE CONTRACT FOR STREET SWEEPING TO CHULA VISTA SANITARY SERVICE, INC. AS APPROVED BY RESOLUTION NO. 7084 WHEREAS, at its meeting of December 14, 1982, the City . Gouncil of the City of Carlsbad adopted Resolution No. 7084 approving an agreement for street sweeping services; and WHEREAS, said agreement must be amended to establish the cost for sweeping streets constructed after the date of the Agreement NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. The above recitations are true and correct. 2. That paragraph 2 of the Contract Agreement for street sweeping. which was approved by Resolution No. 7084 shall be amended to read as follows: "2. COMPENSATION For all of the services which Contractor is obligated to perform under the terms of the Agreement, the C~ty shall pay to Contractor the sum of $9967.00 payable monthly on the basis of one-twelfth of the annual lump sum. Streets constructed after the effective date of this Agreement will be added at the rate of $11.50 per curb mile (as measured in each direction of sweeping along the curb, berm, or shoulder)·. Additional special work of an extraordinary nature including but not limited to disaster, spillage and parades will be charged at a minimum of four (4) hours at the rate of $45.10 per hour when requested by the Assistant City Manager/Maintenance and Operations." 3. That the Mayor is authorized to execute said Agreement as amended. However, in reading the Agreement I discovered that paragraph 2, COMPENSATION, does not address the subject of additional scheduled street sweeping. This matter is mentioned in para·· graph 9, ADDITIONAL WORK, which states: "In the event the City desires to extend the sweeping program to include streets constructed after the effective date of this Agreement, other streets or alleys, or parking lots, any additional sweeping which is required of Contractor shall be paid for at the curb mile rate, specified in Paragraph 2." It is requested that an arnrnendment be madQ to the Agreement which clearly spells out the cost of additional scheduled work at the rate of $11.50 per curb mile in paragraph 2. This is standard procedure in both the public and private sectors regarding the curb mile costs for additional scheduled work. For your information the formula factors are already contained in our Proposal Form as follows: Your annual estimated curb miles: Residential: 360 curb miles every other week: 360 X 26 El Camino Real: 10 curb miles every other week: 10 X 26 Downtown: 5 curb miles 3 times weekly: 15 X 52 Total Annual Miles Miles 9360 260 780 10400 I ,I l I r Mr. Bill Baldwin Page 2 December 27, 1982 Annual cost o~ $119,600; 10400 Annual Curb miles= $11,50 per curb mile Additionally, paragraph 2 does not include the standard (4) hour minimum for special work of an extraordinary nature, including but not limited tt disaster, construction spillage (which should be reimbursed to the City) and parades which may require sweeping services. Paragraph 2 should be ammended to read: 2. COMPENSATION For all of the services which Contractor is obligated to perform under the terms of the Agreement, the City shall pay to Contractor the sum of $9967.00 payable monthly on the basis of one-twelfth of the annual lump sum. Streets constructed after the effective date of this Agreement will be added at the rate of $11.50 per curb mile (as measured in each direction of sweeping along the curb, berm, or shoulder).
