RECOMMENDED ACTION:
The Planning Staff recommends that this application be APPROVED
and that the City Council ADOPT Resolution No. 113 \
ITEM EXPLANATION
This item is a request by Seabluff Associates for City Council
approval of an annexation of 170 acres of land, generally located
west of Batiquitos Lagoon, between Interstate 5 and the AT&SF
Railroad tracks. The property was prezoned on August 3, 1982, to
RD-M and 0-S. On January 10, 1983, the Local Agency Formation
Commission adopted a Resolution of Annexation for this property.
A copy of this resolution is attached for your review. The last
remaining discretionary action to complete the annexation is the
adoption of a Resolution of Annexation by the City Council.
Approval of this annexation would be consistent with the City
Council's annexation policy.
ENVIRONMENTAL REVIEW
The City Council certified the Environmental Impact Report for
this property on July 6, 1982. A copy of the environmental
documents is on file in the City Clerk's Office.
FISCAL IMPACT
The annexation of this property will generate additional revenue
from property taxes which should offset the cost of providing
public services to the site.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE ANNEXATION OF
CERTAIN UNINHABITED TERRITORY HEREINAFTER
DESCRIBED AND DESIGNATED AS THE SEABIUFF REORGANIZATION
TO INCLUDE THE DETACHMENT OF SAID PROPERTY FROM THE
LEUCADIA COUNTY WATER DISTRICT.

WHEREAS, an application for approval of a proposal for the6

to the City of Carlsbad, County of San Diego, State of
_- California, was filed with the Local Agency Formation Commission
... Reference No. DA 81-6; and
WHEREAS, a resolution of the said Local Agency Formation
, _ Commission, after a hearing held in the manner required by law,
- . was duly passed and adopted on the 10th day of January, 1983,
, ,. approving the application for annexation of the territory
.,- hereinafter described by metes and bounds; and
.,„ WHEREAS, said resolution provided that said reorganization

the City Council of the City of Carlsbad was authorized to annex
said territory without notice and hearing by said Council and
without an election as provided in California Government Code
22 Section 35151; and
WHEREAS, a written petition containing the required
signatures and a description of the uninhabited territory
hereinafter described has been presented to the Local Agency
p. Formation Commission requesting reorganization under the
p~ Municipal Organization Act of 1977; and the District
Reorganization Act of 1965; and

WHEREAS, said petition has been signed or consent thereto
has been filed by the owners of all of the land in the territory
to be annexed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said petition contains a description of certain
uninhabited territory sought to be included and annexed to the
City of Carlsbad and detached from the Leucadia County Water
District and that said petition is signed by the owners of not
less than 25% of the land in the territory by area and by
assessed value as shown on the latest equalized assessment roll
of the County of San Diego, in which county the City of Carlsbad
is situated.
3. That the City Council hereby declares that said petition
has been signed or consent to the proposed reorganization filed by
the owners of all of the land in the territory proposed to be
annexed and, therefore, no protests may be filed against the
petition by persons owning property in the territory.
4. That the territory proposed to be annexed to the City is
uninhabited territory as defined by Section 35038 of the
Government Code and is contiguous to the boundaries of the City.
5. That the aforementioned uninhabited territory included
in the proposed reorganization is hereby designated and shall
hereafter be known as the Seabluff Reorganization.
6. That upon completion of said reorganzation all of the
property included therein shall be taxed accordingly with the
other property within the City of Carlsbad to pay the bonded
indebtedness and any and all general indebtedness of the City of

Legal Description
All that portion of the South Quarter of the Southwest
Quarter ox Section 28, and that
portion of the North half of the Northwest Quarter and of Lots 1,4,
5,6,13,14, and 15 of Section 33, Township 12 South, Range 4 West,
San Bernardino Base and Meridian, in the County of San Diego, State
of California, according to United States Government Survey,
approved Kay 3, 1883, lying within the following described boundaries:
Beginning at the intersection of the Northerly line of the South Quarter
of the Southwest Quarter of said Section 28 with the Easterly line of that certain
parcel of land conveyed to the Atchinson, Topeka and Santa Fe
Railway Company, by Deed recorded March 30, 1946 in Book 2059, Page
466 of Official Records, of said county, being an angle point in the
boundary of the City of Carlsbad as established by their Ordinance
No. 1122, adopted July 21, 1970, by said City;
1. thence South 89°57'53" East, 2384.70 feet along said Northerly
line and said city boundary to an angle point therein; being

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
APPROVING A PROPOSED REORGANIZATION INVOLVING
ANNEXATION TO THE CITY OF CARLSBAD AND
DETACHMENT FROM THE LEUCADIA COUNTY WATER DISTRICT
"SEABLUFF REORGANIZATION"
(CITY OF CARLSBAD)
On motion of Commissioner Hedqecock , seconded by Commissioner
Lake , the following resolution is adopted:
WHEREAS, pursuant to the District Reorganization Act of 1965,
commencing with Section 56000 of the Government Code, a petition
was submitted to this Commission proposing a reorganization consisting
of the following changes of organization:
1. Annexation of the territory, as described in the application
on file with the Local Agency Formation Commission, to the
City of Carlsbad.
2. Detachment of the territory as described an the application
on file with the Local Agency Formation Commission, from the
Leucadia County Water District.
WHEREAS, the petition of landowners was certified sufficient by
the Executive Officer on January 5, 1983 ; and
WHEREAS, the Executive Officer of this Commission has filed his
report on said proposed reorganization, which report has been considered
by this Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES AND
ORDERS, as provided in Government Code Section 56250 et seq. as follows:
1. The description of the boundaries of the Territory as described
in the petition is not definite and certain , but will be made so by
modification to conform to Exhibit "A" attached hereto.
2. The description of the boundaries of the Territory does conform
to lines of assessment and ownership.

3. All owners of land have consented in writing to the
proposed reorganization.
4. The Territory includes 170 acres and is uninhabited.
5. The Commission certifies that it has reviewed and considered
the information contained in the EIR prepared by the City of Carlsbad.
The Commission adopts the Environmental Findings required by Section
15088 of the State CEQA Guidelines for each significant impact
identified by the EIR, as stated on Exhibit "C" attached hereto.
The Commission finds, pursuant to Section 15119(b) of
the State CEQA Guidelines, that an additional 4.47 acre parcel is
not subject to the environmental impact evaluation process because
the proposal area is undeveloped, but is of minimum size for the
construction/installation of new small facilities or structures as
defined by Section 15103.
The Commission further finds, pursuant to Section 15060
of the State CEQA Guidelines, that an additional 16.53 acre parcel
consisting of State freeway right-of-way is not subject to the
environmental impact evaluation process because there is no
possibility for the proposed project to significantly impact the
environment, and the activity is not covered by the requirements
set forth in CEQA or the State CEQA Guidelines.
6. The Commission hereby approves a proposed reorganization
consisting of annexation of the territory described in Exhibit "A"
attached hereto to the City of Carlsbad, and detachment of the
territory described in Exhibit "A" attached hereto from the Leucadia
County Water District, subject to the conditions as stated on
Exhibit "B" attached hereto.
7. Pursuant to Government Code Section 56271.1 the City of
Carlsbad is hereby authorized to initiate reorganization proceedings
in compliance with Government'Code Section 56430 et seq. and this
resolution, without notice and hearing and without an election.
8. The Executive Officer of this Commission is directed to
mail and file certified copies of this resolution in accordance
with Government Code Section 56272.

FOR SIGNIFICANT EFFECTS OF
PROPOSED "SEABLUFF REORGANIZATION"

SUMMARY
Impacts a
Agriculture; The proposed annexation would indirectly lead to the
ultimate conversion of agricultural land. It is therefore considered
to have a potentially significant impact to agricultural resources.
Traffic Circulation: The Seabluff project would generate 4480 daily
trips upon ultimate buildout. Assuming the proposed road improvements
in the adopted Circulation Plan are completed, Seabluff-generated
traffic when added to other approved or proposed project traffic
would result in significant impacts to the Carlsbad circulation system.
However, Seabluff would only contribute an estimated 10 to 11 percent
of the ADT at post project and circulation system buildout. Seabluff-
generated traffic is therefore not a significant impact by itself,
but the cumulative effects of other development with significantly
higher traffic generation would bring ADTs .to above acceptable levels.
Archaeology; A field survey of the property located six previously
recorded archaeological sites. Since the project proposes no
development plans, the proposed annexation and prezone will not cause
any direct impacts to these sites.
Community Services; The proposed project would not have a significant
impact on any community services within the project area. However,
it is anticipated that a combined effect on population from the
ultimate development of this site and other developments in the
vicinity over the next several years will require increases in levels
of community services.
Geology and Seismicity: The proposed annexation of the project site
by the City of Carlsbad would not entail any geotechnical impacts.
Hydrology: No direct impacts will be caused by the proposed
annexation and prezone. Potential sedimentation impacts as a result
of this proposed project could result at the time of ultimate
development.
Water Quality; No direct impacts to water quality are anticipated
from the annexation and prezone alone. However, future impacts at
the time of development may be anticipated but are considered a very
small incremental contribution to the total contaminant load.
Biological Resources: Since the project proposes no specific
development plans, the proposed annexation and prezone by themselves
will not cause any direct adverse biological effects. A potential
effect of ultimate site development could be the alteration of bluff

habitat important to the Cactus Wren (Campylorhynchus brunneicapillum)
and the Black-Tailed Gnatcatcher (Polioptila melanura californica),
two declining bird species.
Noise: There would be no noise-related impacts associated with
annexation of the project site by the City of Carlsbad. Ultimate
development of the site to residential land would also not entail
significant impacts, with the exception of a narrow strip of land
along the top of the roadway embankment at the site's eastern
boundary, where there is a direct line of sight to 1-5.
Mitigation Measures
Agriculture: Impacts can be mitigated to a level of insignificance
through restrictions placed on future development of the project
site which would allow for agricultural preservation on a portion
of the property. Such a mixed-use program of development would be
consistent with the policies of the San Dieguito LCP and the conceptual
agricultural policy of the City of Carlsbad. Specific conditions for
preserving the agricultural land should be established when future
development is proposed and should be a permit requirement.
Traffic Circulation; Assuming Seabluff development precedes other
planned development, the proposed road improvements as described in
the adopted Circulation Plan if constructed would enable the Carlsbad
circulation system to adequately handle the increase in Seabluff-
generated traffic.
Archaeology: To appropriately manage the cultural resources upon
the subject property for future development, a program of preservation/
impact mitigation is recommended. A preservation program of any or all
of the cultural resource areas could eliminate potential development
impacts.
Community Services: Impacts related to future cumulative development
increases on fire and police protection can be mitigated by the City
of Carlsbad by 1) increasing fire department staffing by two
officers; or 2) increasing police department staffing by three
officers.
Geology/Seismicity: In the event that the site is developed for
urban land use, a detailed subsurface soil and engineering geology
investigation should be conducted to provide grading, foundation, and
construction recommendations prior to final design.
Hydrology: The implementation of an effective erosion control program
would minimize potential hydrological impacts (see below).
Water Quality: Potential sedimentation impacts could be mitigated
by the implementation of a comprehensive erosion control program in
conformance with the City of Carlsbad's grading ordinance. The

ordinance requirements should be strictly enforced by periodic
site inspections. In addition, grading activities should be permitted
only during the summer dry season to reduce the potential for erosion
and sedimentation of the lagoon, and the graded site should be hydro-
seeded to reduce the erosion potential during the phased construction.
Biological Resources: The proposed project would subsequently zone
the bluffs and lagoon habitats of the site as O-S (Open Space), thus
removing this land from potential development. It is recommended
that any future development be set back from the bluff edge to create
a buffer zone between human activity and natural habitat zones.
Noise: Specific impacts and required mitigation such as setback - "
distances or noise attenuation barrier design should be determined
at the time individual portions of the site are prepared for development,
FINDINGS
Pursuant to Section 15088(a) of the State EIR Guidelines, find that
the mitigation measures listed above for the identified impacts have
been or can and should be adopted by the City of Carlsbad, and that
the mitigation is within the jurisdiction of the City of Carlsbad and
not LAFCO because the affected resources and services will be within
the City limits upon annexation.
