RECOMMENDED ACTION:
INDUSTRIAL WASTE DISCHARGE REGULATIONS
It is recommended that the Council introduce an ordinance modifying the C Code relating to the discharge of industsial wastes.
ITEM EXPLANATION:
The ordinances of the six JAC member agencies must be in conformance with
rules and regulations concerning industrial waste discharges prior to fin
grant payments for the Phase I11 enlargement. The city's code was review
Encina Water Pollution Control Facility staff and their recommendations h
been incorporated into the proposed code changes. The changes to our exj
code are considered minor in nature. These changes require:
1. That industrial wastes do not cause total plant effluent dischar
to exceed water quality standards - and sludge disposal standards:
2. That pretreatment plans be developed and approved if pretreatme1
processes are required to meet discharge standards,
Self-monitoring and reporting i:; called for (this has been accon
in the past as a condition of the permit),
Provides for public access to the permit which was not previous:
stated, and,
Authorizes the City Engineer to modify the permits if federal a1
state requirements change in the future.
Additionally, it requires that permits not be transferrable to other ownc
requires they be renewed every three years. This requirement provides u:
better information on the current status of industrial operations.
FISCAL IMPACT:
This code change will cause no increased cost. Industrial pretreatmen/t (
may be a substantial cost to the particular industry based on the type o
they plm to discharge to the plant. Burroughs, as an example, has an e
pretreatment program due to the nature of the plating operations conduct
of this pretreatment program is, however, to recover precious metals fro
processes. Costs for the Encina
Waste monitoring program (about $6,00O/year) are recovered as a part of fee structure.

Subject: Sewer Use Ordinance Revision.
Attached herewith is a checklist of items required by EPA regulations tc be included in local Sewer Use Ordinances. These items are part of the
requirements for an approved Industri a1 Waste Pretreatment Program.
I have reviewed Calrsbad's Ordinance No. 7060, Chapters 13.04 and 13.16 and have noted those items which need attention, and have made sugges- tions for wording and location in the Ordinance for the additions.
1) Checklist requirement 3.iv.(A): The development of a complia schedule by each Industrial User for the installation of tech logy required to meet applicable Pretreatment Standards and Requirements.
"Pretreatment Plants Required: determines that pretreatment is required to make the waste
acceptable, the applicant shall be so notified and shall subn
suitable engineering plans and specifications showing in dett the proposed pretreatment facil ities and pretreatment opera- tional procedures which shall then be included within and become part of the original application. A permit shall not
be issued until such plans, specifications and operational procedures have been reviewed by the Engineer.

(El): The submission of all notict and self-monitoring reports from Industrial Users as are nect sary to assess and assure conipl iance by Industrial Users wit1 Pretreatment Standards and Requirements, including, but not limited to, the reports required in Section 403.12 of the General Pretreatment Regulations.
"Self Monitoring and Reporting: All Industrial Users shall subject to self-monitoring and reporting requirements. The requirements for each appl ic,ible User shall be determined by the Engineer and included in the User's discharge permit."

"Pub1 ic Access to Information: Information and data provided
by an Industrial User identifying the nature and frequency of a discharge shall be available to the public without restric-
tion which may be so submitted or which may be furnished by a User in connection with required periodic reports shall also be available to the public unless the User or other intereste person specifically idenitifies and is able to demonstrate to the satisfaction of the Engineer that the disclosure of such information or a particular part thereof to the general publi would divulge methods or processes entitled to protection as trade secrets. "The Engineer shall be empowered to revise discharge permit requirements to comply with evolving Federal law. Permit revisions or modifications shall not be inconsistent with appl icable Federal Pretreatment Standards."
This paragraph should be inserted after 13.16.050 which deals with issuance of permits.

"Wastes containing substances which are not amenable to treat or reduction by the treatment processes employed, or are amen to treatment only to such a degree that: effluent cannot meet the waste discharge requirements of the Regional Water Quality Control Board or other agencies having jurisdiction over the quality and protection of the receiving waters or b) thethe chosen disposal method.
This paragraph should be inserted in 13.04.050 as letter (1).

WHEREAS, the City Council of the City of Carlsbad is member ager

expansion which is grant funded by tke United States Government and i
