TITLE: TRANSFER OF SEWER CAPACITY DEW. HD..&
AND ClN AlTYW QUARTERLY SEWER STATUS REPORT CIN MGR&*
ITEM EXPLANATION :
At its meeting of July 1, 1980, the City Council adopted Resolution No,. 6226
making 1800 EDU's of sewer capacity available to the public on a first-come,
first-serve basis. This capacity was made available only in the Encina Service
Area and the Palomar Airport Drainage Basin.

the City Council Reserve. Since that time, 795.16 EDU's have been forfeited
from the Second Phase Allocation and'placed in the Council Reserve giving a
current total of 1027.70 EDU's. Staff recommends that Council retain 300 EDU's
for use at their discretion as explained in the staff report and the balance of
727.70 EDU'S be transferred to the "Available to the Public" category so they
may be issued on a routine first-come, first-serve basis.
As of January 1, 1983, there were only 146.16 EDU's in the "Available to the
Public" category. Transferring the 727.70 EDU's will provide a total of
873.86 EDU's in this category, which will probably be sufficient for the
remainder of the year. Encina Expansion Phases I11 and IIIA will probably be
operational about January, 1984, and will provide approximately 6900 additional
EDU's of capacity to Carlsbad.
FISCAL IMPACT:
There is no direct fiscal impact. The transfer will allow the continued
issuance of sewer in a routine manner and avoid possible delays caused by
developers requesting sewer capacity from the Council.
This action does not result in any change in the City's sewer capacity at
Encina.

B. RECOMMENDATION TO REVISE ALLOCATIONS:
Nearly all sewer permits are issued from Category Number 5, Available to the Public. This category has only 146 EDU's left and is expected to be depleted in one or two months. The solution to this problen? is to transfer some EDU's from the Council Reserve to the Available to the Public Category. of forfeitures of allocations and is not required to be kept in reserve.
A reserve is needed to handle the following: City projects; projects which benefit the community; and projects which the Council may decide should proceed in the event there is a sewer moratorium. some sewer capacity remains in the unlikely event of another sewer moratorium.
Most of the reserve capacity occurred as a result

The future sewer demand from projects, which have approved tentative maps or recorded final maps but have not yet been constructed, has been estimated as follows:

Since these developments will require a number of years to complete once they start, no problems with sewer capacity are anticipated, at least for the next several years. Encina Phases I11 and IIIA will be online in January, 1984, and-will provide a total of approximately 6900 EDU's for Carlsbad.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALiFORNIA, AUTHORIZING THE TRANSFER OF 727.70 EDU'S OF
AVAILABLE TO THE PUBLIC SEWER CAPACITY FROM THE CITY COUNCIL RESERVE TO BE MADE
WHEREAS, the City Council, at its meeting of February 1, 1983, received a
report from the City Engineerstatingthat only 146.16 EDU's were available to
the public as of January 1, 1983; and
WHEREAS, to date, 795.16 EDU's from the Second Phase Sewer Allocation have
been forfeited by developers who did not complete projects and said EDU's were
placed in the City Counc.il Reserve.
NOM, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

The above recitations are true and correct.
That the City Coucil is satisfied that 1027.70 EDU's of sewer capacity
are available in the City Council Reserve.
That the City Council desires to maintain a balance in the City Council
Reserve of 300 EDU's.
That the City Council hereby determine that 727.70 EDU's of sewer
capacity from said Reserve shall be made available to the public.
That said sewer capacity shall be available in the Encina Sewer Service
area and the Palomar Airport Drainage Basin as shown on Exhibit A to
Resolution No. 6226.
That except as otherwise provided by the Resolution, all provisions of
Resolution Nos. 6662 and 6226 shall remain in effect.
