CM RECOMMENDED ACTION: DEPT. HD. CITY ATTY _. CITY MGR. * Council authorize city to construct four lanes of pavement on Alga Road east of El Camino Real and request City Attorney to prepare a reimbursement agreement with Daon Corporation. ITEM EXPLANATION: The approval of Alicante Hills project contained a condition that the developer widen Alga Road by assessment district or bonded agreement prior to recordation of subdivision. City Council. adopted the 1983 Capital Improvement Program, $500,000 was appropriated for Alga Road widening. When the The staff has determined that an assessment district is not feasible because of financial encumbrances on the land. The Alicante Hills project has closed escrow and the new owner wishes to record the final map. However, the city cannot approve recording until the road issue is resolved. Daon Corporation has offered to reimburse the city for Alga widening prior to recording of the next subdivision on Daon property. Daon requests that City Council accept the reimbursement agree- ment as satisfying condition 47 on the Alicante project. FISCAL IMPACT: The estimated cost of the road widening is $500,000. City would be advancing that amount for an unknown length of time. Interest could be charged on the reimbursement amount. Daon has agreed to contribute about $30,000 to the project immedi- ately. ITEM EXPLANATION The City Council, at your meeting of October 15, 1982, introduced Ordinance No. 9648 approving ZC-262. In addition, the City Counc directed the City Attorney to prepare the necessary document approving a 40 Lot/490 unit Tentative Tract Map CT 82-15 and Condominium Permit CP-212. That resolution is attached, 1 Condition numbers 20 and 47 have been amended to read as follows: Condition #20: "All grading equipment shall be maintained in top operating condition with adequate mufflers to mitigate noise impacts. shall be limited to the hours of 7:30 a.m. to 8:OO p.m., On site maintenance of equipment Monday through Saturday." .- Condition #47: "Prior to final map approval the developer shall construct the north half of Alga Road from Alicante Road to El Camino Real. Prior to final map approval the City may initiate special assessment district proceedings for said road and developer shall agree to consent to the formation of the district. If silch proceedings are consumated prior to final map approval developer is relieved from his obligation to construct the road in return for his participation in the district. If the City chooses not to initiate the district the City Council may elect to accept a secured agreement from developer for construction of the road provided such agreement provides for the construction within six months of the date the final map is approved."
