Introduce Ordinance No. g{!,_3,__ establishing the authority for the
Chief of Police to levy cost recovery fees for certain police
services which are currently provided at no cost, and adopt
Resolution No. 713~ setting those fees.
ITEM EXPLANATION
Carlsbad Police Department is unique in the county in that it has
never charged the public for copies of accident reports or
fingerprinting services. These services require a substantial
amount of time and the cost to the City is significant.
Additionally the City of Carlsbad has never had a formal policy
regarding the provision of police personnel to public and private
entitites who request police personnel for special events.
The recommended action will establish a fee schedule for reports,
fingerprinting, photographs and clearance letters. It will enable
the Chief of Police to require that individuals requiring or
requesting special police services pay for these services at a
fixed rate. The Council may waive all or part of any fees on their
own motion or by appeal of the applicant.
The objective of the proposal is recovery of non-mandated costs of
services provided by the police department and it will not result
in any "profit" to the City at the expense of the user(s). The
Chier of Police will retain the authority to assign personnel to
any event at taxpayer expense if he deems it necessary to affect
the department's enforcement or public safety goals.
The fire departme,1t presently recovers the cost of providing
standby fire protection to special events pursuant to provisions in
the City's Fire Code. This proposal would enable the police
department to do the same.
FISCAL IMPACT:
Although the police department does not tabulate exact records of
the number of reports, etc., that have been provided in the past, it
is conservatively estimated that 3,000 reports and fingerprinting
services are requested and provided annually. Maintaining this
level of service would recover o~ generate approximately $10,000,
Revenue recovered providing personnel to special events is
predicated on the number of requests and mandated requirements by
the Chief of Police. Any estimate of revenue would be purely

speculative. The pa~t two years experience indicates the City might
recover anywhere from $5,000 to $10,000 over a period of one year.
The fees levied do not exceed the cost of providing the service and
therefore will not affect the City's appropriation limit under
Article XIIIB of the State Constitution (Gann Initiative;.

INTRO DU CTI ON
This report will deal with user fees in two categories:
1. fees for reports, photographs, and like
services ( document fees).
2. fees based on providing police personnel
for special events.
DOCUMENT FEES
A survey of all San Diego County police agencies as well as the Los
Angeles Police Department reveals that all agencies charge a fee
for providing crime reports, accident reports, photographs, and
fingerprinting services. Carlsbad charge~ the vendors cost for
photographs; while reports, fingerprinting and clearance letters
(required for foreign travel by many countries), are provided free.
Government Code 6257 and Vehicle Code 20012 provide that any fee
charged in proviciing copies of reports 11 shall not exceed the cost of
providing such copy 11
• Compy_ting the cost of each report is precluded
by 'i:he many varia~les involved. The differing number of pages, amount
of time required to write various kinds of reports, and the clerical
functions involved in different t:-pes of reports assure that virtually
every report will have a different cost factor. Additionally there is
no history of the number or types of Y"eports and fingerprinting services
we have provided to base a cost analysis on. Using only the clerical
cost (employee time and materials) as a basis for calculating the cost
of providing the average document, the fees charged in the survey are
easily justified.
SPECIAL EVENTS
For purposes of this report a special event is defined as:
l. Any commercial event within the framework of MC 5.08,060
requiring a permit from the City Council. This includes
but is not limited to, circus', shows, and athletic
events (e.g. boat races and motorcycle races). The
broad language of the section would seem to include any
event conducted for a business purpose.

2. Any request for police personnel outside the normal
patrol .or investigations function that requires the
assignment of personnel at additional cost to the
department (taxpayer). Shopping center security and
High school·football games are examples.
The concept of charging for uniformed patrol services is relatively new
and many of the agencies contacted are attempting to establish policies.
Currently, most of the agencies operate with written and unwritten
policies that vary widely in their interpretation and application. An
example is police coverage of high school football games which varies
from:
--no service
--reserve officers only, provided free or ~aid by the
school
--private security only
--police personne1 paid by the school
--police personnel paid by the city.

CARLSBAD, CALIFORNIA ESTABLISHING CHARGES FOR
COPIES OF POLICE REPORTS, FINGERPRINTING SERVlCES
O'l'HER DOCUHEN'rS, AND POLICE PERSONNEL FOR SPECIAL
EVENTS.
WHERRAS, the City Council of the City of Carlsbad,
California desires to implement a schedule of user fees to
offset costs of certain services provided by the police
department; and
WHEREAS, such fees are authorized by C~apter 3.36 of
the Carlsbad Municipal Code

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 3 OF THE CARLSBAD
MUNICIPAL CODE BY THE ADDITION OF CHAPTER 3.36 TO
PROVIDE FOR THE LEVY OF FEES FOR SPECIAL POLICE
SERVICES.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 3 of the Carlsbad Municipal Code
is amended by the addition of Chapter 3.36 to r.ead as follows:

3.36.010 Established.
(a) A fee established by City Council resolution shall
be paid whenever special police services are provided by the
Carlbad Police Department. •rhe fee shall not exceed the cost of
providing the service.
(b) For the purposes of this chapter "special police
services" includes, but is not limited to, providing crime
reports, accident reports, fingerprinting, photographs,
clearance letters and patrol or security officers or equipment
for special events.
3.36.020 Special events.
(a) Whenever a special event~ including but not
limited to exhibits, fairs, athletic events, trade shows,
concerts or conventions~ requires any permit under the
provisions of this code the Chief of Police may as a condition
of the permit require that patrol or security officers or
equipment be provided.
(b) The patrol or security officers or equipment
provided shall be approved by the Chief of Police.
(c) The Chief of Police may require that the patrol or
security officers or equipment shall be provided by the Carlsbad
Police Department as a special police service.
(d) Whenever patrol or security officers or equipment
shall be provided by the Carlsbad Police Department the
applicant shall deposit with the City security in a form
acceptable to the Chief of Police, or cash, in an amount
sufficient to guarantee payment for the cost of providing the
special police service.

(e) Whenever a person holding an event not requiring a
permit requests special police services the provisions of this
section shall apply.
3.36.030 Waiver of fees. Governmental agencies and
non-profit corporations, agencies, or organizations whose
non-profit status is listed and declared by the State of
California may request a waiver of the fees from the City
Council.
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published
at least once in the Carlsbad Journal within fifteen day~ after
its adoption.
