TITLE: REQUEST FOR AUTHORITY

RECOMMENDED ACTION:
Direct staff to proceed to prepare assessment district documents for the
establishment of the James Drive Assessment District and adopt Resolution No.
appropriating funds for the costs of district setup and engineering costs.
ITEM EXPLANATION:
Engineering has received petitions from, and met with, the property owners in
the area of the extension of James Drive, north of Basswood Avenue. A majority
of the affected property owners have indicated an interest and willingness to
participate in an assessment district proceeding. The improvements would involve
paving, storm drains, sewers, street lights, and water service.
Staff will be soliciting consultants' proposals to perform cost assessments and
prepare plans and specifications. Attached is a sketch which indicates a possible
boundary configuration. However, the final boundary and assessment will be
reported to Council in the Engineering Report required by the assessment district
proceedings. Costs for right-of-way are anticipated to be included in the assess-
ments to more equitably distribute costs.
FISCAL IMPACT;
The costs are as follows:
Preliminary Assessment and Engineering Costs $ 40,000
Construction Costs 383,000
Total $423,000
Property owners have asked to have the cost bonded for repayment over a 10-year
period. The initial costs ($40,000) can be paid from Account No. 30-18-40-3100
(Sidewalk Assessment Project) and later reimbursed upon the issuance of the bonds.
Staff is asking for authority to use funds from Account No. 30-18-40-3100 (Side-
walk Assessment Project) for this project. Funds in the amount of $91,222 are
available in this account to cover preliminary assessment district costs. Total
construction cost is estimated at $383,000. Engineering and assessment district
costs are estimated at $40,000. These costs are reimbursable under the assessment
procedures.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE EXPENDITURE
OF FUNDS FOR THE FORMATION OF THE JANES DRIVE
ASSESSMENT DISTRICT.
BE IT RESOLVED by the City Council of the City of Carlsbad, California,
as follows:
That the funds, in the amount not to exceed $40,000, in Miscellaneous
Drainage Project/Sidewalk Assessment District are authorized to be expended
the formation of the James Drive Assessment District to be reimbursed from
