RESOLUTION OF PROPERTY TAX EXCHANGE
FOR THE VISTA DEANNEXATION.

RECOMMENDED ACTION:
1) Approve City Council Resolution No. 7/30 and direct the City Clerk to send a certified copy of same to the Local Agency Formation Commission, the County Auditor and Controller/Property Tax Services and the County Department of Planning and Land Use;
2) Rescind Resolution No. 6828
ITEM EXPLANATION
The City Council adopted Resolution No. 6828 on April 4, 1982
approving a property tax exchange agreement for property that has
been deannexed from Carlsbad to Vista (see Exhibit 'B'). Since
that time, the city has filed the necessary documents to the county indicating the City Council's approval of the tax
exchange. Some confusion was created because the exhibit for the
Tax Exchange Agreement was mislabeled in Resolution No. 6828. The county has requested that the city adopt a new resolution
which clears up the ambiguities created by the mislabeled exh i bi t .

Carlsbad to determine an cquit.able exchange of property tax revenue
applicable to such jurisdictional change and the Vista City Council
has adopted a resolution approving the negotiated tax exchange; and
WHEREAS, this resolution replaces Resolution No. 6828
adopted by the City CounciX on April 6, 1982, and its approval
hereby rescinds Resolution No. 6828; and
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the juris-
dict.io;ial change shall result in the property tax exchanges shown o
the attached Exhibit "Ar'.
IT IS FURTHER RESOLVED AND ORDERED that the City Clerk of
the city of Carlshad shall, on behalf of the city notify the County
Auditor and the Local Agency Formation Cornmi.ssion of such negotiate
exchange of property tax revenues by forwarding to them a copy of

ITEM EXPLANATIPN
Revenue and Taxation Code Section 99 requires that prior to the
effective date of certain jurisdictional changes, the governing
bodies of the affected jurisdictions shall establish, by resolution, the amoilnt of property tax to be exchanged.
The Planning Department has negotiated with the city of Vista on behalf of the city of Carlsbad the transfer of all city received property taxes to the city of Vista for those properties to be
annexed to Vista as shown on Exhibit "BR. The attached resolution and Exhibit "A" represent the transfer of property taxes from Carlsbad to Vista. .The entire city portion of the taxes would be transfered over to Vista since Carlsbad would no longer provide public services to the properties.
ENVLRObiMENTAL REVIEW
This action is exempt from environmental review.
FISCAL IMPACTS
The loss of revenue generated by property taxes from these properties would be offset by the cost savings when Carlsbad ceases to provide public services to these properties.

F~EREAS, Revenue and Taxation Code Section 99 requires the
